CANONS OF THE GENERAL CONVENTION

CANON 14.

OF THE FILLING OF VACANT CURES.

§ 1. When a Parish or Congregation becomes vacant, the Church Wardens or other proper officers shall notify the fact to the Bishop. If the authorities of the Parish shall for thirty days have failed to make provision for the services, it shall be the duty of the Bishop to take such measures as he may deem expedient for the temporary maintenance of Divine services therein.

§ 2. No election for Rector shall be had until the name of the Clergyman whom it is proposed to elect has been made known to the Bishop, if there be one, and sufficient time, not exceeding thirty days, has been given him to communicate with the Vestry thereon.

$ 3. Written notice of the election, signed by the Church Wardens, shall be sent to the Ecclesiastical Authority of the Diocese. If the Ecclesiastical Authority be satisfied that the person so chosen is a duly qualified Minister, and that he has accepted the office, the notice shall be sent to the Secretary of the Convention, who shall record it. And such record shall be sufficient evidence of the relation between the Minister and the Parish.

§ 4. A Minister is settled, for all purposes here or elsewhere in these Canons, who has been engaged permanently by any Parish, according to the rules of said Diocese, or for any term not less than one year.

CANON 39.

OF REGULATIONS RESPECTING THE LAITY.

§ 1. A communicant in good standing removing from one Parish to another shall be entitled to and shall procure from the Rector or Minister of the Parish or Congregation of his last residence, or, if there be no Rector or Minister, from one of the Wardens, a certificate stating that he or she is a communicant in good standing; and the Rector or Minister of the Parish or Congregation to which he or she removes shall record him or her as a communicant when such letter is presented, or on failure to produce such a letter from no fault of the communicant, upon other evidence of his or her standing sufficient in the judgment of the said Rector or Minister. Notice of the above record shall be sent by said Rector or Minister to the Rector of the Parish from which the communicant has removed.

CANON VII.

VACANT CHURCH AND CLERICAL SETTLEMENT AND REMOVAL.

§ 1. Whenever an incorporated Church becomes vacant, it shall be the duty of the Vestry to give immediate notice thereof to the Bishop.

§ 2. Prior to the election of a Minister of any incorporated Church the Vestry shall inform the Bishop of the name and residence of the person

they propose to elect; and it shall be unlawful for the Vestry to take action on any name until the receipt of the Bishop's acknowledgement of such notification, and of his accompanying suggestion, if there be any Provided he be at the time within the territory of the United States, and that his reply be not deferred longer than thirty days after the receipt of said notification. If, after the expiration of six months, the Vestry of such Church which has become vacant, shall fail to call or settle a Minister, it shall be the duty of the Bishop to appoint one, and he shall notify the Vestry of such appointment, and upon their concurrence, the Minister so appointed shall become Rector of the Church.

§ 3. The Bishop may appoint Clergymen in the Diocese, or others, who can with most convenience discharge the duty, to supply such vacant Churches at such time as may be deemed convenient and proper. It shall be the duty of such vacant Churches thus supplied, to defray all the expenses incidental to such occasional services.

STANDING RESOLUTIONS

Resolved, That at the Episcopal visitations the offerings, after the Bishop's traveling expenses have been paid, be hereafter devoted to a Bishop's Trust Fund.-Convention 1889.

Resolved, That any Missionary of the Diocese, who may be precluded by pecuniary inability from attending the annual Convention, be requested to advise the Bishop of such fact; and that upon application of the Bishop in such behalf to the Treasurer of the Convention, the latter shall extend the necessary aid to enable such Missionary to meet his brethren in Convention. Resolved, That the Treasurer of the Diocese of Western Michigan is hereby authorized and instructed to pay to the "Treasurer of the Association of the Diocese of Western Michigan each recurring year, so long as the necessity may exist, such portion of the money realized from the assessments upon the Parishes, as shall be over and above the amount required to pay the annual current expenses of the Diocese, to be used in making good, so far as it will go, any deficiency that occurs in the Bishop's salary from the insufficient avails of the Episcopal Fund. Provided, that in no event shall the sum paid from the General Fund towards the Bishop's salary exceed the amount of the deficiency for that year, which deficiency when it becomes apparent, the Treasurer of the Association shall officially certify to the Treasurer of the Diocese, and the receipt of the Treasurer of the Association shall be a voucher to the Treasurer of the Convention. Resolved, That the Treasurer of the Diocese be requested to send notice of Assessment to the Wardens of Parishes. [Journal 1883, page 62.]
