Provided always, and be it further Enacted, by the Qualifica-Authority aforefaid, That no Person fhall be capable oftion of acting as a Commiffioner in the Execution of this Act, fioners. unless he fhall be in his own Right, or in Right of his Wife, in the actual Poffeffion or Receipt of Lands, See Tenements, or Hereditaments, of the clear yearly Value of Forty Pounds, or poffeffed of or intitled to a perfonal Eftate of Eight Hundred Pounds; and if any Penalty on Perfon not being fo qualified fhall prefume to act, acting, not every fuch Perfon fhall for every fuch Offence forfeit being duly qualified. and pay the Sum of Fifty Pounds, to any Perfon or Perfons who fhall fue for the fame; to be recovered, in any of his Majesty's Courts of Record, by Action of Debt, or on the Cafe, or by Bill, Suit, or Information, wherein no Effoign, Protection, or Wager at Law, or more than One Imparlance, thall be allowed; and every Perfon fo profecuted fhall prove that he is qualified as aforefaid, or otherwife fhall pay the faid Penalty, on Proof given of his having acted as a Commiffioner in the Execution of this Act.

Provided always, and be it further Enacted, by the Power Authority aforefaid, That when and as often as any of lodged in the faid laft-mentioned Commiffioners, who do not more to derive their Power from the paft or prefent Enjoyment elect new of any Office, or from the Election of any College or CommifParish, fhall die or refufe to act, then, and in every fuch Cafe, it fhall and may be lawful to and for the furviving or remaining Commiffioners, whether official, elective, or other, or any Five or more of them, at a Meeting to be held for that Purpose, to elect another Perfon or Perfons in the Room of him or them fo dying or refufing to act; and every Perfon fo elected fhall have the fame Powers and Authorities for putting this Act in Execution, as the Perfon in whofe ftead he shall be elected was vefted with.

And be it further Enacted, by the Authority aforefaid, Meeting of That the Commiffioners nominated and appointed by, or elected in pursuance of this Act, or any Seven or more of them, may and fhall meet and affemble in the Town Hall in the faid City on the Fourth Tuesday after the paffing of this Act, between the Hours of Nine and Twelve in the Forenoon, in order to put this Act in Provifion Execution; and fhall then, and from Time to Time for future afterwards, adjourn themselves to, and meet at, the Meetings. fame Place, or at any other convenient Place within the faid Univerfity or City, as they, or the major Part of them prefent at fuch Meeting, fhall appoint: And if it fhall happen that there fhall not appear at any Meeting, which fhall be appointed to be held by the faid Commiffioners, a fufficient Number thereof to act and to adjourn to another Day, (Two Commiffioners being always deemed fufficient for the Purpose of adjourning,) or if they fhall omit or neglect to adjourn, then, and in every fuch Cafe, their Clerk, or any Three or more of the faid Commiffioners, fhall and may call a Meeting, at the Place where the laft Meeting was appointed to be held, on that Day Three Weeks, between the Hours of Nine and Twelve in the Forenoon, Notice thereof being given as hereafter is directed.

Provided always, and be it Enacted, by the Authority be given aforefaid, That previous to any Meeting of the faid Two Days Commiflioners in purfuance of this Act, fubfequent to fuch First Meeting as aforefaid, Notice fhall be given by the Clerk of the faid Commiffioners, and fixed at the South Gate of the Schools of the faid University, and alfo at the Gate of the Town Hall in the faid City, fignifying the Time and Place of every fuch Meeting, Two Days at least before every fuch Meeting.

Shilling and Six-pence: For every Coach, Chaise, Berlin, Chariot, or other Carriage as aforefaid, drawn by Four Horfes, or other Cattle, the Sum of One Shilling: For every Coach, Chaife, Berlin, Chariot, or other Carriage, drawn by Two Horfes, the Sum of Six-pence: For every Chaife, or other Carriage, drawn by one Horfe or other Beast, the Sum of Twopence: For each Horse, or other Beaft, drawing in any See General Waggon, Cart, Wain, or other Carriage, being a Turnpike Common Stage Waggon, or travelling for Hire, the Act. Sum of Two-pence: For each Horfe or other Beast drawing in any Waggon, Cart, Wain, or Carriage, not travelling for Hire, or employed in Hufbandry, the Sum of One Penny And for every other Horse,

Mare, Gelding, Mule, or Afs, laden or unladen, and not drawing, the Sum of One Penny: For every Drove of Oxen, or Neat Cattle, Five-pence per Score, and fo in Proportion for any greater or lefs Number: Which Sums refpectively fhall be demanded in the Name of and as a Toll, and shall be and are hereby vested in the faid Commiffioners, and the fame and every Part thereof fhall be paid and applied in fuch Manner as is herein after mentioned and directed; and it fhall and may be lawful, to and for fuch Perfon or Perfons as the faid Commiffioners, or any Five or more of them, under their Hands and Seals fhall from Time to Time nominate and appoint, to demand and take the Tolls or Duties hereby granted and made payable; and also to levy the fame upon any Perfon or Perfons liable to pay the fame, who fhall, after Demand thereof made, neglect or refufe to pay fuch Tolls or Duties as aforefaid, by Diftrefs of any Carriage or Carriages, or Cattle upon which fuch Tolls or Duties are by this Act impofed, or by Diftrefs of any other of the Goods and Chattels of the Perfon or Perfons fo neglecting or refufing as aforefaid, wherefoever the fame may be found, and to detain and keep fuch Goods and Chattels fo diftrained until fuch Tolls and Duties, with the reasonable Charges of fuch Distress and keeping, fhall be paid; and fuch Perfon or Perfons fo diftraining after the space of Four Days after fuch Diftrefs made and taken, fhall and may fell the Goods or Chattels fo diftrained, returning the Overplus, (if any be,) upon Demand, to the Owner thereof, after fuch Tolls and Duties, and the reasonable Charges for diftraining, keeping, and felling the fame, thall be deducted and paid.

Provided nevertheless, That no more than One Half of the Tolls aforefaid thall be demanded or taken for any Horfe or other Cattle, drawing in any Waggon, Cart, Wain, or other Carriage, laden with Corn only, coming into the faid City, through any Turnpike Gate or Turnpike Gates to be erected by the Authority of this Act, upon either of the Weekly Market Days there.

Provided always, and be it Enacted, by the Authority aforefaid,

aforefaid, That if any Perfon or Perfons fhall have paid Tolls to be the Tolls by this Act granted and afcertained for the paid but Paffing of any Cattle or Carriage through any Turnpike Hours. erected by Virtue of this Act, fuch Perfon or Perfons, upon producing a Note or Ticket of the Day, denoting III. p. 85. fuch Payment, fhall be permitted to pafs and repafs through the fame Turnpike, and alfo through all other Turnpikes erected by Virtue of this Act, with the fame. Cattle or Carriage, Toll-free, at any Time or Times during the fame Day to be computed from Twelve of the Clock in one Night to Twelve of the Clock in the next Night; which faid Note or Ticket the Collectors of the faid Tolls are hereby required to give gratis (if demanded) on Receipt of fuch Tolls.

Provided always, and be it further Enacted, That no Exemption Perfon or Perfons fhall be charged with any of the from Tolls. Tolls or Duties aforefaid, for paffing through any of the Turnpikes to be erected by Virtue of this Act, with any Cattle or Carriage going empty for, or drawing or carrying, or returning empty after having drawn or carried, any Materials for repairing the faid Roads or Streets, or any Hay or Corn in the Straw, to be laid up in the Houfes, Outhoufes, Barns, or Yards, belonging to the refpective Inhabitants of the faid Univerfity, City, and Suburbs thereof, or the faid Parish of Saint Clement, or any Manure or Compoft to be laid upon. Lands or Gardens, or with any Ploughs, Harrows, or other Implements of Hufbandry, or with any Horfes or other Cattle, going to or returning from Pasture or Watering Places, in any of the Parishes in Oxford aforefaid, or in the faid Parish of Saint Clement, or going to be fhod or otherwife farried, or returning therefrom, or with any Horfes or Carriages drawing or carrying the Poft-Mail or Pacquet, or attending any Soldiers in their March, or laden with their Arms or Baggage, or travelling with Vagrants fent by legal Paffes, or going to or returning from any Election of a Knight or Knights of the Shire to ferve in Parliament for the County of Oxford, or of a Burgefs or Burgeffes for the faid University, or of a Citizen or Citizens for the faid City of Oxford, on the Day or Days of fuch Election.
