An Act for vesting certain Parcels of Land in Paddington, in the County of Middlesex, in the Rector and Churchwardens of the Parish of Saint George Hanover Square, in the faid County; and appropriating the fame for a Burial-ground for the said Parifb.

HEREAS Sir John Frederick Baronet, de- Preamble, ceased, being feized, to him and his Heirs, reciting the of a confiderable Real Estate in Lands, Tenements, Will of Sir and Hereditaments, did, in and by his laft Will Frederick,&c. and Teftament, in Writing, bearing Date the Twenty-feventh Day of February One thousand feven hundred and thirty-four, give and devise the fame unto or to the Ufe of his eldest Son John Frederick (afterwards Sir John Frederick Baronet, and fince deceased) for his Life, without Impeachment of Waste; with Remainder to Trustees therein named, and their Heirs, during the Life of his faid Son John Frederick, in Truft, to preferve contingent Remainders; and, after his Death, to his First and every other Son fucceffively, in Tail Male; Remainder to the Teftator's Second Son Thomas

Frederick (now Sir Thomas Frederick Baronet) for his Life, without Impeachment of Wafte, with the like Provifion for preferving the contingent Remainders; and, after his Death, to his First and every other Son fucceffively, in Tail Male; Remainder to the Heirs Male of the Teftator's own Body; Remainder to his own right Heirs; and gave Power to any of his Sons, when in Poffeffion, to make fuch Jointures and Leafes of the fame Estates as therein mentioned; and, by a Codicil to his faid Will, bearing Date the Tenth Day of April One thousand feven hundred and forty-two, he gave, devised, and bequeathed, his Real Estate, in Default of Iffue Male of his faid Sons John and Thomas, and Iffue Male of his own Body, unto the Heirs of his Body; and thereby gave Power to his faid Sons John and Thomas refpectively, when in Poffeffion of his Real Estate, under faid Codicil and Will, to charge the fame with fuch Portions and Maintenances for their respective Daughters and younger Sons, if Iffue Male, or for their Daughters, if no Iffue Male, as therein mentioned; and after taking Notice therein, that, fince the making his faid Will, he had purchased the Scite and Capital Meffuage of the Manor of Paddington, and the Demefnes and other Lands lying in Paddington, in the County of Middlefex, held by Leafe for Three Lives from the Bishop of London, he thereby gave and devised the fame to the Trustees, in his faid Will, their Heirs and Affigns, during the Lives of Judith Jodrell, John Affleck, and John Crozier the younger, in the faid Leafe named, and the Life of the longest Liver of them, upon Trust, out of the Rents and Profits, to pay the Rent reserved by the faid Leafe, and perform the Leffees Covenants therein, and to renew the faid Leafe, as Occafion fhould require, and raise the Fines and Charges for

fuch Renewals, and fubject thereto, fhould ftand feized of the faid Leafehold Premifes, in Truft, for fuch and the fame Perfon and Perfons as fhould from Time to Time be entitled to his Freehold Lands of Inheritance, by virtue of his faid Will or Codicils, fo far as the Nature of the said Leafehold Premises would admit, and by the Rules of Law or Equity they might: And whereas the faid Sir John Frederick, the Teftator, died in the Year One thousand seven hundred and fifty-five; and, upon his Death, the Freehold and Leafehold Eftates, fo given and devised by his faid Will and Codicil respectively, did thereby come unto, and veft in, the faid Sir John Frederick, his eldest Son, who held and enjoyed the fame during his Life; and he dying inteftate and without Iffue, in the Month of March One thousand feven hundred and fifty-feven, the faid Freehold and Leafehold Eftates did thereupon come unto, and are now vefted in, the faid Sir Thomas Frederick, under the Devifes, Trufts, and Limitations, of the faid Will and Codicils refpectively And whereas the faid Sir Thomas Frederick hath Iffue Two Daughters, namely, Elizabeth Frederick, now of the Age of Four Years, and Selina Frederick, now of the Age of Three Years, or thereabouts, and no other Iffue: And whereas, by the great Increase of Inhabitants in the Parish of Saint George Hanover Square, in the County of Middlefex, the prefent Cemetery or Burial-ground thereof is become too small for the Burial of the Dead; and the Straitnefs thereof, and the great Number of Parish Poor and others buried therein, render it offenfive and unwholesome to the Inhabitants in the Neighbourhood: And whereas a certain Piece or Parcel of Ground, fituate, lying, and being in Paddington aforefaid, and containing Five Acres or thereabouts, lying at the West End of the

Field called Tyburn Field, and containing, in Breadth from Eaft to Weft, Four hundred and three Feet and four Inches, or thereabouts, and in Length, from North to South, Five hundred and forty Feet, or thereabouts, and abutting towards the Weft and North on Two other Fields, Part of the faid Eftate, and South on a fmall Piece of Wafte Ground, lying between the said Field and the Highway leading from London to Uxbridge, and is Part of the Lands and Tenements held by Leafe from the Bishop of London as aforefaid, would be very convenient to be made ufe of and converted into a Cemetery or Burial-ground for the faid Parish of Saint George Hanover Square; and also the said Piece or Parcel of Ground lying between the faid Highway and Tyburn Field aforefaid, being Part of the Waste of the Manor of Paddington, and belonging to the faid Lord Bishop of London, as Lord of the faid Manor, and in Right of his See, and containing, in Breadth, at the Eaft End, Twenty-two Feet, and, at the West End Sixteen Feet, or thereabouts, and in Length, Four hundred and three Feet and Four Inches, or thereabouts, and abutting North on the faid Field, and South on the faid Highway, is proper and convenient to be used and applied in and for the making Ways, Paffages, Drains, and other Conveniencies, for the faid intended Burial-ground; and the Reverend Charles Mofs Doctor in Divinity, Rector of the faid Parish of Saint George Hanover Square, and the Right Honourable Anthony Lord Feverfham, and Sir William Beauchamp Proctor Baronet, Churchwardens of the faid Parish, have contracted and agreed with the faid Sir Thomas Frederick, for the Purchase of his Life Eftate or Intereft in faid Five Acres of Ground; and it is alfo propofed and agreed, that the Churchwardens of the faid Parifh of Saint
