PREFACE.

EVE

VERY gentleman of the law, (for whose use the following work is chiefly intended,) who hath had any experience in bufiness, must know, that upon the trial of caufes, a client frequently fuffers, from his own fault, in not giving a full ftate of his cafe, previous to the commencement, or defence of an action, either from mifreprefentation, or the concealment or omiffion of fome effential fact; and the attornies concerned, are frequently blamed, without just cause. I know many honourable men of the profeffion, who have done every thing in their power, for the benefit of their clients, confiftent with the principles of truth and juftice; and yet have frequently failed in their endeavours. In fuch cafes, many imputations have been unjustly caft on men, who, fo far from deferving them, merited the moft grateful thanks of those for whom they were concerned. It has long been customary for persons, who
