Domini one thousand seven hundred and fixty one, in the first year of the reign of our fovereign Lord GEORGE the Third, by the grace of GOD, of Great Britain, France, and Ireland, King, defender of the faith, &c. And from thence continued by feveral prorogations to the feventeenth day of December, one thousand feven hundred and fixty five, being the fifth feffion of the twelfth parliament of

Great Britain.

CAP. I.

An act to continue an act made in the last feffion of parliament, intituled, An act for importation of falted beef, pork, bacon, and butter, from Ireland, for a limited time.

WH

HEREAS an act of parliament paffed in the fifth year of Preamble, rethe reign of his prefent Majefty, intituled, An act for im- citing act 5 portation of falted beef, pork, bacon, and butter, from Ireland, Geo. 3. c. I. for a limited time; which was to continue in force for twelve months from the commencement thereof, is near expiring: and whereas the allowing the importation of falted beef, pork, bacon, and butter from Ireland, for a further time, may be of great advantage to both kingdoms; may it therefore please your Majefty that it may be enacted; and be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords spiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That the faid act, and The recited all and every the claufes, provifions, penalties, forfeitures, al- at further lowances, drawbacks, matters, and things therein contained, continued to 1 Feb. 1767. shall be further continued from the expiration thereof, until the first day of February, one thousand seven hundred and fixty seven, VOL. CAP. II.

An act for continuing and granting to his Majefty certain duties upon malt, mum, cyder, and perry, for the fervice of the year one thoufand feven hundred and fixty fix.

Preamble. Malt act of 1 George 3. further continued to 24 June, 1767. Malt in Scotland to pay 3 d. per bufhel. Mum 10 s. per barrel. Cyder and perry made for fale, 4 s. per hogfhead. How thefe duties are to be raised, &c. 20,000l. to be raifed in Scotland. Surplus to be added to the fisheries, &c. This act to relate to the fame day and time as the act 1 Geo. 3. did. Malt brought from Scotland by sea, to be entered at the port of landing : Brought by land, to be entered at Berwick or Carlife. Cyder for diftil ling not chargeable. Distiller to give notice to officer when he diftils cyder. Allowances for exportation of malt. 1 W. & M. On certificate of malt being exported, and fecurity, allowance to be paid. Penalty on relanding., Malt fteeping for exportation to be kept separate till measured. Malifters to give notice to officers, &c. Penalty on opening the locks, &c. Maliters, on 24 June, 1766, to clear out of their wai ehoufes all malt within fifteen months. And fo all future malfters. Claufes in act 12 Annæ, & 6 Geo 1. 5s per bufhel penalty on all corn steeping, or steeped for malt, which shall be found in the ciftern or couch, fo hard and compact as it could not be, unless the fame had been forced together to prevent the rifing. 100 l. penalty on fraudulently conveying from the cistern, any steeping of corn, and mixing the fame with other corn charged with the duty in the couch; or fraudulently conveying the faine away, so that no gauge of fuch corn can be taken in the couch. Penalties how to be recovered. Buyers of cyder or perry for their private ufe, not to be charged. Perfons felling less than 20 gallons to be deemed retailers. Claufe of loan at 31. per cent. Taliies of Joan to be ftruct, &c. Orders registered and paid in courfe. No fee for regittering, &c. Penalty for undue preference. No undue preference where tallies are dated or brought the fame day: nor if fubfequent orders be paid before fuch as were not demanded in courfe. Orders affignable. Commiffioners of the treafury impowered to prepare any number of exchequer bills of one common fum, or different fums, in the principal monies. Bills to bear intereft at 31 per cent. per ann. These bills to be numbered arithmetically. Treafury to direct the course of payment for loans or exchequer bills, and to appoint cheques. &c. The bills to be placed as cash in the exchequer, and to be ifluable thereout in common with other monies, and to be current in the revenue. Receivers to exchange bills for ready money. Tallies to be levied for bills lent into the exchequer. Intereft to continue till payment. Interest to cease whilft the bills are in the hands of receivers, &c Bills paid to receivers, &c. to be figned and dated. Intereft to be allowed to the faid days. The bills may be reiffued, both for principal and intereft. Receivers to keep a book. Bills filled up by indorfements, or defaced, to be exchanged. Bills not exceeding 5000l. each, to be made forth at the exchequer. Forging exchequer bills felony. How the monies arifing by this act thall be applied. Treafury on 29 Sept. 1767, to take an account of all monies raised and discharged. Unlatisfied monies to be paid out of the next aid, or out of the finking fund. Commiflioners to appoint perfons to pay off principal fums, which fhall from time to time be in courfe of payment upon exchequer bilis. Money, as brought in, to be paid to the paymasters. Bills to be registered in courfe. When intereft to cease. Payinafters liable to the controul of the treafury. Treasury to fettle falaries of clerks, &c and to contract with perfons to circulate bills, &c. Contractors not difabled from being members of parliament: May lower or raife the intereft with confent of treasury. Contractors how to be paid. No fee to be taken. No intereft for lefs than one penny. Charges to be paid out of the finking fund; to be replaced out of the first fupplies. Claufe of relief for bills loft or destroyed. Bills difcharged to be cancelled. Sinking fund appropriated to difcharge national debts incurred before 25 Dec.

CAP. III.

An act for allowing the importation of corn and grain, from bis Majefty's colonies in America, into this kingdom, for a limited time, free of duty.

WE

Preamble.

HEREAS the importation of oats and oatmeal into this kingdom, for a limited time, duty-free, would be an advantage to his Majefty's fubjects; may it therefore please your most excellent Majefty, that it may be enacted; and be it enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That it fhall and may be lawful to and for any of his Liberty given Majesty's subjects to import into Great Britain, in any fhip or to import oats veffel navigated according to law, at any time or times before or oatmeal, at the twenty ninth day of September, one thoufand feven hundred fore 29 Sept. and fixty fix; unless a fhorter term fhall be fixed for that pur- 1766, dutypofe by any act to be paffed in this feffion of parliament, any files afhorter quantity of oats or oatmeal, without the payment of any any fubfidy, custom, duty, or impofition whatsoever; any thing in any by any future former or other act or acts of parliament to the contrary thereof act of this in any wife notwithstanding.

to his Majefly's fubjects; be it therefore enacted by the King's most excellent majefty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this present parliament affembled, and by the authority of the same, That from and after the paffing of this act, no perfon or perfons whatfoever, at any time or times before the twenty fixth day of August, one thousand seven hundred and fixty fix, fhall directly or indirectly export, transport, carry, or convey, or caufe or procure to be exported, tranfported, carried or conveyed, out of or from the faid kingdoms of Great Britain or Ireland, or load or lay on board, or caufe or procure to be laden or laid on board, in any fhip or other veffel, or boat, in order to be exported or or Ireland, at carried out of the faid kingdoms of Great Britain or Ireland, any time before 26 Aug. any fort of corn, grain, malt, meal, flour, bread, bifcuit, or ftarch, under the penalties and forfeitures herein after mentioned; that is to fay, That all the faid commodities that shall be fo exported, shipped, or laid on board, or loaded to be exported, fhipped, or carried out, contrary to this act, shall be forfeited; and that every offender or offenders therein shall forfeit the fum of twenty fhillings for every bufhel of corn, grain, malt, meal, or flour; and twelve pence of lawful money of Great Britain for every pound weight of bread, bifcuit, or starch, and fo in proportion for any greater or lefs quantity, which fhall be fo exported, fhipped, or put on board to be exported; and alfo the hip, boat, or veffel, upon which any of the faid commodities fhall be exported, fhipped, or laden to be exported, and all her guns, tackle, apparel, and furniture, fhall be forfeited; and one moiety of all the faid penalties and forfeitures fhall the profecu- be to the King's majefty, his heirs, and fucceffors, and the other moiety to him or them that will fue for the fame; and for offences which thall be committed in that part of Great Britain called England, fuch penalties and forfeitures fhall be recovered by action of debt, bill, plaint, or information, in any of his Majefty's courts of record at Westminster, or before the juftices of affize, or at the great feflions in Wales, or by information at any general quarter feffions of the peace for the county, city, riding, divifion, or place, where the offence fhall be committed and in fuch fuit, no effain, protection, privilege, or wager of law, shall be allowed; and for offences which fhall be committed in that part of Great Britain called Scotland, by action or fummary bill, or information, in the courts of feffion or exchequer in Scotland; and for offences which shall be committed in Ireland, in his Majefty's courts of record in Dublin, or at the general quarter feflions of the peace for the county, city, or place, where the offence fhall be committed; and that the mafter and the mafter and mariners of any fuch fhip, boat, or veffel, wherein any fuch offence fhall be committed, knowing fuch offence, and witbeing privy to, tingly and willingly aiding and affifting thereunto, and being and aiding thereof duly convicted in any fuch courts as aforefaid, fhall therein, to be committed for be imprifoned for the space of three months, without bail or three months, mainprize.
