T the Provincial Parliament, began and holden at Quebec, the twenty-ninth 66. day of January, Anno Domini, one thousand eight hundred and eight, in "the forty-eighth year of the Reign of our Sovereign Lord GEORGE the Third, by "the Grace of God, of the United Kingdom of Great Britain and Ireland, KING, "Defender of the Faith."

AN ACT further to continue for a limited time, and amend an A&t paffed in the forty third year of His Majefty's Reign, intituled, "An Act for eftablishing Regulations respecting Aliens and certain Subjects of His Majefty, who have refided in France, coming into this Province, or refiding therein."

ACTE qui continue encore, pour un tems limité, et amende un acte paffé dans la quarante-troisième année du règne de Sa Majefté, intitulé, " Afte диг établit des règlements concernant les Etrangers et certains fujets de Sa Majefte, qui, ayant résidé en France, viennent dans cette Province, ou y resident."

TTENDU qu'un acte a été paffé dans la quarante-troisième année du règne de Sa Majefté, intitulé, "Acte qui établit des règlemens concernant les Etrangers et certains fujets de Sa Majefté, qui, ayant réfidé en France, viennent dans cette Province,

Préambule,

"refiding therein" which A& will expire at the end of this Seffion; And Whereas it is expedient and neceffary that the faid Act be further continued with certain ad. ditional Claufes: Be it therefore enacted by the King's Moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and alfembled by virtue of and under the authority of an A& passed in the Parliament of Great Britain, intituled, “An A& to repeal certain parts of an Act paffed in the fourteenth year of his Majefty's reign "intituled, " An Act for making more effectual provifion for the Government of the "Province of Quebec in North America:" And to make further provifion for the Go. "vernment of the faid Province;" And it is hereby enacted by the authority of the A&t. 43 Geo. 3 fame, that the faid Act, intituled, " An Act for establishing Regulations refpecting "Aliens and certain Subjects of His Majefty, who have refided in France, coming into "this Province, or refiding therein," and all matters and things in the faid Act, and in this A&t contained, fhall continue and be in force, until the first day of January one thousand eight hundred and nine, and from thence to the end of the then next Sel fion of the Provincial Parliament, and no longer.

II. And be it further enacted by the authority aforefaid, that all and every fubject of His Majefty, who, now is refident in or who, from and after the paffing of this Act, fhall voluntarily enter into France, or any part of the Dominions thereof, or into any country in alliance with France, or any part of the Dominions of fuch countr or into any country in the occupancy or under the controul of the arms of Franc or of her allies, fhall, upon his or her arrival in this Province, obey and perform all and every part of the Act hereby continued, which refpects Aliens, and shall be liable and fubject to all and every the pains and penalties thereby declared and enacted, for disobedience and negle&t by any Alien therein defcribed, and the fame powers and authority are hereby granted; to all and every perfon for the execution of this Act, refpecting his Majesty's fubjects abovesaid, and in every other respect, as were and are granted by the abovementioned Act hereby continued, for the execution of the fame respecting Aliens.

III. And be it further enacted by the authority aforefaid, that it fhall and may be lawful to and for the Governor, Lieutenant Governor, or person administering the Government of this Province, from time to time, by and with the advice and confent of His Majefty's Executive Council, by Order or Orders, Proclamation of Proclamations, to be issued and published, to require Aliens of any defcription, and all or any other perfon or perfons, as fhall, in fuch Order or Orders, Proclamation or Proclamations be defcribed coming into this Province, by land or inland na. vigation, to enter the fame by fuch Frontier Poft, or Pofts, or Place or Places only, as fhall therein be defignated, and at fuch Frontier Pofts, or Places, to make unto fuch perfon or perfons, and at fuch place, house or Office, as shall be appointed for

"Province, ou y réfident," lequel Afte n'aura de durée que jusqu'à la fin de la préfente feffion de la Légiflature; Et vu qu'il eft expédient et nécessaire que le dit A&te foit encore continué avec certaines claufes additionelles: Qu'il foit donc ftatué par la très excellente Majefté du Roi, par et de l'avis et conlentement du Confeil Légiflatif et de l'Affemblée de la Province du Bas-Canada, conftitués et affemblés en vertu et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Breta gne, intitulé," A&te qui rappelle certaines parties d'un A&te paffé dans la quator“ zième année du règne de Sa Majefté, intitulé," Acte qui pourvoit Acte qui pourvoit plus efficace"ment pour le Gouvernement de la Province de Québec dans l'Amérique Septentrio "nale;" et qui pourvoit plus amplement pour le Gouvernement de la dite Pro"vince;" Et il eft par le préfent flatué par la même autorité, que le dit Acte, intitulé, “ Ace qui établit des réglemens concernant les Etrangers et certains fujets de "Sa Majefié, qui, ayant rélidé en France, viennent dans cette Province, ou y réfident," l'acte de la 43me et toutes les matières et chofes contenues dans le dit Acte et dans le préfent Acte, continueront d'être en force jufqu'au premier jour de Janvier mil hait cent neuf, et de là jusqu'à la fin de la Seffion alors prochaine du Parlement Provincial, et pas plus longtems.

II. Et qu'il foit de plus ftatué par l'autorité Sufdite, que tout fujet de Sa Majesté qui réfide actuellement en, ou qui, depuis et après la paffation de cet Acte, entrera volontairement en France ou dans quelque partie des Domaines d'icelle, ou dans quelque pays en alliance avec la France, ou dans quelque partie des Domaines de tel pays, ou dans quelque pays occupé ou fous le contrôle des armes de la France ou de fes alliés, obéira et fe conformera, à fon arrivée dans cette Province, à toute et chaque partie de l'Acte par le préfent continué, qui a rapport aux Etrangers, et fera affujetti à toutes et chaque peines et pénalités déclarées et ftatuées par icelui, pour délobéiffance et négligence commife par tout Etranger de la defcription mentionnée au dit Acte, et les mêmes pouvoirs et autorité qui ont été et font accordés par l'Acte ci-deffus mentionné, et qui eft continué par le préfent Acte pour fon exéction, concernant les Etrangers, font par le préfent accordés à toute et chaque perfonne pour l'exécution du préfent Acte, concernant les dits Sujets de Sa Majefté, et à tous autres égards.

Et qu'il fcit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loifible au Gouverneur, Lieutenant Gouverneur ou à la perfonne ayant l'adminif- cette Province par tration du Gouvernement de cette Province, d'ordonner, de tems à autre, par et de l'avis et contentement du Confeil Exécutif de Sa Majefté, par ordre ou ordres, ou par une Proclamation ou des Proclamations qui feront émanées et publiées, que les Etrangers de toute description, et toute autre perfonne ou perfonnes quelconques qui feront défignées dans tel ordre ou ordres, Proclamation ou Proclamations, venant dans cette Province par terre ou par la navigation intérieure, y entrent feule ment par tel Pofte ou Poftes, Place ou Places fur les frontières qui y feront défignés, et à tels Poftes ou Places fur les frontières faffent à telle perfonne ou person
