pany in which he ferved, was reduced; that no perfon fhall have or receive any part of the fame, except fuch perfons who did actual fervice in fome regiment, troop or company; that no perfon having any other place or employment of profit, civil or military, under his Majefty, fhall have or receive any part of the half-pay that no chaplain of any garrifon or regiment, who has any ecclefiaftical benefice, or other preferment in Great Britain or Ireland, fhall have or receive any of the faid half-pay; that no perfon fhall have or receive any part of the fame, who hath refigned his commiffion, and has had no commiffion fince; that no part of the fame thall be allowed to any perfons, by virtue of any warrant or appointment, except to fuch perfons who would have been otherwife entitled to the fame, as reduced. officers; and that no part of the fame fhall be allowed to any of the officers of the five regiments of dragoons, and eight regiments of foot lately difbanded in Ireland, except to fuch as were lately taken off the establishment of half-pay in Great Britain.

The overplus, XXII. And whereas by an act of parliament made in the tenth how to be dif- year of his Majesty's reign, for continuing the duties on malt, mum, pofed of. cyder and perry, to raise money by way of a lottery for the fervice of the year one thousand feven hundred twenty four, and for other purposes therein expreffed, several supplies which had been granted to his Majefty, as is therein mentioned, were appropriated to feveral ufes and purposes therein expressed, among which any fum or fums not exceeding the fum of feventy nine thousand pounds, upon account of half-pay for the year one thousand feven hundred and twenty four, was appropriated to be paid to the reduced officers of his Majefty's land-forces and marines, fubject nevertheless to fuch rules to be cbferved in the application of the faid half-pay, as in and by the aforefaid act were prefcribed in that behalf: now it is hereby provided, enacted and declared by the authority aforefaid, That fo much of the faid fum of feventy nine thoufand pounds, as is or fhall be more than fufficient to satisfy the said reduced officers, according to the faid rules by the aforefaid act prescribed to be observed in the application thereof, or any part of fuch overplus, fhall or may be difposed to such officers who were maimed or loft their limbs in the late wars, or to fuch others as by reason of their long service, or otherwife, his Majesty fhall judge to be proper objects of charity, or to the widows or children of fuch officers, according to fuch warrant or warrants under his Majesty's royal fign manual, as shall be signed in that behalf; any thing in this act, or the faid former act, to the contrary notwithstanding.

An act for continuing the feveral annuities of eighty eight thousand feven hundred fifty one pounds feven fhillings and ten pence halfpenny, and one hundred thousand pounds tó the bank of England, until Midfummer one thousand Seven hundred twenty seven; and from thence, for reducing the fame to Seventy one thousand and one pounds two sbillings and three pence three farthings, and eighty thousand pounds, redeemable by parliament; and for preventing the uttering of forged, counterfeited or erafed bank-bills or

notes.

WHEREAS

THEREAS by an act of parliament, made and paffed in the 7 Anne, c. 7. Seventh year of the reign of ber late majesty Queen Anne, (of blessed memory) intituled, An act for enlarging the capital stock of the bank of England; and for raising a further supply to her Majefty, for the fervice of the year one thousand seven hundred and nine; the governor and company of the bank of England were obliged, in the manner therein mentioned, to deliver up to be cancelled certain exchequer-bills, which had been made forth by a former act of parliament in that behalf; which bills, with intereft thereupon, were computed to amount to feventeen hundred seventy-five thoufand twenty feven pounds feventeen fillings and ten pence halfpenny; and to the end the faid governor and company of the bank of England, and their fucceffors, might have a competent recompence and confideration for fo doing, and for all their demands relating thereto, it was by the faid act of the feventh year of her faid late Majefty's reign enacted, that from and after the feast of Saint Michael the Archangel in the year of our Lord one thousand feven hundred and ten, the faid governor and company of the bank of England, and their fucceffors, should have, receive and enjoy one annuity or yearly fum of one hundred and fix thousand and five hundred and one pounds thirteen fillings and five pence, out of fuch duties on houfes as are therein mentioned: but it was thereby provided and enacted, That at any time, upon one year's notice to the faid governor and company of the bank of England, or their fucceffors, and upon full payment to them of the faid fum of one million feven hundred feventy five thoufand twenty feven pounds feventeen fillings and ten pence halfpenny, and of all arrears of the faid annuity of one hundred and fix thoufand five hundred and one pounds thirteen fhillings and five pence per annum, (if any should be then due) then, and not till then, the said annuity of one hundred and fix thousand five hundred and one pounds thirteen fillings and five pence per annum, fhould ceafe and determine; and then alfo the faid duties on houfes fhould be understood to be redeemed by parliament, and fhould not be issued, paid or applied to any use or purpose whatsoever, but by the authority of parliament : and whereas in an act of parliament, made and pased in the third year of your Majesty's reign, intituled, An act for redeeming fe- 3 Geo, 1. c. 8.

veral funds of the governor and company of the bank of England, pursuant to former provifoes of redemption; and for fecuring to them several new funds and allowances redeemable by parliament; and for obliging them to advance further fums not exceeding two millions five hundred thousand pounds, at five pounds per centum per annum, as shall be found neceffary to be employed in leffening the national debts and incumbrances; and for continuing certain provifions formerly made for the expence of your Majesty's civil government; and for payment of annuities formerly purchased at the rate of five pounds per centum; and for other purposes in the said act mentioned, reciting, that the faid governor and company of the bank of England, in regard the common rate of intereft-money was very much leffened under your Majesty's most aufpicious government, and that feveral of the funds of the faid governor and company of the bank of England, in the faid act mentioned, were redeemable at fuch times, and in fuch manner, as in the faid act are particularly fet forth; and that they the faid governor and company were willing and contented to accept one annuity of eighty eight thousand feven hundred fifty one pounds seven fillings and ten pence halfpenny, being after the rate of five pounds per centum per annum, on the faid principal fum of one million feven hundred seventy five thousand twenty feven pounds feventeen fhillings and ten pence halfpenny, in lieu of their then prefent annuity or fum of one hundred and fix thousand five hundred and one pounds thirteen fhillings and five pence per annum; and that the faid governor and company were alfo willing and contented to discharge and deliver up to be cancelled, as many of the exchequer-bills, formerly made forth, as amounted to two millions in principal money, and to accept an annuity or fum of one hundred thousand, pounds per annum, being after the rate of five pounds per centum per annum, for the fame: it was in and by the faid act of the third year of your Majesty's reign enacted, That the faid governor and company of the bank of England, and their fucceffors, fhould have, receive and enjoy the faid annuity or yearly fum of eighty eight thousand feven hundred fifty one pounds feven fillings and ten pence halfpenny, in respect of the faid principal fum of one million feven hundred feventy five thousand twenty feven pounds feventeen fhillings and ten pence halfpenny; which annual or yearly sum of eighty eight thousand seven hundred fifty one pounds seven shillings and ten pence halfpenny, was thereby charged upon, and made payable from time to time, out of all the monies arifen or to arife, at the receipt of your Majesty's exchequer, of or for the particular duties on boufes therein mentioned, and of or for the faid duties and revenues, commonly called the aggregate fund, and every or any of them, and was to be paid to the faid governor and company of the bank of England, and their fucceffors for ever, from the feaft of the nativity of Saint John Baptift one thousand seven hundred and eighteen, at the four most ufual feafts or days of payment in the year, by even and equal portions; all which payments were to be made in fuch manner and form, and with such preference as are in the faid alt prescribed in that behalf: but it was thereby alfo provided and enacted, That upon one year's notice to be given at the faid feast of the nativity of

Saint John Baptist one thousand seven hundred and eighteen, or any quarterly feaft-day after, and upon repayment by parliament, to the Jaid governor and company of the bank of England, or their fucceffors, of the faid fum of one million feven hundred feventy five thoufand twenty Seven pounds feventeen fillings and ten pence halfpenny, and of all arrears of the faid annuity of eighty eight thousand feven hundred fifty one pounds feven fillings and ten pence halfpenny per annum, (if any fhould be then due) then, and not till then, the faid annuity of eighty eight thousand feven hundred fifty one pounds feven fbillings and ten pence halfpenny per annum, fhould ceafe and determine; and in and by the jaid act it was further provided and enacted, That the faid governor and company of the bank of England should, on or before the twenty fifth day of December one thousand feven hundred and feventeen, deliver up as many exchequer-bills formerly made forth (then being uncancelled and undifcharged) as amounted to the sum of two millions in principal money, to fuch perfon or perfons as the commiffioners of his Majesty's treasury, or any three or more of them, or the high treasurer for the time being, should nominate, to be discharged, cancelled and made void; and that, from and after the feaft of the birth of our Lord Chrift one thousand seven hundred and Seventeen, the faid governor and company of the bank of England, and their fucceffors for ever, fhould have, receive and enjoy one annuity or yearly Jum of one hundred thousand pounds, being after the rate of five pounds per centum per annum, computed upon the faid principal fum of two millions; which yearly fum of one hundred thousand pounds was thereby charged upon and made payable, from time to time, out of all the monies arifing or to arife at the receipt of your Majesty's exchequer, as well of or for the faid feveral duties, revenues and incomes, called the aggregate fund aforesaid, as of or for the faid particular duties on houses, and was to be paid at fuch times, and in fuch manner and form, and with such preference as are in the said act prescribed in that behalf: and it is by the faid act alfo enacted and provided, That at any time, upon one year's notice to be given at the feast of the birth of our Lord Chrift one thousand seven hundred and feventeen, or any quarterly feaft-day after, and not before, and upon repayment by parliament to the faid governor and company of the bank of England, or their successors, of the said sum of two millions, and of all arrearages of the faid yearly fum of one hundred thousand pounds (if any should be due at the time of such payments)then, and not till then, the faid annuity of one hundred thoufand pounds per annum fhould ceafe and determine, as in and by the faid act it doth and may more fully and at large appear : and whereas, pursuant to the faid act, and the provisions therein contained, the Said governor and company of the bank of England did, on or before the twenty fifth day of December one thousand seven hundred and feventeen, deliver up as many of the faid exchequer-bills as amounted to the faid fum of two millions in principal money, and the fame were difcharged, cancelled and made void; and they the faid governor and company of the bank of England have, ever fince the faid feast of the birth of our Lord Chrift one thousand seven hundred and feventeen, received and enjoyed the said annuity or yearly fum of one hundred

thousand pounds, and are fill entitled unto the fame: and whereas in 5 Geo. 1. c. 3. and by one other act of parliament made in the fifth year of your Majefty's reign, intituled, An act for applying certain overplus monies, and further fums to be raised, as well by way of a lottery as by loans, towards paying off and cancelling exchequer-bills, and for leffening the prefent great charge in relation to thofe bills, and for circulating and exchanging for ready money the refidue of the fame bills for the future, it is among ft divers other matters and things enacted and declared, That all the faid particular duties on houfes, and all the frid other rates, duties, revenues and in3 Geo. 1. c. 8. comes, which by the faid act of the third year of your Majesty's reign were fettled for answering the refpective payments therein mentioned (and which are denominated to be the aggregate fund) and every of them should be continued, and be paid and payable to your Majesty, your heirs and fucceffors for ever, and that all the monies of the faid duties, revenues and intomes, which should or ought to be brought into the receipt of the exchequer, (except the neceffary charges of raising, collecting, levying, iffuing, paying and accounting for the fame) should be and are hereby appropriated, and should be issued and applied to and for the repayment and fatisfaction of feveral yearly and other funs in the faid act particularly expressed, in the due course, and with fuch preferences as are thereby appointed, amongst which payments an exprefs provifion is made for payment of the jaid feveral and respective annuities of eighty eight thousand feven hundred fifty one pounds fevert Shillings and ten pence halfpenny, and one hundred thousand pounds per annum; and it was thereby enacted, That the said several annuities, and either of them, fhould feverally and refpectively be redeemable upon such payments, and in fuch manner and form as in and by the respective provifions contained in the recited act of the third year of your Majefly's reign, are prefcribed for the redemption thereof: and whereas due notice was given by the right honourable Spenčer Compton, efquire, speaker of the house of commons, to the faid governor and company of the bank of England, for paying of the faid principal fum of one million feven hundred seventy five thousand twenty feven pounds feventeen fhillings and ten pence halfpenny, and for redeeming the faid annuity of eighty eight thousand seven hundred fifty one pounds feven fillings and ten pence halfpenny, attending thereon, at the feast of the nativity of Saint John Baptist which shall be in the year of our Lord one thousand seven hundred and twenty five, and pursuant to the faid notice, the fame is redeemable accordingly and whereas the governor and company of the bank of England have agreed and confented, That in cafe they may be permitted. to enjoy the said annuities of eighty eight thousand seven hundred fifty one pounds feven fillings and ten pence halfpenny, and one hundred thousand pounds, until the feast of the nativity of Saint John Baptift which shall be in the year of our Lord one thousand feven hundred Further provi- and twenty feven; that from and after the faid feast-day not only fions relating their faid annuity of eighty eight thousand feven hundred fifty one hereto, 1 Geo. pounds feven fillings and ten pence halfpenny, but also their annuity 2. ftat. 2. c. 8. of one hundred thousand pounds per annum, upon the respective fums 2 Geo. 2. c. 3. of one million feven hundred feventy five thousand twenty seven pounds
