Lard, and Greafe; to the regulating the Fees of Officers of the Cuftoms and Naval
Officers in America; to the allowing the Exportation of certain Quantities of Wheat,
and other Articles, to his Majefty's Sugar Colonies in America; and to the allowing a
Drawback of the Duties on Rum fhipped as Stores to be confumed on board Mer-
chant Ships on their Voyages.

HEREAS the Laws herein after mentioned have by Experience been found ufeful and beneficial, and are near expiring: May it therefore please your Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That fo much of an Act made in the eighth Year of the Reign of King George the Firft, intituled, An Act for giving further Encouragement for the Importation of Naval Stores, and for other Purposes therein mentioned, as relates to the Importation of Wood and Timber, and of the Goods commonly called Lumber, therein particularly enumerated, from any of his Majefty's British Plantations or Colonies in America, free from all Cuftoms and Impofitions whatfoever, which was to be in force for twenty-one Years from the twenty-fourth Day of June one thousand feven hundred and twenty-two; and which by feveral fubfequent Acts, made in the fixteenth, twenty-fourth, and thirty-first Years of the Reign of his late Majefty King George the Second, and the fourth and twelfth Years of his prefent Majefty's Reign, was further continued until the twenty-ninth Day of September one thoufand feven hundred and feventy-eight, and from thence to the End of the then, next Seffion of Parliament, fhall further conti be, and the fame is hereby further continued, from the Expiration thereof, until the twenty-ninth Day of September one thousand feven hundred and eighty-five, and from thence to the End of the then next Seffion of Parliament.

11. Provided nevertheless, and it is hereby further enacted by the Authority aforefaid, That a due Entry of fuch Goods fhall be first made in the Custom house belonging to the Port where the faine fhall be imported, in the fame Manner and Form, expreffing the Quantities and Qualities of the respective Goods, as was used and practifed before the making of the faid recited Act; and the faid Goods fhall be landed in the Prefence of the proper Officer appointed for that 'urpofe, other wife fuch Goods fhall be liable to the Payment of the like Duties as would be due and payable for the fame, at the Times of the Importation thereof, if the faid recited Act had not been made; and it fhall and may be lawful for any Officer of the Cultoms to top fuch Goods, and fecure the fame in his Majelty's. Warehoufe till fuch Duties are accordingly paid; and if the fame fhall not be paid within fix Months after the faid Goods are brought to fuch Warehouse, they fhall and may be fold, and the Produce thereof applied in the fame Manner as other Goods

Goods, which are brought to his Majefty's Storehoufes for Security of the Duties, may, by the Laws now in force, be fold and difpofed of; any Thing in the faid recited Act, or any other Act, to the contrary notwithstanding.

III. And be it further enacted by the Authority aforefaid, That fo much of an Act, made in the fifteenth and fixteenth Years of the Reign of his late Majefty King George the Second, intituled, An Act to empower the Importers or Proprietors of Rum or Spirits of the Britilh Sugar Plantations, to land the fame before Payment of the Duties of Excife charged thereon, and to lodge the Jame in Warehouses at their own Expence; and for the Relief of Ralph Barrow, in respect to the Duty on fome Rock Salt, loft by the overflowing of the Rivers Weaver and Dane; as relates to the landing of Rum or Spirits of the British Sugar Plantations, before Payment of the Duties of Excife, and to the lodging of the fame in Warehouses, at the Expence of the Importers or Proprietors thereof, which was to continue in force from the twenty-ninth Day of September one thousand seven hundred and forty-two, to the twenty-ninth Day of September one thoufand feven hundred and forty-nine, and from thence to the End of the then next Seffion of Parliament, and which, by several fubfequent Acts of the twenty-third and thirty firft Years of the Reign of his faid late Majefty, and the fourth and cleventh Years of the Reign of his prefent Majefty, was further continued until the twenty-ninth Day of September one thousand feven hundred and feventy-eight, and from thence to the End of the then next Seffion of Parliament, fhall be, and the fame is hereby further continued, from the Expiration thereof, until the twenty-ninth Day of September one thousand seven hundred and eighty-five, and from thence to the End of the then next Seffion of Parliament.

IV. And be it further enacted by the Authority aforefaid, That an Act, made in the feventh Year of the Reign of his prefent Majefty, intituled, An Act to difcontinue, for a limited Time, the Duties payable upon the Importation of Tallow, Hogs Lard, and Greofe, which was to be in force for three Years, from the twenty-fifth Day of March one thousand feven hundred and fixty-feven, and from thence to the End of the then next Seffion of Parliament; and which by feveral fubfequent Acts, of the tenth, thirteenth, and fixteenth Years of the Reign of his prefent Majefty, was further continued until the twenty-fifth Day of March one thousand feven hundred and feventy-nine, fhall be, and the fame is hereby further continued, from the Expiration thereof, until the twenty-fifth Day of March one thousand seven hundred and eighty-two.

V. And be it further enacted by the Authority aforefaid, That fo much of an Act, made in the tenth Year of the Reign of his prefent Majefty, as relates to the regulating the Fees of the Officers of the Cuf toms in America, and for extending the fame to the Naval Officers there, which was to be in force from the first Day of August one thousand feven hundred and feventy, for the Term of two Years, and from thence to the End of the then next Seffion of Parliament; and which was by two Acts, made in the twelfth and fourteenth Years of the Reign of his prefent Majefty, further continued until the first Day of August one thousand feven hundred and feventy-eight, and from thence to the End of the then next Seffion of Parliament, fhall be, and the fare is hereby further continued, from the Expiration thereof, until the first nued till Aug. I. Day of August one thousand seven hundred and eighty-two, and from thence to the End of the then next Seffion of Parliament.

VI. And be it further enacted by the Authority aforefaid, That fo much of an Act, made in the fixteenth Year of the Reign of his prefent Majefty, intituled, An Act for allowing the Exportation of certain Quantities of Wheat, and other Articles, to his Majesty's Sugar Colonies in America, and to the Island of Saint Helena, and to the other Settlemenes belonging to the United Company of Merchants of England trading to the East Indies; and of Bifcuit and Peafe to Newfoundland, Nova Scotia, Bay Chaleur, and Labrador; and for indemnifying all Perfons with refpect to advising or carrying into Execution his Majefty's Orders of Council already made for allowing the Exportation of heat and other Articles; as relates to allowing the Exportation of certain Quantities of Wheat, and other Articles, to his Majefty's Sugar Colonies in America, which was to continue in force until the first Day of January one thoufand feven hundred and feventy-feven; and which by two Acts, made in the feventeenth and eighteenth Years of the Reign of his prefent Majefty, was continued until the firft Day of May one thoufand seven hundred and feventy-nine, fhall be, and the fame is hereby nued till May 1 further continued, from the Expiration thereof, until the first Day of May one thoufand feven hundred and eighty.

VII. For encouraging the Exportation of Rum and Spirits of the Growth, Produce, and Manufacture, of the British Sugar Plantations in America, from this Kingdom, as Stores to be fent and confumed on board in any Voyage to Parts beyond the Seas;' be it enacted by the Authority aforefaid, That during the Term of two Years from and after the paffing of this Act, the fame Drawbacks and Allowances which are given by any former Act or Acts of Parliament how in force on the Exportation of fuch Rum to Parts beyond the Seas, as Merchandife, fhall be allowed and paid to the Merchant or Merchants, on his, her, or their fhipping any fuch Rum as Stores to be spent and confumed on board in any Voyage to Parts beyond the Seas; and when any Merchant or Merchants fhall be defirous of fhipping any fuch Rum as Stores, as aforefaid, and fhall give five. Days Notice thereof to the refpective Commiffioners of Excife, for the Time being, or to fuch other Perfon or Perfons as they fhall, from Time to Time, appoint for that Purpose, mentioning in fuch Notice the exact Deftination of the intended Voyage, the Tonnage of the Ship or Veffel, and the Number of the Mariners intended to be employed in navigating the fame, and alfo the Number of his Majefty's Troops that may hereafter be embarked in the fame; it thall and may be lawful to and for the faid Commiffioners of Excife, or the Perfon or Perfons fo to be appointed by them as aforefaid, to afcertain the Quantity of fuch Rum which fhall be fhipped on board fuch Ship or Veffel as Stores, and for which fuch Drawback and Allowance fhall be paid and made; and alfo the Size and Marks of the Cafk or Cafks in which fuch Spirits fhall be fo fhipped; and on Oath being made, before

one or more of the faid Commiffioners of Excife, or Juftices of the Peace for the County or Place from whence any fuch Rum is intended to be exported, or before fuch other Perfon or Perfons as fhall be authorifed as aforefaid by the faid Commiffioners of Excife for that Purpofe, that the fame are to be fhipped as Stores, to be spent and confumed in the Voyage, the Merchant or Merchants fhipping the fame fhall be paid the fame Drawbacks, and have the fame Allowances for Rum fo fhipped, as if fuch Rum had been exported as Merchandife: Provided always, That neither the faid Drawback or Allowance, or any other Drawback or Allowance, fhall be made or paid for any Quantity of fuch Rum which fhall be exported or be allowed for fhipped for Stores as aforefaid, in any Cafk which fhall contain lefs than one hundred Gallons; nor fhall. any Rum exany fuch Drawback or Allowance whatsoever be made or paid for any Quantity of Rum which shall be fo exported or shipped for Stores as aforefaid, on board of any Veffel or Veffels of lefs Burthen than one hundred Tons; but that all fuch Rum fhall be exported and fhipped, in all Refpects not otherwife directed by this prefent Act, under the fame Rules, Regulations, and Penalties, as are prefcribed by any former Act or Acts of Parliament now in force, relating to the Exportation of Spirits, drawn or made in Great Britain, as Stores to be spent and consumed aboard in any Voyage to Parts beyond the Seas.

CA P. XXIII.

An Act more effectually to enable the Prefident and Governors of the Hofpital or Infirmary at Bath, eftablifhed by an Act, paffed in the twelfth Year of the Reign of his late Majefty King GEORGE the Second, intituled, An Act for establishing and well-governing an Hofpital or Infirmary in the City of Bath, to take or acquire, and hold, any Lands, Tenements, or Hereditaments, or any Intereft in Lands, Tenements, or Hereditaments, and any Money or Perfonal Property, to be laid out in Lands, Tenements, or Hereditaments, pursuant to any Will, or otherwife, to the Amount limited in the faid Act.

An Act for charging the Lands within the North Level, Part of the Great Level of the Fens called Bedford
Level, and divers Lands adjoining thereto, in the Manor of Crowland, with further Taxes, for a limited
Time, for discharging the Debts incurred by the Commiffioners under an Act of the twenty-feventh Year
of King GEORGE the Second; and for better supporting and preferving the Drainage of the faid Lands..

An Act for granting to his Majefty additional Duties upon the Produce of the feveral
Duties under the Management of the refpective Commiffioners of the Customs and

E your Majefty's most dutiful and loyal Subjects, the Commons of Great Britain, in Parliament affembled, towards raifing, by the most easy Means, the neceflary Supplies to defray your Majefty's publick Expences, have freely and voluntarily refolved to give and grant unto your Majefty the feveral Subfidies and Duties herein-after mentioned; and do moft humbly befeech your Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That from and after the fifth Day of April one thousand feven hundred and feventy-nine, there fhall be raised, levied, collected, and paid, to and for the Ufe of his Majefty, his Heirs after the Rate and Succeffors, an additional Impoft or Duty, after the Rate of five Pounds per Centum upon the Produce of 5 per Cent. of and Amount of all the feveral Subfidies, Impofts, and other Duties, of what Kind or Nature foever they the former Dumay be, which are now due and payable to his Majefty, and are collected in this Kingdom under the ties, &e, Management and Direction of the refpective Commiffioners of the Customs in Great Britain, for and upon any Goods and Merchandifes imported into, or exported from, or carried coaftwife in, Great Britain; which said additional Impoft or Duty fhall be charged and paid upon the Amount of the faid former Subfidies, Impofts, and other Duties, after the ufual Discounts and other Allowances have been made and deducted therefrom, and fhall be wholly repaid and drawn back upon Exportation of the Goods, under the fame Rules, Regulations, Securities, Penalties, and Forfeitures, and in the fame Manner and Form in all Refpects as the prefent Duties of Customs are now charged, collected, paid, and drawn back, except as herein-after is provided.

II. Provided always, and it is hereby further enacted by the Authority aforefaid, That the faid Impoft Prize Goods or Duty herein before granted, fhall not be charged and paid for on Account of any Prize Goods ware- warehoused, &c. houfed in this Kingdom pursuant to two feveral Acts of Parliament, the one made in the eighteenth Year not liable. of his Majefty's Reign, and the other in this prefent Seffion, for granting Relief to the Captors of Prizes with refpect to bringing and landing certain Prize Goods in this Kingdom; nor for any other Goods which by any Act of Parliament now in force are permitted to be warehoufed in this Kingdom for Exportation, unless, and until, fuch Goods fhall be taken out of any Warchoufe wherein they are fo fecured, to be confumed or used in this Kingdom; and that the faid additional impoft or Duty fhall not be drawn. back or repaid upon the Exportation of any Goods, in any Cafe where no Drawback is allowed by Law.

III. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of en all excifeable April one thousand feven hundred and feventy-nine, there fhall be charged, levied, collected, and paid, Goods (except, to and for the Ufe of his Majefty, his Heirs and Succefiors, an additional Duty or Charge of five Pounds after the Rate of per Centum, upon the Produce and Amount of all the feveral Inland Duties, Rates, Impofitions, and Charges (except as herein-after is excepted), now payable to his Majefty, and which are charged and collected under the Management of the refpective Commiffioners of Excife in England and Scotland; which faid additional Duty or Charge of five Pounds per Centum hereby impofed, fhall and may, from Time to Time, be charged, raifed, received, levied, recovered, and fecured, by fuch Ways and Means, and under fuch Penalties and Forfeitures, and with fuch Power of adjudging and mitigating Penalties and Forfeitures, and fubject to fuch Allowances, Drawbacks, Rules, and Directions, as the feveral and respective Inland Duties, Rates, Impofitions, and Charges, on the Produce and Amount of which the faid additional Duty and Charge is hereby impofed, are or can, by any Statute now in force, be refpectively charged, raised, received, levied, collected, recovered, fecured, mitigated, or drawn back, as fully and effectually, to all Intents and Purposes, as if all and every the feveral refpective Powers, Authorities, Directions, Rules, Regulations, Methods, Penalties, Forfeitures, Powers of Mitigation, Claufes, Matters, and Things, were particularly repeated and again enacted in the Body of this prefent Act.

IV. Provided always, and it is hereby enacted by the Authority aforefaid, That nothing in this Act contained fhall extend, or be conftrued to extend, to charge with the faid additional Duty or Charge of five Pounds per Centum, the Produce or Amount of the Duty on Malt, Mum, Cyder, or Perry, continued and granted to his Majefty in and by an Act made in this prefent Seffion of Parliament, intituled, An At for continuing and granting to his Majefty certain Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year one thousand feven hundred and Seventy-nine; nor upon the Produce or Amount of the Duties arifing from and payable for any Beer, Sope, Tallow Candles, or Hides, brewed, made, tanned, tawed, or dreffed, within Great Britain; any Thing herein before contained to the contrary notwithstanding.

V. And be it further enacted by the Authority aforefaid, That, from and after the faid fifth Day of April one thoufand feven hundred and feventy-nine, there fhall be charged, raifed, levied, collected, and paid, to and for the Ufe of his Majefty, his Heirs and Succeffors, an additional Rate, Duty, and Impofition, of fifteen Pounds per Centum upon the Produce or Amount of the Duty payable on Malt, by an Act, made in the thirty-third Year of the Reign of his late Majefty King GEORGE the Second, intituled, An Act for granting to his Majefty feveral Duties upon Malt; and for raifing the Sum of eight Millions by way of Annuities, and a Lottery, to be charged on the faid Duties; and to prevent the fraudulent obtaining of Allowances in the gauging of Corn making into Malt; and for making forth Duplicates of Exchequer Bills, Tickets, Certificates, Receipts, Annuity Orders, and other Orders, loft, burnt, or otherwife deftroyed.

VÍ. And be it further enacted by the Authority aforefaid, That the additional Rate, Duty, and Impofition, of fifteen Pounds per Centum hereby granted, fhall be afcertained, fecured, raifed, collected, levied, recovered, and paid, in fuch and the like Form and Manner, and under fuch Management, and by the fame Ways, Means, and Methods, and with fuch and the like Allowances and Repayments, and Power of making Compofitions, proportionally and according to fuch Rules, Regulations, and Directions, and under fuch Penalties, Forfeitures, and Fines, with fuch Power of Recovery and Mitigation thereof, and other Powers, as are prefcribed, mentioned, or exprciled, for or concerning the afcertaining, compounding, fecuring, managing, railing, collecting, levying, recovering, paying, allowing, and repaying, the feveral and refpective Duties upon Malt within Great Britain, which were continued and granted to his Majefty, in and by the faid above-recited Act, made in this prefent Seffion of Parliament, or as are contained in any other Act or Acts of Parliament in and by the faid Act, made in this prefent Seffion, mentioned or referred unto, or any of them; and that all and every Article, Rule, Claufe, Matter, and Thing, in them, any or either of them, contained or thereby referred unto, fhall be in full Force and Effect, and be duly obferved, practifed, and put in Execution, for charging, afcertaining, compounding, fecuring, managing, railing, collecting, levying, recovering, paying, allowing, and repaying, the faid additional Rate, Duty, and Impofition, of fifteen Pounds per Centum hereby granted, and for levying, recovering, and mitigating, Fines, Penalties, and Forfeitures, and for doing all other Matters and Things, as fully and effectually, to all Intents and Purposes, as if the fame were fpecially repeated and re-enacted in the Body of this prefent Ac.

VII. And it is hereby enacted by the Authority aforefaid, That the faid additional Impofts and Duties by this Act granted, fhall, from Time to Time, be paid into the Hands of the Receiver General of the Cuftoms, and to the Cafhier of the Excife in England, refpectively for the Time being; and fuch Receiver General and Cafhier refpectively fhall weekly, to wit, on Wednesday in every Week, if it be not an Holiday, and if it be, then on the next Day after that is not an Holiday, anfwer and pay all the Monies arifing by the faid additional Impofts and Duties (the neceflary Charges of railing, collecting, and anfwering the fame, only excepted) into the Receipt of his Majefty's Exchequer, diftinct and apart from other Monies which fuch Receiver General and Cafhier refpectively fhall receive for the Ufe of his Majefty, nis Heirs and Succeflors, for the Ufes and Purposes in this Act mentioned.

VIII. And be it further enacted by the Authority aforefaid, That there shall be provided and kept, in the Office of the Auditor of the faid Receipt of Exchequer, a Book or Books, in which all the Monies ariling from the faid feveral Impofis and Duties, and paid into the faid, keceipt as aforefaid, thall be entered separate and apart from all other Monies paid and payable to his Majefty, his heirs and Succefiors, upon any Account whatfoever; and the faid Money fo paid into the laid Receipt of Exchequer, as aforefaid, thail, together with fuch other Rates, Duties, and Revenues, as fhall be granted by any Act or Acts of this Seffion

Seffion of Parliament for this Purpofe, be a Fund for the Payment of the feveral Annuities, and all fuch other Charges and Expences as are directed to be paid and payable pursuant to an Act of this prefent Seffion of Parliament, intituled, An Act for raising a certain Sum of Money by way of Annuities, and for establishing a Lottery.

An Act to continue and amend an Act, made in the eleventh Year of his present Majesty's
Reign, intituled, An At for the Encouragement of the White Herring Fishery.

Regulation of the faid Trade, and for preventing Frauds and Impolitions in the Management thereof, That, from and after the twenty-fecond Day of October one thousand feven hundred and feventy-one, a Bounty of thirty Shillings per Ton fhould be paid annually, in Manner as in the faid Act is provided for, to the Owner or Owners of all decked Veffels from twenty to eighty Tons Burthen, that fhould be fitted out and employed in the faid Fishery, in Manner, and under the Regulations mentioned in the faid Act, and that for the Space and Term of feven Years from and after the faid twenty-fecond Day of ⚫ October one thoufand feven hundred and feventy-one, and to the End of the then next enfuing Seffion of Parliament: And whereas the faid Fishery is of the greatest Importance to the Nation, by promoting • useful Industry, providing for great Numbers of poor People, and ferving as a Nursery for Seamen; but the fame cannot be carried on without the Aid of a Bounty, and as a Prolongation of the above-recited Act (which expires at the End of this prefent Seffion of Parliament) will be of great Advantage to the Publick; may it therefore pleafe your Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That the faid further contiAct, and all the Powers, Provifions, Claufes, and Penalties, therein contained (except as herein-after is excepted), fhall, from and after the Term therein mentioned, be, and the fame are hereby granted and continued for and during the further Term of feven Years, and from thence to the End of the then next Seffion of Parliament, and thall, during fuch additional Term, be in full Force, and be put in Execution, as fully and effectually, to all Intents and Purposes, as if the fame were again repeated and re-enacted in the Body of this prefent Act.

II. And whereas great Inconveniencies have arifen to the faid Fifhery, and to the Perfons employed Part of a Claufe therein, by reafon of Part of a Claufe in the faid Act, which enacts, That every Bufs or Veffel fhall in the faid Act proceed refpectively, manned, furnished, and accoutred (as therein mentioned), either to Tarmouth in repealed. the County of Norfolk, Whitehaven in the County of Cumberland, and Leith in the County of Edinburgh, Inverness in the County of Inverness, or to Braffey Sound in Shetland, Campbeltown or Oban in Argylefire, ог Kirkwall in Orkney, and be at the Rendezvous of the faid Fishery there on or before the twenty-fecond Day of June, and fhall not fhoot or wet their Nets before the twenty-fourth Day of the faid Month of June, and fhall continue fifhing to the twelfth Day of October; or fhall proceed to farmouth in the County of Norfolk, Whitehaven in the County of Cumberland, Leith in the County of Edinburgh, Inverness in the County of Inverness, or to Braffey Sound in Shetland, Campbeltown or Oban in Argylefhire, or Kirkwall in Orkney, and be at the Rendezvous of the faid Fisheries on or before the firft Day of October, and shall 'continue fishing until the eleventh Day of January following, unless they fhall have fooner completed their • Loading of Fish;' be it therefore enacted, That from and after the paffing of this prefent Act, that Part of the faid Claufe above recited fhall be, and the fame is hereby repealed.

III. And be it enacted by the Authority aforefaid, That every fuch Bufs or Veffel fhall, from and after the paffing of this prefent Act, proceed refpectively, manned, furnished, and accoutred, in Manner directed by the before-recited Act, either to Yarmouth in the County of Norfolk, Whitehaven in the County of Cumberland, Leith in the County of Edinburgh, Inverness in the County of Inverness, or to Braffey Sound in Shetland, Campbeltown or Oban in Argylefhire, Kirkwall in Orkney, Stranrawer in the County of Wigtown, or to Stornoway in the Island of Lewis and County of Refs, and fhall be at the Rendezvous of the faid Fishery there at any Time between the firft Day of August and the first Day of October, in each Year, and fhall continue fishing for the Space of three Months from the Day of their respective Departures from the faid Places of Rendezvous, unless they fhall have fooner completed their Loading of Fish; any Thing in the before-recited Act to the contrary notwithstanding.
