XXIX. And be it enacted by the authority aforefaid, That the commiflioners of his Majefty's treasury now being, or the lord high treasurer or commiffioners of the treafury for the time being fhall, on or before the twenty ninth day of September one thousand seven hundred and twenty fix, by and out of the monics arifing out of the contributions on this act, or by and out of any other monies granted to his Majefty for the fervice of the year one thousand seven hundred and twenty fix, provide and direct, that all the faid exchequer bills now remaining undischarged, and fo, as aforefaid, amounting to nine hundred and ninety thousand pounds principal money, be effectually difcharged and cancelled; and that in the mean time and until the effectual discharging and cancelling the fame, or referving fufficient money in the exchequer for discharging and cancelling the fame upon demand, all and every the duties and revenues by the said recited act of the eleventh year of his Majesty's reign appropriated for the circulating, exchanging and finally cancelling the fame, thall remain, continue and be fubject and liable to the circulating, exchanging and cancelling the fame in the fame manner, to all intents and purposes, as they were fubject and liable before the making of this act; any thing herein before contained to the contrary thereof in any wife notwithstanding.

CAP. IV.

An act for continuing the duties upon malt, mum, cyder and perry, in that part of Great Britain called England; and for granting to his Majefty certain duties upon malt, mum, cyder and perry, in that part of Great Britain called Scotland, for the fervice of the year one thousand seven hundred and twenty fix; and for the more effectual preventing frauds and abuses in the shipping of mali for exportation to foreign parts; and for afcertaining the price of ale to be fold in Scotland; and for making good the deficiency on the lottery-tickets of the year one thousand feven bundred and twenty four; and for making forth duplicates of exchequer-bills, lottery-tickets and orders, loft, burnt or otherwife deftroyed.

ND whereas it hath been found by experience, That

malt at the time of making thereof, by means whereof the makers of any drawback Such malt are encouraged to run out their malt into combe, and thereby allowed on exin the making thereof increase the fame, before it be dried, to more portation. than double the quantity which the fame individual parcel of malt so exported did contain by gaging or measure, when the fame was gaged and charged by the officers for the duties chargeable thereon; and notwithstanding the allowances and abatements made by the faid act out of every twenty bushels of malt, at the time that the duties charged thereon are paid, that is to fay, an abatement or allowance of four out of every twenty bushels of malt which shall be charged by the officer by a gage taken in the cistern or in the couch, and in cafe the charge fhall be made from a gage which shall be taken upon the floor, then an allowance or abatement of the duties of ten bushels out of every twenty bushels which shall be so charged from fuch floor gage; notwithstanding which abatements and allowances fo made out of the faid duties as aforefaid, yet nevertheless the faid exporters do demand and infift upon it, that they are to have a drawback of fix pence for every bufhel of malt fo by them exported as aforefaid, although the fame malt fo exported, by their fraudulent way of working the fame, is worth little more than the drawback paid and allowed on the exportation thereof, to the great difparagement of the British malt in foreign parts, and the diminution of his Majesty's duties upon malt: for remedy whereof be it enacted by the authority aforefaid, That from and after the twenty fourth day of fune one thousand seven hundred and twenty fix no malt which fhall be entred and made. for exportation only, in the manner by this act prescribed and directed, fhall, by virtue of this act, be charged or chargeable, or fubject or liable to any of the duties by this act charged or impofed upon any malt to be made in Great Britain; and that no drawback out of the duties on malt by this act granted, shall be paid or allowed for any malt whatfoever, which from and after the faid twenty fourth day of June one thousand seven hundred and twenty fix fhall be made and exported from any part of Great Britain to parts beyond the feas.

XLIX. And be it further enacted by the authority aforefaid, That from and after the faid twenty fourth day of June one thousand seven hundred and twenty fix, all and every malfter intended for and maker of malt for exportation fhall from time to time, be- exportation. fore he, the or they fhall begin to wet or fteep any fteeping of corn or grain to be made into malt for exportation, give or leave notice in writing with the refpective officer or officers for the faid duties on malt for the divifion or place where such malt is to be and shall be made, of the respective quantities of corn or grain intended to be contained in each steeping fo by him, her or them intended to be made into malt for exportation to parts beyond the feas; which faid corn or grain fo intended to be made into malt for exportation fhall from time to time be kept separate and apart, by the refpective makers thereof, from all other corn or gain, either made or to be made into malt for home confumption, on pain of forfeiting the fum of five fhil

LI. And be it further enacted by the authority aforefaid, That when the malt fo intended for exportation as aforesaid fhall be fully made and dried, and fit for exportation, the carried direct- fame fhall from time to time, in the prefence of the respective ly on shipofficer or officers for the faid duties in the faid divifion or board in prefence of an place where the fame was made, be meafured and carried, by the refpective makers or proprietors thereof, directly on fhipboard, if intended to be immediately exported, or else into one or to be locked or more room or rooms, ftorehouse or storehouses, or other up in a store- place or places to be provided by and at the expence of the respective makers or proprietors of the faid malt fo made for exportation, there to be kept feparate and apart from all other malt, under two locks and two keys to each place into which the faid malt shall be carried; one of thofe locks to be provided by the respective makers or proprietors of the said malt, and the other lock to be provided by the supervisor or officer for the faid duties in the divifion or place where the faid malt fhall be locked up, at the expence of the proprietor of the faid malt, whereof one key of each place to be kept by the respective makers or proprietors of the faid malt, and the other key by the officer for the faid duties for the time being of the division or place where the faid malt shall be kept, until the fame fhall be delivered out for exportation.

LII. LIII. LIV. And be it further enacted by the authority aforefaid, Officers to That the faid respective officers do and shall, from time to time, keep an ackeep a true account of all the malt which fhall be fo delivered malt fo delias aforefaid, and of the perfon or perfons to whom the fame be- vered out, &c. longs; and thall and is hereby required to give to the perfon to whom or for whom each quantity of malt fhall be fo delivered out, a certificate in writing, directed to the officer for the faid duties in the divifion or place to which the fame is intended to be removed, in order to be exported, expreffing the quantity of malt fo delivered out, and the name or names of the respective makers or proprietors thereof, and the refpective divifions or places from whence the fame was fo delivered out; which faid certificate or certificates fhall be figned by the refpective officers giving the fame, and fhall be delivered to the refpective officers. for the faid duties for the time being, of the port or place where the faid malt fhall be fo carried to be exported, who fhall duly file and keep the fame, and make an entry thereof in a book or books to be respectively kept by him or them for that purpose, to the intent that upon enquiry and examination it may be difcovered whether any maker of malt for exportation fhall duly export all fuch malt, as fhall be entred by him or them respectively for exportation as aforefaid; and in cafe the maker or proprietor of fuch malt, fo removed from the place of making thereof, fhall neglect or refufe to deliver and procure to be de

livered fuch certificate or certificates to fuch officer for the faid duties of the divifion or place to which the faid malt fhall be removed in order to be exported, to the intent that the fame may be filed and entred in the manner in this act before expreffed, then and in fuch case the maker or proprietor, fo refufing or neglecting to deliver the fame, fhall, for every fuch refufal, forfeit and lofe the fum of fifty pounds.

LV. And be it further enacted by the authority aforefaid, port to attend That it fhall and may be lawful to and for any the officers for the measuring the malt, and the faid duty on malt, in fuch of the ports of this kingdom, where any malt may, is or shall be shipped, in order to be exboard till the ported to parts beyond the feas, not only to fee and attend the thip be cleared. measuring of all malt which shall be shipped or laid on board any ship or vessel for exportation to parts beyond the feas, in fuch port or ports respectively, but alfo to continue on board fuch ships or veffels on which fuch malt shall be loaden or shipped, until the fame shall be respectively cleared their respective ports.

Notice to be

LVI. And it is alfo hereby further enacted by the authority aforefaid, That from time to time, during the fhipping of malt for exportation on board any ship or veffel, at all fuch times as the refpective proprietors or exporters fhall not be actually putting malt or other merchandizes on board, the hatches of the faid ships or veffels fhall and may be kept locked down with two locks and two keys to each hatch; one of those locks to be provided, and the key thereof kept by the respective proprietors or exporters, and the other lock to be provided, and the key thereof kept by the respective officer or officers appointed to attend the said shipping; and that the faid hatches be kept locked down in the aforesaid manner, from the time the said ships or vessels fhall be fully loaded, until the time the same shall be ready to fail from their refpective ports to foreign parts, to the intent that none of the malt put on board may be relanded.

LVII. And be it further enacted by the authority aforefaid, given to the That every perfon or perfons who fhall intend to fhip any malt officer of the for exportation, thall, by the space of forty eight hours at least port when the putting on before the beginning to fhip, or put on board any ship or veffel board of malt any malt for exportation, give or fend to such officer or officers is to be begun. as aforefaid, of the port or place where fuch malt fhall be intended to be shipped or put on board, notice in writing of the particular day, and of the precise hour of such day, when fuch thipping or putting on board of fuch malt is intended to be begun, and also the name of the fhip or veffel fuch malt is to be put on board, on pain to forfeit and lofe the fum of five fhillings for every bushel of malt, which shall be shipped or put on board for exportation without fuch notice fo given or fent as aforefaid; and in case it shall appear, that any of the malt fo entred and made for exportation as aforefaid, fhall not within the space of nine months next after the making and drying thereof, and carrying the fame into fuch room or rooms, ware-houses, ftore houfes or other places, and there locked up and fecured as afore
