Trustees empow. sonable, by way of satisfaction for any damage done by such offender or offenders, Provided always, that if goods and chattels whereon to levy the Penalties and da mages above said, cannot be found or that the same be not paid within ten days af ter the conviction of the offender or offenders, (unless he or they fhall appeal againft fuch conviction as herein after allowed,) then the perfon or perfons fo convicted, fhall in every fuch cafe be committed to the Houfe of Correction, for a term not exceeding one month. XIV. And be it further enacted by the authority aforefaid, that it shall be the fpecial duty of the Clerk or Clerks of the faid Markets, and they are hereby requir ed to overfee the carrying into effect, all Rules and Regulations of and refpecting the faid Markets, and to profecute all offences that may be committed against the fame, and the faid Clerk or Clerks for every neglect of duty, fhall be fubject to and incur a Penalty not exceeding Forty Shillings, and not less than Twenty Shillings, current money. XV. And be it further enacted by the authority aforefaid, that it shall be lawful the for the Trustees acting under the authority of this Act, to act, alfo, as Juftices of the Peace, within their jurifdiction, for carrying into execution the feveral powers and authorities granted by this Act, notwithstanding their being Trustees. And be it further enacted by the authority aforefaid, that all perin the name of fons offending against this Act, may be fued by the Trustees in the name of the Treasurer, and the Juftices of the Peace or any two of them, in their weekly fittings at Montreal, are hereby authorized and required to hear and determine on the oath of one or more credible witness or witneffes, other than the informer, all complaints for any offence or offences committed against this Act. Provided always, that when the fum profecuted for and ordered to be paid, fhall exceed the fum of five pounds currency, an appeal fhall lie to the next General Quarter Seffions of the Peace for the District; on thé perfon or perfons fo appealing, firft finding, paying or giving fecurity, for the amount of the order or judgment complained of. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera du devoir spécial du Clerc ou des Ciercs des dits Marchés, et ils font requis de veiller à l'exécution de toutes règles et règlemens touchant le dit Marché, et de poursuivre toute perfonne contrevenant à iceux, et le dit Clerc ou les dits Clercs feront fujets à encourir une pénalité qui n'excédera pas quarante ichellings, et ne fera pas moins de vingt fchellings argent courant, pour toute négligence de ce devoir. XV. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera loifible aux Sindics agiffant fous l'autorité de cet Acte, d'agir auffi en qualité de Juges de Paix dans leur jurisdiction, pour mettre en exécution les différens pouvoirs et autorités accordés par cet Acte, quoiqu'ils foient Sindics. Les Sindics pourfuivront au nom Provifo. XVI. Et qu'il foit de plus ftatué par l'autorité fufdite, que toutes perfonnes contrevenant à cet Acte, pourront être pourfuivies par les Sindics au nom du Tréforier, du Tréforier. et les Juges de Paix ou deux d'entr'eux dans leurs féances hebdomadaires à Montréal, font par le préfent autorisés et requis d'entendre et déterminer, fur le ferment d'un ou plufieurs témoins dignes de foi, autre que le dénonciateur, toutes plaintes pour offense ou offenfes commifes contre cet Acte. Pourvu toujours, que loifque la fomme pour laquelle il fera fait une pourfuite et qui fera ordonnée d'être payée, excèdera la fomme de cinq livres courant, il y aura appel à la Seffion prochaine de Quartier Général de la paix pour le District, en par la perfonne ou perfonnes ainfi appellant, payant ou donnant des fûretés pour le montant de l'ordre ou jugement dont il y aura plainte. rentes et pénalités feront recouvrées, XVII. And be it further enacted by the authority aforefaid, that all offences against this Act, fhall be fued for within one month after the offence fhall have been committed and not afterwards: and in all cafes, where any action hall be bronht against any perfon, by reafon of any matter or thing done in performance of this Act, the fame fhall be brought within one month after the fame fhall be alledged to have been done, and not afterwards; and if the perfon bringing fuch actior, fhall be non fuited or fhall withdraw the fame, every fuch perfon fhall pay treble cofts. And be it further enacted by the authority aforefaid, that all the Fines, the Fincs, &c.and Forfeitures and Penalties by this A&t impofed, fhall be received by the Sheriff of pay the fame to the faid Diftrict of Montreal, and be by him paid into the hands of His Majefty's Receiver General, to and for the ufe of His Majefty, his Heirs and Succeffors, and towards the fupport of the Civil Government of this Province, and fhall be account. ed for to His Majefty, his Heirs and Succeffors through the Lords Commiffioners of His Majefty's Treafury for the time being, in fach manner and form as His Majefty, his Heirs and Succeffors fhall direct, Public A&t. And be it further enacted by the authority aforesaid, that this Act shall be taken and allowed in all Courts as a Public Act, and all Judges and Juftices are hereby required to take notice thereof, as fuch, without the fame being specially pleaded. CA P. VIII. Preamble AN ACT for continuing and completing the Building of the Market House in the Upper Town of Quebec, and which provides the means of defraying the expences thereof. (16th April, 1807.) WHEREAS the Magiftrates of the Town and City of Quebec, in order to im prove the Market place of the Upper Town of Quebec, and for the conve nience of the Inhabitants of the faid Town and City, have begun to conftruct there. on a stone Market Houfe of two ftories in height, which is already far advanced; and Whereas the faid Magiftrates have applied to the Legiflature, by Petition, praying for the means of defraying the expences already incurred, and those to be incurred in completing the faid Market Houfe. May it therefore please Your Ma jefty, that it may be enacted, and be it enacted by the King's Inoft Excellent Majesty by and with the advice and consent of the Legiflative Council and Affembly of the Province tions. XVIII. Duty of the Truf. tees before they proceed to carry this Act into execution.. 68 Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act of the Parliament of Great Britain, intituled, " An Act to repeal certain parts of an Act paffed in the fourteenth year of His Majesty's reign, "intituled, "An Act for making more effectual provision for the Government of the "Province of Quebec in North America;" and to make further provifion for the "Government of the faid Province :" and it is hereby enacted by the authority of the fame, that the Magiftrates of the faid Town and City of Quebec, or any three of them, refiding in the faid Town and City of Quebec, are hereby conftituted and appointed Trustees, for the purpofe of carrying this A&t into effect.. II. And be it further enacted by the authority aforefaid, that the faid Trustees fhall meet at the Court Houfe in Quebec, within ten days after the paffing of this A&t, in order to take the neceffary measures for carrying the prefent Act into effect: and the faid Trustees fhall afterwards meet, from time to time, and as often as may be neceflary at the fame place, or elsewhere, for the purpofes aforefaid. Provided nevertheless, that before the faid Trustees or any future Trustees fhall further proceed in the execution of any of the powers by this Act given, fuch Truftees fhall prepare and make out, a full, juft, true and particular account in writing, specifying dates and times, of all and every fum and fums of money, which has or have been adually and bona fide paid, laid out or expended, or is, or are now due, and owing or remaining unpaid, or for which any obligation, undertaking or engagement has been entered into, in any manner, in, about, or in respect, of the erection or building of the faid Market Houfe, or the purchase of materials, or the pay ment of wages, to artificers, workmen or labourers, or any other expenditure, in or about the fcite of the faid Market House, or the said plot or space of ground, now called and known by the name of the Market place, or Place de Marché, and heretofore called and known by the name of Place de Notre Dame; and also, a full, juft, true and particular account in writing, fpecifying dates, and times, of all and every fum or fums of money, which has or have come into the hands, cuftody, poffeffion or power, or under the controul of the faid Magiftrates, or either of them; or of any other perfon or perfons acting in, or about the erection or building of the faid Market House; or in, or about the preparing the faid plot or space of ground, for fuch building, or in any manner touching or concerning the fame, which faid. feveral accounts in writing herein before mentioned, fhall be figned by the Magiftrates, and fhall be laid before the Court of General Seffions of the Peace, to be held in and for the District of Quebec, or before a Special Seffions of the Peace, to be held for that purpose; and at which Special Seffions, each and every of His Majesty's Juftices of the Peace, refiding in the City of Quebec, fhall be notified and required by an inftrument in writing, under the hand of the Clerk of the Peace to give their attendance, and fhall be paffed, approved and allowed, by the faid Court of General or Special Seffions of the Peace, and filed in the faid Court, and a verbatim copy thereof, fhall, after such allowance, be published in two fucceffive Quebec Gazettes before |
