or produce of the eftate of the faid Robert Dalzell, late earl of Carnwath, fo forfeited as aforefaid, fuch fum or fums of money (after paying the proportionable part of the demands of fuch creditors, whofe claims have been allowed upon, and do affect the said eftate) shall and may be taken, iffued and applied, for and towards the future fupport and maintenance of the faid Robert Dalzell, late earl of Carnwath, and his family, and for the payment of his debts, without account, impreft or other charge to be fet upon him for the fame, as his Majesty in his great goodness shall, by his fign manual, think fit to direct and appoint: and the commiffioners of his Majesty's treasury, or any three or more of them, or the high treasurer for the time being, are hereby authorized, impowered and directed, to caufe the fame to be paid to the said Robert Dalzell, late earl of Carnwath, or his affigns accordingly, without abatement for fees, charges or other deductions whatfoever; any former law, cuftom or ftatute to the contrary, or any incapacity by reason of the attainder of the faid Robert Dalzell, late earl of Carnwath, notwithstanding.

CAP. XI.

An act to prevent multiplicity of prosecutions upon an act made in the eleventh and twelfth years of the reign of his late majesty King William the Third, intituled, An act for the more effectual employing the poor, by encouraging the manufactures of this kingdom.

WHEREAS by an act made in the eleventh and twelfth years

of the reign of his late majesty King William the Third of glorious memory, intituled, An act for the more effectual employing the poor, by encouraging the manufactures of this kingdom, it is, amongst other things enacted, That all wrought filks, bengals, and fluffs mixed with filk or Herba of the manufacture of Perfia, China, or Eaft-India, and all callicoes painted, dyed, printed or ftained there, whether the fame shall be mixed, fewed or made up together for fale, with any other goods or materials, or otherwife, which from and after the twenty ninth day of September one thoufand feven hundred and one, fhall be found in any house, shop or warehouse, or other place whatsoever (other than in fuch warehouses, as shall be approved of by the commissioners of his Majesty's customs) fhall be forfeited, and fubject and liable to be fearched for and seized; in which faid act it is provided, that the powers therein shall not extend to any fuch filks, bengals, stuffs on callicoes which shall have been made up and ufed in any fort of apparel or furniture before the faid twenty ninth day of September one thousand feven hundred and one : and whereas several perfons have, fince the faid twenty ninth day of September one thousand feven hundred and one, inadvertently made up and used the said prohibited goods in furniture and boufbold-stuff, believing the act extended to apparel only, and thereby have fubjected themfelves to the penalties of the faid act for remedy whereof, and preventing the numberlefs profecutions that might happen from

fuch inadvertency, be it enacted by the King's most excellent majesty, by and with the advice and confent of the lords fpiritual and temporal and commons, in this prefent parliament affembled, and by the authority of the fame, That the faid recited act, or any thing therein contained, thall not extend to any filks, bengals or ftuffs mixed with filk or Herba, or painted, dyed, printed or stained callicoes, manufactured in Perfia, Chind or Eaft-India, which were made up, or ufed in furniture or houshold-ftuff before the twenty fifth day of December one thoufand seven hundred and twenty two; any thing in the said recited act, or any other act or acts of parliament to the contrary notwithstanding.

CAP. XII.

An act for repairing the roads leading from Stump-Crofs, in the parish of Chesterford in the county of Effex, to Newmarket-Heath, and the town of Cambridge, in the county of Cambridge.

This act took place 1 June 1724, and is to continue for 21 years. Continued by 15 Geo. 2. c. 16.

CAP. XIII.

An act for amending the roads from the ftones-end in Southwark to Highgate, at the entrance of Afhdown foreft in the parish of EastGrinstead in the county of Suffex, and from Kingston to Burton-Common, and also the lane leading from Wood-Hatch to Sidlow-Mill, and the lanes called Horfe-hills, Bonehurst alias Boners, and PeteridgeLanes, in the county of Surrey, by enlarging the terms granted by two former acts, one of the fourth, and the other of the fixth year of his Majefty's reign.

The powers, &c. in the private act 4 Geo. 1. c. 4. which were to continue for 21 years from 25 March 1718, which term was enlarged by 6 Geo. 1. c. 26. for two years, are further continued for twenty one years longer from thence next ensuing, for the purposes in this act. Farther continued by 25 Geo. 2. c. 51.

CAP. XIV.

An act for enlarging the times for bearing and determining claims by the trustees for raising money upon the estates of the late directors of the South-Sea company, and others; and for reviving and continuing the provifion formerly made against requiring fpecial bail in actions or fuits upon contracts for stock or subscriptions, between the first day of December one thousand feven hundred and nineteen, and the first day of December one thousand seven hundred and twenty; and for other purposes therein mentioned.

WHE

HEREAS by an act of parliament made in the feventh year of his Majesty's reign, intituled, An act for raising money upon the eftates of the late fub-governor, deputy-governor, directors, cashier, deputy-cafhier, and accountant of the South-Sea company, and of John Aislabie, efquire, and likewife of James Craggs, fen. efquire, deceafed, towards making good the great lofs and damage fuftained by the faid company; and

for

for difabling fuch of the faid perfons as are living to hold any office or place of truft under the crown, or to fit or vote in parliament for the future; and for other purposes in the faid act expreffed it is enacted (amongst other things) That all and every the real estate and eftates whatsoever, and of what nature or kind foever, and all rights of action, uses, trufts, powers and authorities whatsoever, and all and every the share and shares in the capital stock or stocks of any corporation, company or fociety, and all monies due upon any account or accounts balanced or to be balanced, and all other debts and fecurities for debts, and all ready monies, goods, and merchandizes, perfonal eftate and effects whatsoever, of what nature or kind foever, which Sir John Fellows, baronet, late fub-governor, Charles Joye, efquire, late deputy-governor, and William Aftell, efquire, Sir Lambert Blackwell, baronet, Sir John Blunt, baronet, Sir Robert Chaplain, baronet, Sir William Chapman, knight and baronet, Robert Chester, efquire, Stephen Child, efquire, Peter Delaporte, efquire, Francis Eyles, efquire, James Edmondfon, efquire, Edward Gibbon, efquire, John Gore, efquire, Sir William Hammond, knight, Francis Hawes, efquire, Richard Horfey, efquire, Richard Houlditch, efquire, Sir Theodore Janffen, knight and baronet, Sir Jacob Jacobson, knight, Arthur Ingram, efquire, Sir John Lambert, baronet, Sir Harcourt Mafter, knight, William Morley, efquire, Ambrofe Page, efquire, colonel Hugh Raymond, Samuel Read junior, efquire, Thomas Reynolds, efquire, Jacob Sawbridge, efquire, William Tillard, efquire, and John Turner, efquire, late directors of the corporation of the governor and company of merchants of Great Britain trading to the South-Seas, and other parts of America, and for encouraging the fishery, commonly called the South-Sea company, and also Robert Knight late treasurer or cashier, Robert Surman late deputy-cafbier, John Grigsby late accountant to the faid corporation, and John Aislabie, efquire, every or any of them, upon the first day of June anno Domini one thousand feven hundred and twenty, or at any time or times afterwards, or which James Craggs the elder, deceased, or any person or perfons in trust for him at the time of his death, was or were feised or possessed of, or interested in, or entitled unto, in law or equity in their or any of their own rights, or to bis or their own use or uses, or in partnership with any others (except as in the faid act is excepted) were, by force and virtue of the faid act, vefted and fettled in Sir John Eyles baronet, Sir Thomas Croife baronet, John Rudge, Matthew Lant, Roger Hudson, efquires, now Sir Roger Hudfon knight, Edmund Halfey, John Lade, Gabriel Roberts, and Richard Hopkins, efquires, now Sir Richard Hopkins knight, thereby nominated and appointed trustees for the ufes and purposes in the faid act expressed of and concerning the fame, and the heirs, executors, adminiflrators and affigns of the fame trustees, from the respective times in the faid act named, to the intent the fame might be fold and difpofed of, or otherwife applied to and for the ufes and purposes in the jaid act expreffed concerning the fame, and that the clear monies arifing thereby, fhould be appropriated to and for the use of the VOL. XV.

South-Sea company, in fuch manner as therein is expressed: and it is thereby further enacted, That the entries of fuch claims, as by the faid act are directed, by or for any perfon or corporation in Great Britain, fhould or might be made at any time before the twenty-fifth day of December one thousand seven hundred and twenty one, and by or for any person or persons refiding or being beyond the feas, or out of Great Britain, should and might be made at any time before the twenty fifth day of March one thousand seven hundred and twenty two: and by the faid act it is further enacted, That the faid trustees, or any three or more of them, should and might inquire and inform themselves, by or upon the teflimony of witnesses upon oath, or by the examination of the perfons making fuch claims upon cath (all which oaths they, or any one or more of them, had thereby power to adminifter) or by the inspection of any mortgages, bonds, bills, notes, or other fecurities, or any accounts relating to the faid debts, or any of them fo claimed, or by inspection of any grants, gifts, settlements, conveyances, transfers, or assurances relating to the said eftates, interefts, or incumbrances fo claimed, or any of them, or by all or any of the faid ways and means, or otherwife, according to their difcretions, as foon as conveniently might be, touching all or any of the debts, eftates, interefts, or incumbrances fo claimed, and should make a report or reports in writing of their proceedings therein, with their opinions thereon, from time to time, to the court of directors of the faid South-Sea company for the time being; and if the faid court of directors for the time being should be fatisfied in the justice of such claim or claims, or that any debt or fum of money ought to be paid thereupon, or that the eftate, intereft, or incumbrance fo claimed, or any part thereof, ought to be allowed, and should declare their fatiffaction therein, by any refolution or refolutions of that court; and if the party or parties, by or for whom such claim should be made, should likewife, in a book or books to be kept in the faid trustees publick office for that purpose, declare in writing under his, her or their hands, his, her or their acquiefcence in fuch refolution or resolutions of the faid court of directors for the time being, touching his, her or their debt, estate, interest, or incumbrance fo claimed, at any time or times before the first day of August one thousand seven hundred and twenty two, then in all and every fuch cafe and cafes the faid trustees, or any three or more of them, fhould give warrant for the payment and discharge of every such debt or fum of money fo liquidated or adjusted, out of fuch monies as fhould come to the hands of the cashier of the faid South-Sea company for the time being, for the purposes in the faid act expreffed: and it was by the faid act further enacted, That the juftices of the courts of King's bench and common pleas, and barons of the coif of the exchequer for the time being, or any three or more of them, fitting at the fame time and place, and not otherwife, should, and they were thereby authorized, from time to time, to hear and determine all differences, disputes and controverfies touching or concerning any debts, eftates, interefts, or incumbrances, which should be claimed within the refpective times therein before limited for making fuch claims, and could not or fould not be liquidated or adjufted between the faid court of directors for the time

being, and the refpective claimants within the time before limited in that behalf, and all incidents relating thereunto, in fuch manner, as by the faid act is directed and by the faid act it is further enacted, Geo. 1. ftat.1, That the faid juftices and barons, or any three or more of them, upon a complaint to be made by or for any claimant of any fuch debt, eftate, intereft, or incumbrance, whofe claims should not be liquidated or adjusted as aforefaid, (fo as fuch complaint be made on or before the twenty fifth day of December one thousand seven hundred and twenty two) should proceed in fuch manner as by the faid act is directed; and the faid juftices and barons, or any three or more of them, in all cafes where they should find that any debt or fum of money ought to be paid to fuch claimant upon fuch claims, or that the eftate, intereft, or incumbrance fo claimed, or any part thereof ought to be allowed, fhould and might, at any time or times before the twenty fifth day of March one thousand feven hundred and twenty three, tranfmit a certificate or certificates thereof to the faid trustees in the faid act nominated and by the faid act it is provided and enacted, That the powers given by the faid act to the faid juftices and barons, for hearing and determining fuch differences, difputes and controverfies relating to fuch claims as aforefaid, and ifjuing their certificates concerning the fame as aforefaid, fhould continue and be in force until the twenty fifth day of March one thousand seven hundred and twenty three and no longer. And whereas by another act of parliament made in the eighth year of his Majesty's reign, intituled, An act for pro- 8 Geo. r. c. 23. longing the times for hearing and determining claims before the trustees, in whom the estates of the late South-Sea directors, and of John Aiflabie efquire, and likewife of James Craggs, efquire, deceased, are vested, and for other purposes therein mentioned; feveral of the times in the former acts limited, have been enlarged to Several further times therein expressed: and whereas by another act

of parliament made in the ninth year of his faid Majefty's reign, intitu- 9 Geo. 1. c. 237 led, An act for further enlarging the times for entring, hearing and determining claims on the eftates vefted in the truftees of the South-Sea company, and for obliging perfons to claim stock. by the time therein mentioned, for money fubfcriptions, and for other the purposes therein mentioned, the times in the last mentioned act limited, have been enlarged to feveral further times therein expressed, which times by the last act limited, are now near expiring now forafmuch as the claims made purfuant to the firft, and alfo to the last recited act, cannot be adjusted and determined within the times already limited for the fame; may it. please your most excellent Majefty, that it may be enacted, &c. The time for the directors of the South-Sea company to declare their fatisfaction of the justice of any claims, further enlarged to 24 December 1726. and for the juftices and barons to determine differences therein, enlarged to 24 June 1727. and for the juftices and barons to tranfmit their certificates, to 29 September 1727. After 20 May 1724. the time for declaring an acquiefcence to any refolution of the directors, and for making complaints for claimants, to be within 30 days after perfonal notice, or notice in the Gazette, of fuch refolution. Complaints not fo made, void, and the juftices, &c. difcharged from proceeding thereon. If no acquiefcence be declared, the party deemed to have acquiefced. Wives of per
