CAP. VII.

An act for continuing the duties upon malt, mum, cyder and perry, in that part of Great Britain called England; and for granting to his Majefty certain duties upon malt, mum, cyder and perry, in that part of Great Britain called Scotland, for the fervice of the year one thousand seven bundred and twenty feven; and for appropriating the fupplies granted in this feffion of parliament; and for making forth duplicates of exchequer-bills, lottery-tickets, and orders, loft, burnt, or otherwife deftroyed; and for giving further time to clerks and apprentices to pay duties omitted to be paid for their indentures and contracts.

moft dutiful and loyal fubjects, the commons of Great Britain fions in relation in parliament assembled, have freely and unanimously given and grant- to matters in ed unto your Majesty the rates, duties and impofitions herein after G. 2. c. 1 mentioned; and do most humbly befeech your Majefty that it may be enaƐled, and be it enacted by the King's moft excellent majefty, by and with the advice and confent of the lords spiritual and temporal and commons, in this prefent parliament affembled, and by the authority of the fame, That within and throughout that part of Great Britain called England, Wales and town of Berwick upon Tweed, the several and respective rates, duties and impofitions, for and upon all malt, mum, cyder and perry, which in and by one act of parliament made and paffed in the twelfth year of the reign of her late Majesty queen Anne, of blessed memory, intituled, An act for granting to her Majesty duties upon malt, mum, cyder and perry, for the fervice of the year one thousand Seven hundred and thirteen; and for making forth duplicates of lottery-tickets loft, burnt or deftroyed; and for enlarging the time for adjusting claims in feveral lottery-acts; and to punish the counterfeiting or forging of lottery orders; and for explaining a late act in relation to ftamp-duties on cuftomary eftates, which pals by deed and 12 Ann. ftat. copy, were granted to her Majefty, or chargeable in manner 1. c. 2. therein mentioned, until the twenty fourth day of June one I Geo. 1. ftat. thousand seven hundred and fourteen; and which by an act of 2.C. which by another act made and paffed in the fixth year of his
Majefty's reign, were continued until the twenty fourth day of
June in the year of our Lord one thousand seven hundred and
twenty one; and which by another act made and passed in the
feventh year of his Majefty's reign, were continued until the

manner, and shall be and are by this act charged for and upon
all malt which shall be made, and all mum which shall be made
and imported, and all cyder and perry which fhall be made for
fale within that part of Great Britain called England, Wales, and
town of Berwick upon Tweed, from and after the twenty third
day of June in the year of our Lord one thousand seven hun-
dred and twenty feven, and before the twenty fourth day of
June which shall be in year of our Lord one thousand feven
hundred and twenty eight.

Malt made in Scotland to pay 3d. per bushel. Mum 10s. per barrel.
Cyder and perry made for fale, 4 s. per hogfhead. If the duties in Scotland
do not raife 20,000l. neat, deficiency to be made good by a furcharge
on the makers. Surplufage to be applied to the fishery, &c. EXP.

XXVIII. Provided always, and be it enacted by the authority aforefaid, That all the monies coming into the exchequer, money grant- either by loans or exchequer-bills, upon one act of this feffion of parliament, intituled, An act for granting an aid to his Majefly by a land-tax to be raised in Great Britain, for the fervice of

the year one thousand feven hundred and twenty feven, and so much money, if any fuch there be, of the tax thereby granted, as shall arise and remain after all the loans or exchequer-bills made or to be made on the fame act, and all the intereft, Præmium or rate and charges thereon, and the charges thereby allowable for raifing the faid land-tax, fhall be satisfied, or money fufficient shall be reserved in the exchequer to discharge the fame, and all the monies coming into the exchequer either by loans or exchequerbills, upon this act, and so much of the duties on malt, mum, cyder and perry, hereby granted or continued, as fhall arife or remain, if any fuch be, after all the loans or exchequer-bills, hereby directed to be made on the fame, and all the intereft, Præmium or rate and charges thereon, and the charges thereby allowable for raising the said duties, fhall be fatisfied, or money sufficient shall be referved to discharge the fame, and the fum of fourteen thousand nine hundred thirty five pounds, ten fhillings and two pence farthing, remaining in the receipt of his Majesty's exchequer on arrears of former land-taxes, fhall be appropriated and applied, and are hereby appropriated for and towards the several ufes, intents and purposes herein expreffed, fubject nevertheless to fuch reftrictions as are herein after prescribed (that is to say) it is hereby enacted and declared, That The fum for out of all or any the aids or fupplies aforefaid, there fhall and the general may be iffued and applied any fum not exceeding fifty four thou- fund, fand one hundred ninety fix pounds feven fhillings and nine pence farthing, to make good the deficiency of the fund, commonly called the general fund, for raifing feven hundred twenty four thousand eight hundred forty nine pounds fix fhillings and ten pence, and one fifth part of a penny per annum, for the year ended at Michaelmas one thousand feven hundred and twenty five.

XXIX. And it is hereby enacted and declared, That out of for naval ferall or any the aids or fupplies provided as aforefaid, there fhall vices, and may be issued and applied any fum or fums of money, not exceeding one million thirty nine thousand seventy one pounds seven fhillings and eight pence, for or towards the naval fervices. herein after more particularly expreffed that is to say for or towards defraying the charge of the ordinary of his Majesty's navy, and for half-pay to fea-officers, and for and towards. victual, wages, wear and tear of the navy, and the victualling thereof, performed and to be performed, and for or towards feafervices in the office of ordnance performed and to be performed, and for or towards other fervices of the navy performed and to be performed, and for or towards the tranfporting of land forces performed and to be performed.

XXX. And it is hereby allo enacted, That out of all or any for ordnance the aids or fupplies provided as aforefaid, there fhall and may vice, be iffued and applied any fum or fums of money, not exceeding one hundred thoufand pounds, for or towards defraying the charge of the office of his Majefty's ordnance for land-fervices performed and to be performed, and towards the extraordinary Rores fent to Gibraltar and Port Mahon upon account.

XXXI. And

for the landforces, and

other fervices.

XXXI. And it is hereby likewife enacted, That out of all or any of the aids or fupplies provided as aforefaid, there fhall or may be iffued and applied any fum or fums of money not exceeding in the whole the fum of one million three hundred forty one thousand feven hundred and thirty pounds feven fhillings and eight pence halfpenny, for or towards maintaining his Majefty's land-forces and other fervices herein after more particularly expreffed, that is to say, any fum not exceeding eight hundred eighty five thousand four hundred ninety four pounds nine fhillings and four pence, for defraying the charge of twenty fix thousand three hundred eighty three men, including commiffion and non-commiffion officers and invalids, for guards, garrifons, and fix independant companies for the fervice of the Highlands and other his Majefty's land-forces in Great Britain, Ferfey and Guernsey, and other fervices relating to the forces for the year one thousand feven hundred and twenty feven; and any fum or fums of money not exceeding one hundred fifty fever thousand fix hundred thirty feven pounds fixteen fhillings and five pence halfpenny, for maintaining his Majefty's garrifons in the plantations, Minorca and Gibraltar, and for provifions for the garrifons of Annapolis Royal, Placentia and Gibraltar, for the year one thousand feven hundred and twenty feven; and any fum or fums of money not exceeding four thousand eight hundred forty seven pounds two fhillings and fix pence, upon account for out-penfioners of Chelsea Hofpital, for the year one thousand seven hundred and twenty feven; and any fum or fums Of the 60,000l. of money not exceeding thirteen thoufand feven hundred fifty furplus how to be applied, pounds nineteen fhillings and five pence, for defraying several 1Geo.2. ftat.2. extraordinary expences and fervices relating to the forces, incurc. 9. fect. 16. red and not provided for by parliament; and any fum or fums of money not exceeding fixty thoufand pounds, upon account of half-pay to the reduced officers of his Majefty's land-forces and marines for the year one thousand seven hundred and twenty feven; fubject nevertheless to fuch rules to be observed in the application of the faid half-pay, as are herein after prescribed concerning the fame; and the fum of fifty thousand pounds to compleat the fum of one hundred and twenty five thoufand pounds, due and payable to the landgrave of Heffe Caffel, for raising, maintaining and keeping a body of twelve thoufand men for his Majefty's fervice, purfuant to the treaty between his Majesty and the faid landgrave of Heffe Caffel, dated the twelfth day of March one thousand seven hundred and twentyfive-fix; and any fum or fums of money, not exceeding one hundred and seventy thousand pounds, upon account for the fubfidy to the landgrave of Heffe Gaffel, and the pay of twelve thousand of his forces to be taken into his Majefty's fervice, and the pay of a lieutenant general to command the faid twelve thousand men, and for forrage-money, waggon-money, and other neceffary charges relating thereunto, pursuant to the faid treaty; and any fum or fums of money, not exceeding one hundred fixty thousand three hundred and fix pounds feventeen

fhillings and five pence farthing, towards making good the deficiency of the grants for the fervice of the year one thousand seven hundred and twenty fix.

XXXII. And be it enacted, That out of the faid aids or fup- And such plies there fhall and may be from time to time iffued and appli- fums of money ed, fuch fum or fums of money as shall be neceffary for and to- as shall be neceffary for dewards anfwering and defraying fuch expences and engagements, fraying fuch as have at any time been, or fhall before or until the twenty expences as fifth day of December one thousand seven hundred and twenty fhall be made feven, be made by his Majefty, in concerting fuch measures as before 25 Dec. he in his great wifdom thinks will beft conduce to the security 1727. by his of the trade and navigation of this kingdom, and to the preserving and restoring the peace of Europe.

XXXIII. And be it enacted, That the faid aids or supplies And to no provided as aforefaid fhall not be issued or applied to any use, in- other use. tent or purpose whatsoever, other than the uses and purposes before-mentioned, or for the feveral deficiencies before directed to be fatisfied out of the faid loans or exchequer-bills, by any particular claufe or claufes for that purpose contained in this act or in any other act of this prefent feffion of parliament.

XXXIV. And as to the faid fum of fixty thousand pounds Rules to be obby this act appropriated, on account of half-pay as aforefaid, it ferved in the is hereby enacted and declared by the authority aforefaid, That application of the rules herein after prescribed, shall be duly obferved in the the half-pay. application thereof; that is to fay, That no perfon fhall have or receive any part of the fame, who was a minor, under the age of fixteeen years, at the time when the regiment, troop or company in which he ferved was reduced; that no perfon fhall have or receive any part of the fame, except such persons who did actual fervice in fome regiment, troop or company; that no perfon having any other place òr employment of profit, civil or military, under his Majefty, thall have or receive any part of the half-pay; that no chaplain of any garrifon or regiment, who has any ecclefiaftical benefice in Great Britain or Ireland, fhall have or receive any of the faid half-pay; that no person shall have or receive any part of the fame who hath refigned his commission, and has had no commiffion fince; that no part of the fame shall be allowed to any perfon by virtue of any warrant or appointment, except to fuch perfons who would have been otherwise entitled to the fame, as reduced officers; and that no part of the fame fhall be allowed to any of the officers of the five regiments of dragoons, and eight regiments of foot, lately disbanded in Ireland, except to fuch as were lately taken off the establishment of half-pay in Great Britain.

XXXV.
