III. And for the greater fafety of property which may be committed to the care of Pilots undertaking for hire to conduct fcows and rafts, from Chateauguay to Montreal be it further enacted, that every perfon intending to act as a Pilot in any such case, shall, annually, take out a licence to authorife him to practice, for hire, the piloting and conducting of (cows and rafts from Chateaugay to Montreal, as aforefaid, which licence the Juftice of the Peace for the Diftrift of Montreal, in their weekly fittings, or any fpecial feffion to be held in the faid city, are hereby authorised and required, on the recommendation of the Inpector or any one of the Measurers, (if no good reafon be fhewn to the contrary,) to grant to the perfon applying for the fame, on paying to the Clerk for fuch licence, two fhilPesce to take lings and fix-pence currency, and no more: and the faid Clerk is hereby refor the fame and quired to keep a register of the names of the perfons, who fhall be fo licenced: to keep a Register Provided always, that if any perfon applying for fuch a recommendation, shall fuch as are licen be refufed the fame, fuch perfon fhall be allowed to adduce before fuch JuftiPerfons to whom ces, proof of his capacity to discharge the duties of a Pilot, upon which, and recommendations after hearing the Inspector or a Measurer, in fupport of the reafons for fuch remayadduce proofs fufal, the faid Juftices fhall grant or withhold a licence, as they fhall fee most conducive to the purposes of this A&t.

Et pour la plus grande fûrcté des Propriétés qui peuvent être confiées au foin des Pilotes qui entreprennent pour gages de conduire les Bacs et Cages de Chateauguay à Montréal, Qu'il foit ftatué par l'autorité fufdite, que toute perfonne se propofant d'agir comme Pilote prendra annuellement, en tout tel cas, une Licence pour l'autorifer à pratiquer pour gages le Pilotage et la conduite des Bacs et Cages dront une Licen de Chateauguay à Montréal comme fufdit, laquelle Licence les Juges de Paix pour ce. le District de Montréal, dans leur Seffion hebdomadaire ou aucune Seffion fpéciale par eux tenue dans la dite Cité, font par le préfent autorifés et requis d'accorder à la perfonne qui le demandera fur la recommandation de l'Infpecteur ou d'un des Mefureurs, (s'il n'y a point de bonne raifon produite au contraire) en payant au Greffier pour telle Licence deux Chellins et fix deniers, Argent Courant, et pas plus, et le dit Greffier de la Paix eft par le préfent requis de tenir un Régiftre des noms des perfonnes qui obtiendront telle Licence. Pourvu toujours, que fi quelque perfonne demandant telle recommendation eft refufée, il fera allouée à telle ila perfonne de produire devant tels Juges de Paix des preuves de fa capacité pour remplir les devoirs d'un Pilote, fur quoi, et après avoir entendu l'Infpecteur et un des Mefureurs au foutien des raifons de tel refus,, les dits Juges de Paix accorderont ou refuseront une Licence, ainfi qu'ils croiront être le plus convenable pour remplir

V. Et qu'il foit de plus ftatué par l'autorité fufdite, que fi quelque perfonne n'étant point Pilote avec Licence comme fufdit, entreprend, pour falaires ou moyennant quelques gages, de conduire ou piloter, par les Rapides de Chateauguay à Montréal, quelque Bac chargé en partie ou en tout, ou quelque Cage de bois de chêne ou de douve, ou autres bois de conftruction, ou bois de chauffage, toute perfonne ainfi contrevenante encourra et payera, pour toute telle offenle, une Amende n'excédant point Quarante Chellins, Argent courant.

VI. Provided always and be it further enacted by the authority aforesaid, that nothing in this Act contained, fhall extend or be conftrued to extend to prevent any perfon or perfons from conducting and Piloting from Chateauguay to Montreal, any raft or rafts of firewood, which is or are his or their property, but this fhall not exempt any fuch proprietor from first caufing fuch raft or rafts of firewood, to be measured and branded, as by this Act is directed; and in default of being fo measured and branded, every fuch Proprietor fhall forfeit and pay, a fum, not exceeding ten Shillings current money of this Province.

VII. And it being neceffary to fix the hire or wages of Pilots licensed as by this A&t is directed, Be it further enacted by the authority aforefaid, that from the opening of the navigation until the first day of October, annually, there fhall be paid to licensed Pilots, in lieu of all wages, provifions and ferriage for piloting, from Chateauguay to Montreal, the following hire or wages, that is to say: For every fcow loaded in part or in whole, Thirty Shillings currency. For every raft of ftaves, timber or other lumber confifting of two cribs, and not exceeding eighty feet in length, twelve Shillings and fix pence currency. For a fingle crib of ftaves, timber or other lumber, if the propietor fhall require it to be piloted fingly, twelve Shillings and fix pence, Currency. For every raft of firewood, Ten Shillings, Currency. And from and after the first day of October, inclufive, annually, un til the clofe of the navigation, there fhall be allowed and paid over and above the before mentioned rates, an addition of one fifth part.

VIII. And whereas accidents may happen to fcows and rafts in their paffage from Chateauguay to Montreal. Be it further enacted by the authority aforesaid, that it fhall be the duty of the Pilot, having charge of any scow or raft, which shall meet with an accident, to give every affiftance in his power, not only to clear the rapids from the impediments, which fuch accident may occafion, but further, to the best of his skill and abilities, to affift in endeavouring to fave from lofs, the loading of any scow or raft fo meeting with an accident, nor fhall he depart from, or leave the fame until discharged by the owner thereof, or his agent, under the penalty of the lofs of his wages; and further a fine not exceeding twenty fhillings currency, for every fuch offence. Provided always, that over and above the allowance for pilotage to fuch Pilots, as herein before established, there fhall be paid to him, for every day that he fhall be detained in fo clearing the rapids, or in affifting to fave the property committed to his charge, the wages following, that is to fay: from the opening of the Navigation, until the first day of October, five fhillings currency per day, and from the first day of October inclufive, until the close of the Navigation, one fifth more, and in both cafes of fuch detention, provifions whilft fo employed.

Et étant néceffaire de fixer les Gages ou Salaires des Pilotes ayant obte- Gages des Pilotes tenu Licence, ainsi qu'il eft défigné par cet A&te, Qu'il foit de plus ftatué par l'autorité fufdite, que depuis l'ouverture de la Navigation jufqu'au premier jour d'O&obre annuellement, il fera payé aux Pilotes avec Licence, au lieu de toutes gages, provifions et droits de paffage pour le Pilotage de Chateauguay à Montréal, les Gages ou Salaires fuivans, c'eft-à-dire; Pour chaque Bac chargé en tout ou partie, Trente Chellins, Argent Courant. Pour chaque Cage de douves, bois de conftruction ou autre bois, compofée de deux Cribs, et n'excédant point quatrevingt pieds de longueur, Douze Chellins et Six De niers, Argent courant, une fimple Cage de douves, bois de conftruction ou autres bois, fi le Propriétaire demande à la faire piloter féparement, Douze Chellins et Six Deniers, Argent courant. Pour chaque Cage de bois de chauffage, Dix Chellins, Argent courant; Et depuis et après le premier jour d'Octobre inclufivement de chaque année, jusqu'à la fin de la navigation, il fera alloué et payé, en fus des Taux ci-devant mentionés, une addition d'une cinquième partie.

Et attendu qu'il peut arriver des accidens aux Bacs et Cages dans leur paffage de Chateauguay à Montréal, qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera du devoir du Pilote, ayant la charge d'aucun Bac ou Cage auquel il fera arrivé quelque accident, de donner toute l'affiftance en fon pouvoir, non feulement pour dégager les Rapides des obftacles que tel accident pourra occafioner, mais de plus pour aider, au meilleur de fes connoiffances et habileté, à préserver de la perte la charge de quelque Bac ou Cage qui aura ainfi eu quelque accident, et il n'en partira point ni ne le quittera, avant d'avoir été congédié par le Proprié taire d'icelui ou fon Agent, fous la pénalité de la perte de fes Gages, et en oatre d'une Amende n'excédant point vingt Chellins, Argent courant, pour chaque telle contravention; Pourvu toujours, qu'en outre de l'allouance du Pilotage à tel Pilote, telle que ci-devant règlée, il lui fera payé pour chaque jour qu'il fera détenu à nétoyer ainfi les Rapides, ou à aider à fauver la propriété commise à fa charge, les gages fuivantes, c'eft-à-dire; depuis l'ouverture de la Navigation jufqu'au premier jour d'Octobre, Cinq Chellins, Argent courant, par jour, et du premier jour d'Octobre inclufivement jufqu'à la fin de la Navigation, un Cinquième de plus, avec des vivres dans les deux cas où il aura été ainfi retenu, tant qu'il fera ainfi employé,

X. And be it further enacted by the authority aforefaid, that for the trouble of inspecting, measuring and branding of every fcow, crib or raft, as is herein before directed, there fhall be paid into the hands of the Inspector, the following rates and allowances, that is to fay: For every fcow loaden in part, or in whole, fix fhillings currency. For every crib of ftaves, timber or other lumber, two fhillings and fix pence currency. For every raft of firewood, one fhilling and three pence currency. And for every crib or raft with wheat, flour, or other provifions or pot or pearl afhes thereon, two fhillings and fix pence currency. And the monies fo received by the Inspector, shall be divided and paid as follows, that is to fay: two fifth parts to be retained for himself, and the other three fifths, to the measurers, by equal portions.

XI. And be it further enacted by the authority aforefaid, that all fines and penalties by this A&t inflicted, shall unless otherwise provided for, be fued for within three calender months after the offence committed, and not afterwards, before any one or more Juftice or Juftices of the Peace, in the District, who is, and are hereby authorised to hear and determine the fame, and on conviction of the offender, by his or her confeffion, or by the oath of one or more credible witness or witneffes, being other than the profecutor, the fame fhall be levied, with cofts of fuit, by warrant of diftrefs, under the hand and feal of fuch Juftice or Juftices of the Peace, of the goods and chattels of the perfon fo convicted; and one half of fuch fines and penalties, fhall be paid to the profecutor, and the other half for to his Majefty. fhall be paid into the hands of his Majesty's Receiver General of this Province, to be applied to the public ufes thereof; and the fame shall be accounted for to his Majesty, his Heirs and Succeffors, through the Lords Commiffioners of his Majesty's Treasury, in fuch manner and form as his Majesty, his Heirs and Succeffors fhall direct.
