XIII. XIV. An act to explain and amend an act, passed in the twenty-fecond year of the reign of his prefent Majefty, for the better relief and employment of the poor.[May 7, 1793.]

HEREAS, by an act made in the twenty-fecond year of the reign of his present Majesty, (intituled, An act for the better relief and employment of the poor), it was among other things enacted, That whenever two third parts in number and value, according to the poor rate, of the owners or occupiers of lands, tenements, or hereditaments, within any parish, township, or place, qualified as there-after mentioned, should, at any time after the paffing of that act, at a publick meeting to be holden pursuant to the directions of that act, fignify their approbation of the provisions therein contained, and their defire to adopt them: and whereas doubts have arifen, whether it be necessary that two third parts in number and value as aforefaid, of the whole number of perfons fo qualified as aforefaid, Should at fuch publick meeting fignify their approbation and defire as aforefaid: be it therefore declared and enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this present Two thirds in parliament affembled, and by the authority of the fame, That value of perwhenever two third parts in number and value as aforefaid, of fons qualified fuch qualified perfons only, as have actually attended, or may according to hereafter actually attend, at fuch publick meeting, have there fignified, or may hereafter there fignify, their approbation of the provifions in the faid act contained, and their defire to adopt them, according to the form and manner prefcribed by the faid act, fuch approbation and defire fo fignified, or to be hereafter fo fignified, as aforefaid, have been, and fhall be, and are hereby declared to be, a due and fufficient compliance with the aboverecited provifion of the faid act, according to the true intent and meaning of the fame.

II. And whereas also the duty of guardian of the poor, under the faid act, in certain parishes, townships, or places, on account of the extent and population thereof, has been found to be more than one perfon could fully and properly execute: and whereas also it is defirable to prevent fuch difputes and litigations as might arife concerning the relief of fuch cafual poor as may happen to be within any one of the parishes, townships, or places united or to be united together for the purposes of the faid act: be it therefore enacted by the authority A like numaforefaid, That whenever two third parts, in number and value ber may re- as aforefaid, of the faid perfons fo qualified, and actually atcommend to tending at fuch publick meeting as aforefaid, fhall nominate the juftices three perfons and recommend to the confideration of the juftices of the qualified for peace of the county, riding, divifion, diftrict, city, town, or guardians of place where fuch meeting fhall be holden, three able and difcreet the poor, &c. perfons qualified for guardians of the poor for fuch parish, townfhip, or place, and shall fix the falary to be paid to fuch guardian, according to the manner and form prefcribed by the faid act;

and fhall alfo, at the faid publick meeting, by writing under their
hands, fignify their opinion to the faid juftices, that, on ac-
count of the extent and population of such parish, township, or
place, more than one guardian of the poor is neceffary for the
fame; and fhall express their defire that two of the three perfons
fo nominated and recommended as aforefaid, may be appointed
guardians of the poor for fuch parifh, township, or place, it fhall
and may be lawful for such of the said justices as are already em-
powered by the said act to appoint one guardian for fuch parish,
township, or place, to comply with the faid defire, and to appoint
two guardians accordingly.

III. And be it also further enacted by the authority aforesaid, That after the paffing of this act, all fuch casual poor, as may Cafual poor to happen to be within, and would be entitled to relief from, any be relieved by united parishes one of such parishes, townfhips, or places as have been, or may conjointly. hereafter be, united together for the purposes of the act herein-before first mentioned, fhall be relieved by all the faid parifhes, townships, or places conjointly, and in the fame respective proportion as they shall and are directed to contribute for the general purposes of the faid act, according to the provisions and regulations in the faid act specified and contained.

CA P. XXXVI.

An act to establish certain regulations respecting officers ferving in several
corps of Fencible Men, in that part of Great Britain called Scotland,
and in certain other corps which may be directed to be raised in Great
Britain. [May 7, 1793.]

Commiffions in fencible regiments in Scotland, or in other corps in Great
Britain, in which only the adjutants and quarter mafters fhall be entitled
to half-pay and rank after reduction, not to vacate seats in parliament.
Officers of fuch corps and of the militia in England, when ferving together
to rank according to the dates of commiffions. Half-pay officers during
their fervice in fuch corps as lieutenants, &c. to receive halt-pay. The
allowance of 12d. a day may be received by ferjeants of Chelsea Hofpital
ferving in fuch corps.

CA P. XXXVII.

An act to amend an act, made in the thirty-first year of the reign of
his late majesty King George the Second, intituled, An act for
the due making of bread, and to regulate the price and affize
thereof; and to punish perfons who fhall adulterate meal,
flour, or bread, with respect to the time within which certain
profecutions directed by the faid act are to be brought. [May 10,
1793.]

HEREAS by an act of parliament, made and passed in the Preamble. thirty-fecond year of the reign of his late majesty King George the Second, intituled, An act for the due making of bread, 31 Geo. 2. c. and to regulate the price and affize thereof; and to punifh per- 29, recited. fons who fhall adulterate meal, flour, or bread; it was among st other things enacted, That, from and after the twenty-ninth day of September one thousand feven hundred and fifty-eight, no perfon should knowingly put into any corn, meal, or flour, which should be

ground, dreffed, bolted, or manufactured for fale, either at the time of grinding, dreffing, bolting, or in anywife manufacturing the fame or at any other time or times, any ingredient, mixture, or thing whatfoever, or fhould knowingly fell, offer, or expofe to or for fale, any meal or flour of one fort of grain as or for the meal or flour of any other fort of grain, or any thing as or for or mixed with the meal or flour of any grain, which should not be the real and genuine meal or flour of the grain the fame fhould import to be, and ought to be, upon pain that every person who should offend in the premises, and fhould be thereof convicted in manner therein-after prefcribed, should forfeit and pay, for every fuch offence, any fum not exceeding five pounds, nor less than forty fhillings, as the magiftrate or magiftrates, juftice or juftices, before whom fuch offender or offenders fhould be convicted, fhould think fit or order; and the faid act directs that no perfon fhould be convicted, in manner therein aforefaid, for any of the offences in the faid act before-mentioned, unless the profecution, in order to fuch conviction, should be commenced within three days next after the offence committed: and whereas the powers and remedies by the faid recited act given and granted for enforcing the intention thereof, have been found by experience infufficient to anfwer the good purposes thereby intended, and that it would be of great publick benefit and utility to have further and more effectual powers given for carrying the intentions of the faid act into execution; and a further and other time given for convicting any offender or offenders guilty of adulterating any corn, meal, or flour, which should be ground, dreffed, bolted, or manufactured for fale as aforesaid, with any other ingre dient, mixture, or thing whatsoever; may it therefore please your Majefty that it may be enacted; and be it enacted by the King's most excellent majesty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent Provifo limit- parliament affembled, and by the authority of the fame, That, ing the time from and after the first day of June one thousand seven hundred of conviction, and ninety-three, the herein-before recited provifo, contained in in fect. 41 of the forty-firft fection of the faid in part recited act, limiting the repealed, and time of conviction for three days next after any of the offences profecution to committed, and in the faid recited act mentioned, be repealed; becommenced and that, from and after the faid first day of June, no perfon fhall within 7 days. be convicted for any of the before-mentioned offences in the faid

II. And be it further enacted, That this act fhall be deemed, adjudged, and taken to be a publick act; and fhall be judicially taken notice of as fuch, by all judges, juftices, and other perfons whomfoever, without the fame being fpecially pleaded.

CA P. XXXVIII.

An act for making and maintaining a navigable canal from or nearly from a place called The Saltisford, in the parish of Saint Mary, in the borough of Warwick, unto or near to the parish of Birmingham, in the county of Warwick, and to terminate at or near to a certain navigable canal in or near to the Town of Birmingham, called The Digbeth Branch of the Birmingham and Birmingham and Fazeley canal navigations.

Certain perfons incorporated by the Name of "The Company of Proprietors of the Warwick and Birmingham canal navigation." Act to commence April 5, 1793. Canal to begin at a bridge at a place called The Saltisford, in the parish of Saint Mary in Warwick, through Budbrooke, Hatton, Shrewley, Rowington, Kingswood, Baddefley, Clinton, Knowle, Solyhull, Hampton in Arden, Elmdon and Bickenhill, in the county of Warwick; Yardley in the county of Worcester, and Afton juxta Birmingham, and Birmingham, and to terminate at the Digbeth Branch of the Biriningham and Fazeley canal. General powers. Surveys taken. Map and book of reverence authenticated by the speaker of the houfe of commons, and allowed as evidence. For making a communication with the Birmingham and Fazeley canal, and preventing lofs of water by the junction. For the tonnage and wharfage of all coals, coke, iron, iron stone, and goods carried from the Digbeth Branch of the Birmingham and Fazeley canal into the intended canal, 6d. per ton, and from the intended canal to the faid Digbeth Branch, 3d. to be received by the proprietors of the Birmingham and Fazeley canal. For recovery of the rates to be paid to the Birmingham and Fazeley canal. Birmingham and Fazeley canal company may reduce the tonnage rates, and the navigation free, on payment of the faid rates. Birmingham and Fazeley canal to reduce the faid rates to 5d. a ton, when they have paid off 3,600l. with intereft due to certain fubfcribers of an intended canal, and to give an account thereof annually to this company. Power to deviate one hundred yards from the line laid down in the plan. Land owners omitted in the book of reference not to obftruct making the canal. Breadth of canal and towing paths to be thirty yards. Courfe of canal through Mr. Spooner's and Sir Thomas Gooch's lands defcribed. Canal to be made at a certain distance from the houses of Mr. Moland and Mrs. Baldwyn. Water to be taken from the river Rea, or the stream supplying Olton mill. After the canal, &c. fet out, the land fo fet out, may be fold and conveyed to the company. Commiffioners names. In what cafes juries to be impanelled. 20l. penalty on sheriffs making default, and 51. on jurymen. Expences of commiffioners and jury. Perfons requesting juries to enter into a bond to profecute. Notice of injury to be given to the company of proprietors before complaint made to the commiffioners. Perfons giving falle evidence, liable to punishment for perjury. Upon payment or tender of money affeffed, the company to enter to make canal. Verdicts, &c. to be recorded, and lands become vefted in the company. The company to be taxed for lands and buildings in the fame proportion as adjoining lands. Purchase monies to be laid out to the fame ufes. Commiffioners to fettle proportion of money to be paid to perfons interested. If costs and damages not paid in four months, the fame may be levied by distress and fale. Commiffioners to enter proceedings in a book, and appoint a clerk. To deftroy the works felony. Proprietors may raise 100,000l. to be divided into fhares of tool. each, and no perfon to have more than 15 shares. Power to raise 30,00ol. more if neceffary. Five per cent. interest to be paid to fubfcribers, until the canal is finished. Subfcribers to have a vote for each share. First meeting of general assembly on May 27, 1793, for choosing a committee. Committee to be under the controul of the general affembly. General affemblies to confift of 550 fhares. Power of general affemblies. Power of committee. Subfcribers forfeiting, fhall have perfonal notice, and the forfeiture must be declared at a general affembly. General affemblies may remove committee men, make bye laws, &c. On death of subscribers before shares completed, executors and administrators allowed to contribute. How fhares may be difpofed of.
