Cinders, Ashes, or Duft, from carrying away the fame for his own Ufe, but not for Sale.

L. And be it further enacted, That no Perfon fhall caufe to be erected or built within any of the faid Streets and other publick Paffages or Places, any Hoard or other Inclosure, for the Purpose of depofiting Materials for building, or for any other Purpose, without a Licence under the Hand of the Surveyor to the faid Committee of Paving, who is hereby required to grant the fame forthwith, under fuch Regulations and Restrictions as the faid Committee shall direct, to be expreffed in fuch Licence, upon Payment, by the Perfon applying for fuch Licence to the faid Surveyor, of the Sum of One Shilling, and no more; and no Perfon fhall build any fuch Hoard or Inclofure as aforefaid, in any other Manner, or fuffer the fame to remain for any longer Time than fhall be expreffed and allowed in fuch Licence, or a Renewal thereof, or without keeping the fame lighted in fuch Manner as fhall be expreffed in fuch Licence or Renewal thereof, upon Pain of forfeiting any Sum not exceeding Forty Shillings for every fuch Offence; and it fhall be lawful for the Surveyor to the faid Committee to cause all Posts, Rails, Boards, or other Things, of which the faid Hoard or Inclofure fhall confift, and which fhall have been erected or continued without, or contrary to fuch Licence, to be taken down and removed, and depofited in fuch Place as he thall think proper (giving Notice to the Perfon or Perfons who erected fuch Hoard or other Inclofure, of the Place where the faid Materials fhall be depofited, if he, fhe, or they can be found), and the fame fhall be there kept and detained until the Owner or Owners thereof fhall pay to the Perfon

in whofe Cuftody the fame fhall be, the faid Penalty, together with the Charges of taking down and removing the fame; and in cafe the fame fhall not be claimed, and the faid Penalty or Forfeiture and Charges paid, within the Space of Five Days next after fuch Removal, it fhall be lawful for the faid Committee to cause the fame to be appraised and fold, returning the Overplus (if any), upon Demand, to the Owner or Owners of fuch Materials, after deducting the faid Penalty, and the Charges of taking down, removing, keeping, appraising, and felling the fame.

LI. And be it further enacted, That if any Per- Afcertaining fon fhall take away any Night Soil from any House the Hours of within the faid Parish, except between the Hours taking away Night Soil. of Twelve in the Night and Five in the Morning, between Michaelmas and Lady Day, or between the Hours of Twelve in the Night and Four in the Morning between Lady Day and Michaelmas, or fhall put or caft, or caufe to be put or caft, any fuch Night Soil in any of the faid Streets, or other publick Paffages or Places, it fhall be lawful for any Constable, Beadle, Watchman, or Patrol, and he is hereby strictly required by the Authority of this Act, and without any other Warrant, to apprehend any fuch Offender, and convey him to the Watch Houfe of the faid Parish, and from thence, as foon as conveniently may be, before fome Justice of the Peace for the faid City and Liberty, or County of Middlefex, and upon Proof being made upon Oath of any fuch Offence, every such Offender fhall forfeit any Sum not exceeding Forty Shillings; and in Default of Payment thereof, the faid Juftice fhall commit the Offender to the House of Correction for any Time not exceeding Three Months, or until fuch Penalty, and the Cofts and Charges

Charges of fuch Commitment, be paid; and it fhall be lawful for the said Committee to pay to the Perfon or Perfons apprehending fuch Offender any Sum not exceeding Ten Shillings.

LII. And, for the more fpeedy amending the Pavement which shall be taken up for repairing any Main or Pipe belonging to any of the Water Companies; be it further enacted, That as often as any Water Pipes. Main or Pipe belonging to any Water Company, within any of the faid Streets or other publick Paffages or Places, fhall require to be repaired, the Surveyor to the faid Committee fhall forthwith give Notice thereof in Writing to the Paviour of the Water Company to whom he apprehends the fame to belong, which Notice fhall be delivered to him,' or left at his laft or ufual Place of Abode; and fuch Paviour is hereby required forthwith to take up the Pavement, and open the Ground, where any fuch Repairs fhall appear to be wanted, and if he fhall thereupon difcover that fuch Main or Pipe does not belong to the Water Company whofe Paviour he is, then he fhall forthwith give Notice thereof in Writing, to the Paviour of the Company to whom the faid Main or Pipe fhall appear to belong; and fuch laft-mentioned Paviour is hereby required, upon Demand, to make Satisfaction for taking up fuch Pavement, and opening fuch Ground, to the Paviour giving Notice as aforefaid, and the Paviour of fuch Water Company to whom the said Main or Pipe fhall belong, fhall and is hereby required to caufe the faid Main or Pipe to be forthwith effectually repaired, and afterwards to fill in and ram down the Ground on the fame Day that the Repair of the Main or Pipe is completed, and within Six Hours then next to give Notice thercof to the Surveyor or Infpector to be ap pointed

pointed by the faid Committee, by Writing to be delivered to him, or left at his ufual Place of Abode; and if any Pavement within any of the faid Streets or other publick Paffages or Places fhall be taken up for the Purpose of making or altering any Vault or Drain, or for any other Purpose, the Perfon caufing the Pavement fo to be taken up fhall, as foon as the Nature of the Work will permit, cause the Ground to be filled in and ramined down, and immediately give Notice thereof in Manner aforefaid, to the Surveyor to the faid Committee; and the Perfon taking up any Pave- Where the ment as aforefaid is hereby required to caufe the l'avement is taken up, the Place to be properly lighted in the Night Time, fo Place to be as to prevent Accidents happening thereby; and in lighted in the cafe any Paviour or other Perfon fhall make De- Night Time, fault in any of the Matters aforefaid, he shall, for every fuch Default, forfeit and pay any Sum not exceeding Five Pounds, nor lefs than Forty Shillings; and the Surveyor to the faid Committee fhall forthwith, upon receiving any fuch Notice as aforefaid, tranfmit the fame to the Paviour or Perfon contracting with the Committee to repair the Pavements within the faid Streets and other publick Paffages and Places: Provided always, that if at any Time there fhall be no regular or fixed Appointment of a Paviour to any Water Company within the faid Parish, then fuch Notice fhall be delivered to or left at the Office of the Clerk to fuch Company, who fhall be fubject and liable to the like Directions in all Respects, and to the like Penalties for Default, Refufal, or Neglect, as the Paviour to fuch Com pany is herein-before made fubject and liable to.

LIII. And be it further enacted, That if it fhall appear to the faid Committee, by the Report of their Inspector or otherwife, that the Pavement

adjoining Pavement, fo far as the fame shall have been injured or damaged thereby, fhall not have been well and fufficiently re-laid and made good, the Paviour to the Water Company, or the Perfon to whom fuch Main or Pipe fhall belong, fhall, within the Space of Two Days after Notice given by fuch Inspector in Manner aforefaid, caufe fuch Pavement to be again re-laid, to the Satisfaction of fuch Inspector; and if at any Time within the Space of Four Calendar Months after any Pavement fhall have been re-laid, any Defect fhall appear therein, the Paviour to the Water Company, or the Perfon to whom the Main or Pipe, for the repairing of which fuch Pavement was taken up fhall belong, fhall, within Two Days after Notice thereof given to him as aforefaid, again re-lay and make good fuch Pavement, and fo in like Manner from Time to Time, until the Pavement fo re-laid or repaired fhall continue in good and fufficient Repair for the Space of Four Calendar Months at the least after fuch re laying or repairing.

LIV. And, in order that the Places of Abode of Water Com- the Paviours employed by the faid Water Companies may be known to the faid Committee; be it further enacted, That the feveral Paviours now or hereafter to be employed within the faid Parish by any Water Company fhall, within Ten Days next after the Commencement of this Act, or within Three Days after they fhall be refpectively appointed, or fhall remove from their ufual Places of Abode, give Notice in Writing to the Clerk to the said Committee of their refpective Names and Places of Abode, and of the Names of the refpective Companies whofe Paviours they are, and of the Divifion,
