butions on the faid aft did amount to the faid full fum of nine hundred and ten thousand pounds, and the annuities, which became payable in respect of the fame, did amount to the yearly fum of forty five thoujand five hundred pounds: and whereas fince the making of the faid act, as much of the faid capital flock as amounted to feven hundred fix thousand one hundred jeventy five pounds and fifteen fillings, and as many of the faid annuities attending the fame, as amounted to thirty five thousand three hundred and eight pounds fifteen fillings and nine pence per annum, have been fubfcribed into the capital flock and yearly fund of the South-Sea company, and as much of the faid capital flock created by the act, in part before recited, as amounts to two hundred three thoufand eight hundred twenty four pounds and five fillings, and as many of the faid annuities as amount to ten thousand one hundred ninety one pounds four billings and three pence per annum, in refpe& thereof, do fill remain transferrable at the bank, or devifeable as aforefaid, and are payable by the faid cashier of the governor and company of the bank of England for the time being: and whereas in and by certain claufes contained in another act of parliament, made 1 Geo. 1. ftat. and passed in the said first year of your Majefly's reign, intituled, An act for enlarging the capital ftock and yearly fund of the SouthSea company, and for fupplying thereby eight hundred twenty two thousand thirty two pounds four fhillings and eight pence, to publick uses; and for raifing one hundred fixty nine thousand pounds for the like ufes, by fale of annuities upon divers encouragements therein mentioned; and for appropriating several supplies granted to his Majefty, for encouragement of fuch perfons and corporations as would advance, for the fervice of the publick, any fum or fums of money, not exceeding the further fum of one hundred fixty nine thousand pounds, a certain yearly fum of eight thousand four hundred and fifty pounds was established to be a diftinct or feparate fund, for answering and paying annuities after the rate of five pounds per centum per annum, which were thereby to be purchased, until the redemption thereof by parliament; and the faid yearly fund or fum of eight thousand four hundred and fifty pounds per annum, was thereby directed to be illued at the exchequer, to the first and thief cashier of the governor and company of the bank of England for the time being, by way of impreft, and upon account, fer payment of the faid annuities not exceeding eight thoufand four hundred and fifty pounds per annum; and it was thereby enacted, That the monies which should be fo contributed or advanced for or towards the faid fum, not exceeding one hundred fixty nine thousand pounds, fhould be a capital or joint fłock, on which the annuities last mentioned should be attending; and the fame joint stock, and the proportional annuities attending the fame, were thereby made transferrable and deviseable in 1 Geo. 1. flat. the manner thereby prescribed; and in the act last mentioned there is

contained a provifo, That at any time, upon one year's notice and repayment by parliament, of the faid fum of one hundred fixty nine thousand pounds, or fo much thereof as should be advanced on the act laft mentioned. unto the refpective contributors of the fame, or to fuch perfon or perfous as by, from or under them should be then entitled. to the fame annuities, after the rate of five pounds per centum per

annum, in respect of the money fo advanced, according to fuch interefts as they respectively fhould then have in the fame annuities, and also upon full payment and fatisfaction of all arrears of the fame annuities, after the rate of five pounds per centum per annum, if any should be then due, then, and not till then, the faid laft mentioned annuities, after the rate of five pounds per centum per annum, hould alfo ceafe and determine: and whereas the contributions upon the claufes in the act last mentioned for Juch annuities aforefaid, did amount to the faid whole fum of one hundred fixty nine thousand pounds; and the annuities which were payable in respect of the jame, did amount to the faid yearly fum of eight thousand four hundred and fifty pounds, and fince the making of the act last in part before recited, as much of the faid capital flock laft mentioned, as amounted to one hundred thirty feven thousand five hundred twenty fix pounds fix fhillings and eight pence, and as many of the fame annuities attending the fame stock as amounted to fix thoufand eight hundred seventy fix pounds fix fhillings and four pence per annum, have been fubfcribed into the capital flock and fund of the South-Sea company, and as much of the said capital stock of one hundred fixty nine thoufand pounds as amounted to thirty one thousand four hundred feventy three pounds thirteen fillings and four pence, and as many of the faid annuities attending the fame as amounted to one thousand five hundred feventy three pounds, thirteen fhillings and eight pence per annum, ftill remain transferrable at the bank, and devifcable as aforefaid, and payable by the said cashier of the governor and company of the bank of England for the time being; now we your Majesty's most dutiful and loyal fubjects, the commons of Great Britain in parliament affembled, being fully determined that the faid annuities or fums, amounting to one hundred ninety one pounds four fhillings and three pence per annum, and one thousand five hundred feventy three pounds thirteen fhillings and eight pence. per annum, severally payable after the rate of five pounds per centum per annum as aforefaid, by the faid cashier of the governor and company of the bank of England for the time being, shall be redeemed at the end of one year next after the feast of the annunciation of the bleffed Virgin Mary in the year of our Lord Annuities! one thousand seven hundred and twenty three, by paying to the payable by the faid cathier for the time being, the faid feveral fums of two hun- bank, &c. dred and three thoufand eight hundred twenty four pounds five when redeemshillings, and thirty one thousand four hundred feventy three able, &c. pounds thirteen hillings and four pence; and fuch arrears (if any) as fhall then be due upon the faid annuities, amounting to ten thousand one hundred ninety one pounds four fhillings and three pence per annum, and one thoufand five hundred feventy three pounds thirteen thillings and eight pence per annum, for the use of such person and perfons, body and bodies politick and corporate, as thall then be entitled to the fame, according to fuch intereft as they respectively fhall then have therein, do most humbly pray your Majefty, That it may be enacted, and be it enacted by the King's moft excellent majesty, by and with the advice and confent of the lords fpiritual and temporal,

II. And it is hereby enacted, That fuch notice fo to be given or left, and the notice which the faid fpeaker of the said house of commons did, on the five and twentieth day of December one thousand seven hundred and twenty two, pursuant to an order of the fame house, give or leave at the faid office, for redeeming all fuch annuities, purchased after the rate of five pounds 1 Geo. 1. stat, per centum per annum, on the act first above recited, as had not been fubfcribed into the capital ftock of the South-Sea company, fhall, by force and virtue of this act, be and be deemed, adjudged and taken to be good and fufficient notice, within the true intent and meaning of the faid feveral acts of the first year of his Majesty's reign, for redeeming as well the faid annuities, amounting to ten thousand one hundred ninety one pounds four fhillings and three pence per annum, as the said annuities amounting to one thousand five hundred feventy three pounds thirteen fhillings and eight pence per annum, at the said feast of the annunciation of the bleffed Virgin Mary one thousand seven hundred and twenty four, and the fame shall be redeemable accordingly; any thing in the said acts of the first year of his Majesty's reign, or either of them, or any other act or acts of parliament contained to the contrary notwithstanding.

III. And whereas an act of parliament was made and passed in the third year of your Majesty's reign, intituled, An act for redeeming the duties and revenues which were settled to pay off principal and intereft on the orders made forth on four lottery-acts paffed in the ninth and tenth years of her late Majesty's reign; and for redeeming certain annuities payable on orders out of the hereditary excife, according to a former act in that behalf; and for eftablishing a general yearly fund, not only for the future payment of annuities at feveral rates, to be payable and transferrable at the bank of England, and redeemable by parliament; but also to raise money for such proprietors of the faid orders, as fhall chufe to be paid their principal and arrears of intereft in ready money; and for making good fuch other deficiencies. and payments, as in this act are mentioned; and for taking off the duties on linfeed imported and British linen exported, in and by which act (amongst other things therein contained) a certain yearly jum, amounting to feven hundred twenty four thousand eight hundred forty nine pounds fix fhillings and ten pence and one fifth part of a penny per annum, from the feast of Saint Michael the archangel in the

the year of our Lord one thousand seven hundred and feventeen, by or
out of fuch duties, weekly payments and other provifions as are therein
mentioned, was fettled and established to be a general yearly fund, for
and towards the answering and paying fuch feveral and refpective an-
nuities and payments as were thereby charged or chargeable thereupon,
in fuch manner as is therein mentioned: and whereas (amongst other
payments which were provided for by the fame act) certain annuities,
after the rate of five pounds per centum per annum, amounting in
the whole to four hundred feventy fix thousand seven hundred seven-
teen pounds feventeen fhillings and eight pence per annum, were pur-
fuant to that act charged upon the said general yearly fund, as well in
lieu and difcharge af feveral lottery-orders, made forth by several acts
of parliament of the ninth and tenth years of the reign of her late Ma-
jesty Queen Anne, (of blessed memory) as alfo of certain orders or an- 9 Ann. c. 6.
nual payments, which had been charged upon the hereditary excife,
which annuities, amounting to four hundred feventy fix thousand feven
hundred feventeen pounds feventeen fillings and eight pence per an-
num, fo charged on the faid general yearly fund by the faid act of the
third year of your Majefly's reign, were thereby made likewife payable
by the cashier of the governor and company of the bank of England for
the time being, and the proprietors thereof, by virtue of the fame act,
were entitled in respect thereof, to a capital fum, amounting in the
whole to nine millions five hundred thirty four thousand three hundred
fifty feven pounds thirteen fillings and eleven pence three farthings,
which was alfo transferrable at the bank of England, or devifeable as
in the fame act was directed: and whereas fince the making of the said
act of the third year of your Majesty's reign, as much of the faid ca-
pital stock of nine millions five hundred thirty four thousand three hun-
dred fifty feven pounds thirteen shillings and eleven pence three far-
things, as amounted to eight millions three hundred twenty nine thou-
fand five hundred feventy one pounds ten fillings and feven pence,
and as many of the faid annuities attending the fame as amounted to
four hundred and fixteen thousand four hundred feventy eight pounds
eleven fillings and fixpence per annum, have been fubfcribed into the
capital stock and fund of the South-Sea company, and as much of the
faid capital stock of nine millions five hundred thirty four thousand
three hundred fifty Seven pounds thirteen fillings and eleven pence
three farthings, as amounts to one million two hundred and four thou-
fand feven hundred eighty fix pounds three billings and four pence
three farthings, and as many of the faid annuities attending the fame
as amount to fixty thousand two hundred thirty nine pounds fix fhil-
lings and two pence per annum, do fill remain transferrable at the
bank, and payable by the faid cafbier of the governor and company of
the bank of England for the time being; which annuities, amounting
to fixty thousand two hundred thirty nine pounds fix fillings and two
pence per annum, are nevertheless subject to a provifo contained in
the faid act of the third year of your Majefly's reign, whereby it is
provided and enacted, That at any time upon notice to be given or left
at the publick office of the governor and company of the bank of Eng-
land, at any of the quarterly feaf-days therein mentioned, for pay-
ment of the faid annuities, and upon repayment by parliament of their

respective principal fums, for which the faid annuities fhould be payable by the faid cashier of the bank of England for the time being, and whereupon the faid respective annuities were to be computed by that act, to fuch respective perfons and corporations as should be entitled to -the fame annuities, and alfo upon full payment and fatisfaction of all arrears of the fame annuities, (if any fuch should be then due) then, and not till then, the fame annuities fhould ceafe and determine: and whereas the honourable Spencer Compton, efquire, Speaker of the honourable boufe of commons, did, on the twenty fifth day of December one thousand seven hundred and twenty two, pursuant to an order of the faid houfe, grounded upon a certain claufe contained in the faid 3 Geo. 1. c. 7. act of the third year of your Majesty's reign, give or leave notice in writing at the publick office of the faid governor and company of the bank of England, for redeeming all fuch of the annuities payable by the act laft mentioned, after the rate of five pounds per centum per annum, as have not been fubfcribed into the capital stock of the jaid South-Sea company: now we your Majesty's faid dutiful and loyal fubjects, the commons of Great Britain in parliament affembled, being refolved to redeem the said annuities, amounting to fixty thousand two hundred thirty nine pounds fix fhillings and two pence per annum, fo remaining payable at the faid rate of five pounds per centum per annum, by the faid cafhier of the governor and company of the bank of England, by paying to the faid cafhier of the governor and company of the bank of England, the faid principal or capital fum of one million two hundred and four thousand feven hundred eighty fix pounds three fhillings and four pence three farthings (for payment whereof provifion is herein after made by this act) to and for the use of such perfon and perfons, body and bodies politick and corporate, as at the time of fuch payment made to the faid cashier, shall be entitled to the fame, according to fuch interefts as they respectively thall then have therein, and by payment of all arrears of the fame annuities due at or before the laft preceding half-yearly feast-day (if any fuch fhall be due) and upon payment of fuch arrears as shall be computed by the day upon the fame annuities, from the end of fuch preceding half-yearly feaft-day until the time of fuch payment of the principal to the faid cashier as aforefaid, and being defirous thereby in fome measure to cafe the prefent burthen of the publick debts and incumbrances, do further humbly beseech your Majefty, that it may be enacted, and be it enacted by the authority aforefaid, That out of fuch monies as are or fhall be in the receipt of the exchequer, of the furpluffes, exceffes and overplus monies, commonly called the finking fund, arifen or to arife for the year ended at the feaft of Saint Michael the archangel in the year of our Lord one thousand feven hundred and twenty two, or for any time preceding the fame feaft-day (fuch payments as have been directed to be made at or before the fame feast-day, by authority of parliament, out of the faid furpluffes, exceffes and overplus monies, always excepted and foreprized) there fhall be iffued and paid the fum of two hundred and four thousand feven hundred eighty fix
