• cafh; which deficient masters are hereby required to enter the
'fame in their respective books, left at the bank and at the re-
'port-office, but not caufewife, till they fhall feverally have made
good their deficiencies, except fuch fecurities or stocks as were
specifically appropriated, or trufts declared, to or for any of the
fuitors of this court; which faid ftocks and fecurities fuch de-
• ficient masters, as well as the other masters, are respectively to
enter in their faid respective books causewife; and the bank is to
' receive the intereft, produce and dividends of all the faid fe-
'curities, annuities and ftocks, as alfo the intereft, produce and.
• dividends due or hereafter to be due on all stocks, bonds, tal-
< lies, orders, annuities and other fecurities, whereof any of the
'masters of this court are now poffeffed, or hereafter fhall be
poffeffed of, in truft for the suitors of this court; or have alrea-
dy declared, or at any time hereafter shall declare any trust for
any of the faid fuitors; and that each mafter of the court, do
'from time to time, impower one of the cashiers of the bank to
' receive the fame; and that from time to time fuch intereft,
' produce and dividends fhall be entred in the refpective mafter's
accounts at the bank; and that at least at the end of every term,
'but oftner if there be occafion, the bank fhall certify caufewife
to each mafter the feveral fums fo received, refpectively belong-
ing to the fuitors of this court, under such master's respective
care and inspection, to the end that each mafter may make like
entries in the refpective books kept by themfelves and likewise,
• deliver a copy thereof to the clerk of the report-office, who is
forthwith to caufe the fame refpectively to be entred causewife
• in the respective master's books at the report-office and as to
'mortgages, which any of the mafters of this court have now
fingly by themselves, or jointly with others, in trust for the
fuitors of this court, the particular truft fhall be indorfed on
< the back of the mortgage deed, if it be not so already indorfed, or
fo
inferted in the body of the deed; and as to all fuch future mort-
gages, the particular trusts fhall be inferted in the body of the
'mortgage-deed; and all intereft and principal to be hereafter
paid in on all fuch mortgages, fhall, by the party paying, be
paid into the bank, in manner and form as is herein after di-
rected concerning the payment of money into the bank.

brought before, delivered or paid to fuch mafter; but when any
fecurity, fum of money or other effects are ready to be deli-
vered or paid in, in obedience to any fuch order, the master to
whom the cause stands referred, or to whom, or by whom the
delivery or payment is directed to be made, thall, on applica-
tion by the party interested, his clerk in court, or folicitor in
the caufe, certify the date of fuch order, and the fum of money,
tallies, orders, bonds, depofits, fecurities and other effects then.

the cause, to the account of which the fame is to be placed;
and upon the faid party's, or his clerk in court, or solicitor's
delivering fuch certificate, and payment of such money, or de-
livering of such tallies, orders, bonds, fecurities or other ef-
fects into the bank, the fame fhall be entred in the respective
'master's accounts in the bank, and be under the fame regula-
tions, as in the faid recited order, and herein after is pre-

And whereas, according to the method prescribed by the faid recited order, for the payment of any money out of the bank, belonging to the fuitors of this court, the mafter observing the regulations in the faid recited order contained, is by note under his hand, to draw on the bank, for fuch money as fhall be ❝ ordered by this court to be paid, which note is to be first carried to the report-office: now it is hereby further ordered, That fuch note fhall be fo limited to be paid within a month after date; and that if it be not paid within fuch time, the C note fhall be void; and that when fuch note is carried to the report-office, there shall be also carried with it the order whereby fuch payment was directed to be made, and an entry shall be made in the master's book at the faid office, not only of the faid note, but also a memorandum that it was drawn by virtue of such order, and thereupon an Intratur is to be made, and fuch other proceedings had, as in the said recited order are for that purpose prescribed.

And whereas by the faid recited order it is directed, That 'where fecurities depofited or to be depofited with the bank 'fhall be delivered out, proper entries fhall be made thereof in report-office the mafter's accounts at the bank causewife, of which entries certificates fhall be filed in the report-office; but no provifion is made in such order for the like entry in the master's books in the report-office: it is therefore ordered, That when the mafters do at any time hereafter certify to the report-office 'fuch entry, of the delivering out fuch fecurities as aforefaid, the clerk of the report-office fhall make entries according to "fuch certificate in the refpective mafter's books kept in that office, of the delivering out fuch fecurities as aforefaid.

And it is alfo further ordered, That when any stocks or annuities in the name of the usher shall be hereafter transferred, or any depofits, money, intereft or dividends, or other thing contained in the faid ufher's account, fhall be paid or delivered out of the bank, the fame method fhall be obferved, and the said usher and all others, fhall act and do in all things relating thereto, as the mafters of this court are hereby appointed to do; and in general the fame rules, methods, orders and regulations, which are hereby and by the faid recited order directed and prescribed to be obferved, performed and done by and to the masters of this court, with respect to the monies, ftocks, bonds, mortgages, tallies, orders, annuities, fecurities, • and other effects of the fuitors of this court, in their name, or ⚫ under their inspection and care, shall be in like cases mutatis mutandis, obferved, performed and done by and to the ufher of this court, with refpect to the monies, ftocks, bonds, mort< gages, tallies, orders, annuities, fecurities and other effects of the fuitors of this court, in his name, or under his inspection

And forafmuch as the ufher of this court hath usually had and received, upon the payment of any money or effects into his hands, pursuant to the order of this court, two fhillings for every receipt or certificate by him figned, teftifying the receipt

be filed in the report-office, the faid ufher fhall have and receive two fhillings for figning fuch certificate; and for every draught that he fhall make on the bank, he fhall at the time of fuch draught receive two pence in the pound of all money con'tained in fuch draught, draughts for intereft or maintenance excepted; and if the faid ufher fhall prefume to take any other fee or reward, he fhall be looked upon as guilty of extortion, and upon complaint thereof made to the court, fhall be punished with the utmost severity.

II. And whereas in pursuance of the faid orders feveral of the effects of the fuitors of the faid court have been delivered into the bank of England, and the faid method is for the benefit and fecurity of the Juitors, and fit to be observed, fubject nevertheless to fuch alterations and other regulations, as may at any time hereafter, from the exigency or circumstances of affairs, be found reasonable or proper by the faid high court of chancery; be it therefore enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal and commons, in this prefent par- rders conliament affembled, and by the authority of the fame, That the firmed. faid two orders of the high court of chancery be confirmed, and that the fame fhall be henceforwards obferved and kept, unless in fuch points as fhall be varied in this prefent act, or fhall at any time hereafter be varied or changed by the high court of chancery, according as the faid court fhall, from the exigency or circumstances of affairs, judge reasonable or proper.
