out again paying the fame. Except with a new load, Trustees may make Tickets, fame day, with return the fame day, before twelve of the Clock at night with the fame Carriage, faddle Horfe, Mare or Gelding, without again paying Toll for the fame. Provided fuch carriage be not loaded in whole or in part with merchandise or other articles, not exempted from Toll under this Act; but in cafe the fame carriage fhall pass with such a new load or any part thereof a fecond time or oftener, then the Toll, fhall each time, be payable in the fame manner as the first time; and the Trustees, or any three or more of them, at a general meeting affembled, may make Tickets or Checks under fuch regulations, as they fhall fee fit, for prevention of frauds and abuses in the faid Tolls or Rates, or compofitions, as herein after mentioned, and the Collector and every person receiving fuch a Ticket or Check, who shall give, lend or difpofe of the fame to any other perfon or for any purpose not authorised by the Trustees in their faid regulations, and every perfon, who shall wrongfully and knowingly receive, borrow, purchase or use the fame, and every person who, by any falfe pretext, fhall obtain an exemption from any Toll, to which he or she is liable, being thereof convicted, fhall, for each offence, respectively, forfeit and pay a fum, not exceeding Twenty Shillings currency. And in order to remedy the inconvenience of a want of change or small money for the for the payment of Tolls, Be it further enacted, that the Trustees, or any three or more of them, may, at a general meeting, agree upon and iffue Notes which fhall pass and be received as inoney, in payment of Tolls only, and for no other purpose; and any perfon or perfons who fhall with an intent to defraud the Trustees, their Treasurer or Collector, forge or counterfeit the faid Notes or the abovementioned Tickets or Checks, or any of them, or who fhall pafs as a true one, any Note, Ticket or Check, which such person or perfons fhall know to be forged forging the No. or counterfeited, fhall, upon conviction thereof, before his Majefty's Court of King's Bench for the District of Montreal, forfeit and pay the fum of Twenty Pounds, and in default of payment thereof, upon fuch conviction, fhall be imprisoned for fix calendar Months in the common Gaol of the faid District. tes. XIII. Et afin de remédier à l'inconvénient d'un manque de change ou petite monnoie pour le payement des péages, qu'il foit de plus ftatué par l'autorité fufdite, que les Syndics, ou trois ou plus d'entr'eux pourront convenir à une affemblée générale de faire fortir des Billets, lefqueis pafferont et feront reçus comme de l'Argent pour le payement des péages feulement, et non pour aucun autre objet quelconque, et toute perfonne ou perfonnes qui, dans l'intention de frauder les Syndics, leur Tréforier ou Collecteur, forgeront ou contreferont les dits Billets, ou ceux cidevant mentionés, ou aucun d'eux, ou feront paffer comme véritable un Billet ou Certificat, lorfque telle perfonne ou perfonnes fauront qu'il eft forgé ou contrefait, en étant convaincues devant la Cour du Banc du Roi de Sa Majefté pour le District de Montréal, elles encourront et payeront la Somme de vingt Livres, et à défaut de payement fur telle conviction, elles feront emprifonnées durant fix mois de Calendrier dans la Prifon commune du dit District. XIV. Et qu'il foit de plus ftatué par l'autorité fufdite, que perfonne ne laissera de Charette ou autre voiture, ou ne laiffera ou fera laiffer aucune matière au chofe caufant un embarras quelconque ou nuifance fur le dit Chemin, ou fur les foffés ou canaux d'icelui, et toute perfonne ainfi contrevenante encourra et payera une Somme n'excédant point dix Chellins courant, outre la dépenfe d'enlever tel embarras, et dans le cas qu'on ne puifle pas voir qui a mis ou laiffé telle nuisance ou embarras, le poffeffeur ou occupant du Terrein joignant cette partie du Chemin, Foffé ou Canal fur lequel il fera trouvé, fera tenu et jugé comme ayant commis l'offenfe. And whereas many perfons refident within the parish of La Chine, are liable to certain annual labour on the faid road, and others within that parish and the parish of Montreal, are by Law, chargeable indefinitely with the repairs of certain parts thereof, and it is equitable and would be convenient, that all fuch perfons fhould be exonerated from fuch labour and fuch repairs, and their fervices be compounded for money. Be it therefore further enacted, that every perfon fo liable to any specific annual labour upon the faid Road, may, on or before the laft day of March, in each year, compound for the fame, by paying to the Treasurer, and Clerk of the Trustees, the fum of five fhillings for each days labour of a horfe, cart and driver, and one fhilling and eight-pende currency, for each days labour of a man, to which he or she is liable; and every per fon who is chargeable indefinitely, with repairs to any part of the faid Road, may at the like period, in each year, compound for the fame by fo paying for each Land or Farm of three acres in front, by him or her owned or poffeffed and liable thereto, the fum of fifteen fhillings currency, or compound by agreeing to furnish in lieu of fuch fum when required by the Trustees, or their overfeer, three days labour of a horfe, cart and driver, at the option of any fuch perfon, but fuch option to be declared on or before the period above faid, and fo in proportion, be the Land or Farm of greater or leffer front, or if a village, houfe and lot, five fhillings currency; and every perfon refident along the Cote Saint Paul, may compound as above faid, by paying five fhillings for each farm of three acres in front, by him, her or them poffeffed, and fo in proportion and fuch payments in money or fuch labour if furnished, fhall, refpe&tively, exempt the perfons making them for the year, in which the compofition fhall be fo made from all Tolls, and from the labour upon the faid Road, other than the faid compofition labour to which they would otherwife be liable, the labour, however, refpecting the Road during the feafon of winter conveyances, (to which any fuch perfons may be liable by Law excepted;) and every person who may not be chargeable by Law with repairs to the faid Road, but fhall be defirous of compounding for the use of the fame, in fo far as fhall refpect coaches, chariots, landaus, chaifes, phactons, gigs, calaches, chairs, or other carriages of pleasure, and in respect to faddle horses de défoncer au Chemin, ou d'y conduire de l'eau cune partie du fans permiffion. Pourvu toujours, que telle permiffion ne fera point refufée quand il y aura caufe raisonnable pour la demander, et en cas d'avis contraire à cet égard, ou à l'égard d'aucune matière ou chofe contenue en la dite claufe, l'objet fera décidé par les Juges à Paix de Semaine de Montréal (tels Juges n'étant pas Syndics) autrement par deux au- les différences tres Juges à Paix non Syndics, après avoir entendu les parties. Et attendu que bien des perfonnes réfidentes dans la Paroiffe de la Chine font fujettes à un certain travail annuel fur le dit Chemin, et que d'autres dans cette Paroiffe et la Paroiffe de Montréal font par la Loi fujettes à être chargées indéfiniment des réparations de certaines parties d'icelui, et qu'il eft équitable, comme il feroit convenable que toutes telles perfonnes fuffent déchargées de tel travail et de telles réparations, et que leurs fervices fullent compenfées en argent : Qu'il foit donc de plus ftatué par l'autorité fus-dite, que toute perfonne ainfi fujette à quelque travail annuel fpécifique fur le dit Chemin, pourra, avant le dernier jour de Mars dans chaque année, compofer pour le dit travail en payant au Tréforier et Greffier des Syndics la fomme de cinq chellins courant pour chaque jour de Travail d'un Cheval, Charrette et Charretier, et un Chellin et huit deniers courant pour chaque jour de travail d'un homme, auquel elle eft fujette; Et toute perfonne qui est fujette à être chargée indéfiniment des réparations de quelque partie du dit Chemin, pourra au même tems dans chaque année compofer pour icelles en payant ainfi par chaque Terre ou Ferme de trois Arpens de front tenue ou poffédée par elle, et y étant affujettie, la Somme de Quinze Chellins Courant, ou compofer en convenant de fournir au lieu de telle fomme, quand les Syndics le requerront ou leur Infpecteur ou Sous-voyer, trois jours de travail d'un Cheval, Charette et Conducteurs à l'option d'aucune telle perfonne, cette option néanmoins devant étre déclarée avant ou au tems fus-dit, et ainfi à proportion pour une terre ou ferme d'un front plus ou moins étendu, ou fi c'eft une Maifon et Emplacement de Village, Cinq Chellins courant; Et toute perfonne demeurant le long de la Côte Saint Paul peut compofer, comme il eft ci-deffus dit, en payant cing Chellins pour chaque terre de trois Arpens de front par elle ou lui poffédée, et ainsi à proportion, et tel payement ou tel Travail, s'il eft fourni, exempteront refpectivement les perfonnes qui les feront pour l'année dans laquelle la compofition fera ainfi faite, de tout péage et du Travail sur le dit Chemin, (le dit Travail de compofition excepté) auquel elles auroient été autrement fujettes, excepté néanmoins le travail qui concerne le Chemin durant la Saifon des voitures d'hiver auquel aucune telle perfonne fera fujette par la Loi, et toute personne qui par la Loi, n'eft pas fujette à être chargée des réparations du dit Chemin, mais qui défirera composer pour en faire ufage quand aux Caroffes, Chars, Landaux, Chaifes, Phaetons, Cabriolets, Caleches ou autres voitures de plaifir, et auffi à l'égard H des Quand il y aura nable, la permif une caufe raifon. fion ne fera point refufée. But in neither of the cafes abovesaid, nor in any cafe whatever, fhall any waggon, cart or other carriage, when employed in tranf porting any merchandife, or other effects for hire, be compounded for, or be capable of compofition. XVII. And whereas the road fund of the City of Montreal, is chargeable with the repairs of a the repairs of that part of the faid Road to La Chine, which is fituated between the bridge over the River Prudhomme and the bounds of the faid City, and the general Road A&t, having provided for affiftance from that fund, towards the roads upon hills within the parish, affiftance therefrom was in confequence given towards the expence incurred upon the hills near the Tannery and at Urtubife's. Be it therefore further enacted, that from and after the paffing of this Act, the road fund of the faid City fhall be exonerated from the repairs of the faid part of the La Chine road, between the faid bridge and the City bounds: and also, from the repairs to the faid hills, to all which the faid Trustees fhall become liable, and in confideration thereof, there fhall annually be paid during the continuance of this Act, (the first payment whereof to be made out of the faid road fund, for the year one thousand eight hundred and five,) by the road Treasurer, of the faid City to the Treasurer and Clerk of the faid Trustees, the fum of twenty-five pounds currency. And be it further enacted, that it fhall and may be lawful for the take and carry a faid Trustees, or any Perfon or Perfons whom any two of the Trustees specially fuperintending the repairs of the road fhall appoint, to fearch for, dig, gather, take, and from time, to time convey away Gravel, Stones, Sand, or other materials for roads, from any grounds within the parishes, through which the faid road paffes, or within a neighbouring parish, (not being the ground whereon any houfe stands or whereby, the foundation thereof can be injured, nor a garden, orchard, nurfery of trees, yard or avenue to any houfe,) where fuch materials have been in ufe, to be taken, or are, or may be found, and fo much thereof to carry away as fhall be neceffary for improving and repairing the aforefaid road, paying only for the damage done to the furface of the faid grounds, (and for the expences of fencing in the part of the fame, where the furface is broken, and shall require it) refpectively, where and from whence the fame fhall be dug, gathered or taken away, or over which the fame fhall be carried, the amount of which damage, fhall in the event of difagreement about the fame be ascertained by an equal number of Arbitrators to be chofen by the said fuperintending Trustees, or any two of them, and by the owner or cccupier of fuch grounds; and which Arbitrators fhail, if neceffary, appoint an Umpire, and the decision of the majority of such Arbitrators, or |
