Affeffments; and the faid Commiffioners, or any Seven or more of them, are hereby authorized and impowered (if they fhall think fuch Perfon or Perfons aggrieved) to give fuch Relief in the Premiffes, as to them fhall feem neceffary: and if fuch Perfon or Perfons, Bodies Politick or Corporate, fhall not be fatisfied with the Determination of fuch Commiffioners, he, she, or they shall be obliged to pay fuch Rate or Rates, Affeffment or Affeffments, and to comply with fuch Order of the faid Commiffioners, and then fhall and may appeal to the Quarter Seffion of the Peace, to be holden for the faid County or City of Oxford, within Six Months next after fuch Determination of the faid Commiffioners, fuch Appellant firft giving, or caufing to be given, Eight Days Notice at the leaft in Writing of his, her, or their Intention to bring fuch Appeal, and of the Matter thereof, to the Clerk of the faid Commiffioners, and within Four Days next after such Notice, entering, or caufing a Recognizance to be entered into, before fome Juftice of the Peace for fuch County or City, by Two fufficient Perfons or Sureties conditioned to try fuch Appeal, and to abide the Order of, and to pay fuch Cofts as fhall be awarded by the Juftices at fuch Quarter Seffion; and the faid Juftices of fuch Quarter Seffion, upon due Proof of fuch Notice being given as aforefaid, and of the entering into fuch Recognizance, fhall hear and determine the Caufes and Matters of fuch Appeal in a fummary Way, and award fuch Cofts to the Parties appealing, or appealed against, as they the faid Juftices fhall think proper, and the Determination of fuch Juftices at their Quarter Seffions fhall be final, binding, and conclufive.

And be it further Enacted, by the Authority aforefaid, That no Perfon or Perfons fhall take or carry away, or away Soil, caufe to be taken or carried away, any Afhes, Duft, Contractor. Dirt, Muck, Dung, or Manure, which fhall be made in any or either of the faid Streets, Lanes, Paffages, or other publick Places in the faid Univerfity, City, and Suburbs, and Parish of Saint Clement, out of the fame, befides the Perfons fo to be contracted with, or appointed as aforefaid for fuch Purpose by the faid Commiffioners, upon Pain of forfeiting and paying the Sum of Twenty Shillings for every fuch Offence.

Yards, or Gardens; but the fame fhall respectively belong to the Perfon or Persons fo referving the fame, fo as fuch Ashes, Duft, Dirt, Filth, Soil, Dung, or Rubbish be not laid down or placed in any or either of the faid Streets, Lanes, or publick Paffages, and Places in the faid University, City, or Suburbs, or the faid Parish of Saint Clement, for any longer Time than fhall be neceffary for the loading and carrying away the fame, nor fuffered to annoy the Neighbour or Neighbours of fuch Perfon or Perfons; but in cafe the Person or Persons so referving fuch Ashes, Duft, Dirt, Filth, Soil, Dung, or Rubbish, thall thereby annoy his or their Neighbour or Neighbours, and fhall continue to keep and preferve the fame for the Space of Three Days, after Notice in Writing given to him, her, or them, under the Hands of the faid Commiffioners, or any Five or more of them, or left at fuch Perfon's Dwelling Houfe, to remove the fame, fuch Perfon or Perfons fhall forfeit and pay the Sum of Ten Shillings a Day, for every Day fuch Annoyances fhall be permitted to remain, next after fuch Notice given as aforefaid.

Provided always, That no Perfon fhall be fubject to Penalty the laft-mentioned Penalty of Ten Shillings for any not to exRubbish or Dirt, in the faid Streets, Lanes, Paffages, or publick Places, or any of them, before the Houfe or occationed Tenement of fuch Perfon occafioned by the building, by Buildpulling down any Building, rebuilding, or repairing, any fuch Houfe or Tenement, fo as there be convenient Room left in the fame Street, Lane, Paffage, or Place, where fuch Rubbish or Dirt fhall lie, for Carriages to pafs and repafs, and a fufficient Way kept clean for Foot-Paffengers, by the Perfon laying or occafioning fuch Dirt or Rubbish to be laid; nor for the making up any Lime into Mortar in any of the faid Streets, Lanes, Paffages, or Places, fo as fuch Room be left for Foot-Paffengers and Carriages, and fo as fuch Lime be inclofed before fuch Houfe or Building, about which the fame is to be used, and fo as the Owner or Owners of fuch Houfe or Tenement, before which fuch Rubbish or Lime fhall lie, fhall cause the fame to be removed out of the faid Street, Lane, Paffage, or Place, at his, her, or their own Cofts and Charges, within a reasonable

reasonable Time, or upon Notice to be given to him, her, or them, or left at his, her, or their faid House, where fuch Rubbish or Lime fhall lie, for that Purpofe, in Writing, to be figned by the faid Commiffioners, or any Five or more of them, and fo as that whilft the fame fhall be lying in the faid Street, Lane, Paffage, or Place, fuch Owner or Owners fhall fet up and maintain a fufficient Light upon or against the fame, every Night during the whole Night, from the Time it becomes dark, to prevent any Mischief happening to Paffengers, which might otherwise be occafioned thereby.

Provided always, and be it further Enacted, by the Dirt in the Authority aforefaid, That the Perfon or Perfons conStreets, &c. tracted with for cleanfing the faid Streets, Lanes, by confent publick Paffages, and Places, or any Part or Parts thereof, fhall have Liberty, by the Approbation and Order of Five or more of the Commiffioners, to lodge their Dirt, Duft, Afhes, or other Filth, in fuch vacant and publick Places in or near the faid Streets, Lanes, Paffages, and other Places, as fhall not appear to be intended to be built upon, and as fhall be thought convenient by the faid Commiffioners, they the faid Perfons, fo contracted with, giving fuch Satisfaction to the Owners and Occupiers of fuch vacant Places as the faid Commiffioners, or any Five or more of them, shall direct.

That if any matriculated Perfon or Perfons, or Member damaging of the faid Univerfity, fhall wilfully break, throw down, or otherwise damage, any of the Lamps which fhall be erected by Virtue of this Act, or any of the Pofts, Irons, or other Furniture thereof, or extinguifh any of the See 21 Geo. faid Lamps, it fhall and may be lawful to and for the III. p. 98. on Account of Abfence, commonly called the ProVice-Chancellor, or his Affeffor in the Univerfity Court, and they are hereby required, upon Oath made of the Commiffion of any fuch Offence, (which Oath the faid Vice-Chancellor, or his faid Deputy, or his faid Affeffor, or any of them, is and are hereby impowered and required to administer to any Perfon or

Perfons offering to make the fame,) to iffue a Warrant or Warrants for apprehending the Party or Parties accused; or it fhall be lawful for any Perfon or Perfons whatsoever, who fhall fee fuch Offence committed, to apprehend, as alfo for any other Perfon or Perfons to affift in apprehending, the Offender or Offenders, and, by Authority of this Act, to convey him or them before the faid Vice-Chancellor, Deputy, or Affeffor, to be dealt with as herein after is directed, and the Party or Parties fo accufed being brought before the faid Vice-Chancellor, Deputy, or Affeffor, or Oath being made before him, or either of them, that fuch Party or Parties cannot be found and apprehended, (which Oath the faid Vice-Chancellor, Deputy, or Affeffor, is and are hereby alfo required and impowered to administer,) the faid Vice-Chancellor, Deputy, or Affeffor, fhall proceed to examine upon Oath any Witnefs or Witneffes who fhall appear or be produced to give Information touching fuch Offence; and if the Party or Parties accufed fhall be convicted of fuch Offence, either by his or their own Confeffion, or upon fuch Information as aforefaid, he or they fo convicted shall for the first Offence refpectively forfeit and pay (to be applied to the Purposes of this Act) a Sum not exceeding Ten Shillings, nor under Five Shillings, for each Lamp fo broken or thrown down, damaged, or extinguished as aforefaid: For the fecond Offence the Sum of Fifteen Shillings, and for the third and every fubfequent Offence the Sum of Twenty Shillings; and full Satisfaction fhall alfo be made to the faid Commiffioners or their Surveyor, by fuch Offender or Offenders, for the Damage fo by him or them done as aforefaid and in cafe the Offender or Offenders fhall refufe or neglect to pay the faid Penalties, and make fuch Satisfaction to the faid Commiffioners as aforefaid, it fhall and may be lawful for the faid Commiffioners, or any Two or more of them, to proceed for and recover the fame in the Vice-Chancellor's Court of the faid Univerfity: And alfo for the faid Vice-Chancellor, Deputy, or Affeffor, fitting in Judgment in the faid Court, to inflict by Way of further Punishment on the faid Offender or Offenders, all or any of the Penalties, whether pecuniary or other, which by the Statutes
