vifions of the faid A&, any Sum or Sums of Money which fhall have Company
been advanced or difburfed by the faid Company in the East Indies for
His Majefty's Navy, or any Public Services; and it fhall alfo be
lawful for the faid Company to pay any Sum or Sums of Money on
account of or in Repayment of Sums of Money advanced under the
faid Act, into the Receipt of His Majefty's Exchequer, at any time
after the Firit Day of January in the Year One thoufand eight hun-
dred and twelve, any thing in the faid Act to the contrary notwith-
flanding; and all Sums fo advanced or difbursed in the Eaft Indies as
aforefaid, which fhall be allowed by the faid Commiffioners of the
Treafufy to be carried to the Credit of the faid Company, and all
Sums paid into the Receipt of His Majesty's Exchequer after the
faid First Day of January One thoufand eight hundred and twelve,
in Repayment of Sums advanced under the faid Act, fhall be received
at the Exchequer, and go in Difcharge of any Balance which fhall
remain unpaid of Sums fo advanced as aforefaid; and it shall be lawful
for the faid Commiffioners of the Treafury to iffue and apply the fame
to fuch Services as fhall then have been voted by the United King-
dom of Great Britain and Ireland in this prefent Seffion of Parlia-
ment, and all fuch Payments fhall go in Difcharge of the Amount fo
repaid of any Bonds given by the faid Company for Repayment of
Advances under the faid Act, any thing in the faid recited Act to the
contrary notwithstanding.

An Act to repeal an Act paffed in the Thirty ninth and Fortieth
Year of His prefent Majefty, for eftablishing certain Regu-
lations in the Offices of the Houfe of Commons, and to
establish other and further Regulations in the faid Offices.
[28th February 1812.]

HEREAS an A& was paffed in a Seffion of Parliament,

feat Majefty, intituled An Á& for establishing certain Regulations in 39 & 40 G.S. the Offices of the House of Commons: And whereas the Provifions c.92. repealed of the faid Act are in feveral refpects defective, and in others require to be varied and amended; and it is therefore expedient to repeal the faid A&t, and to make other and further Provisions in lieu thereof; Be it therefore enacted by the King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, the faid Act fhall be and the fame is hereby repealed.

II. And whereas by Letters Patent under the Great Seal of Letters Patent, * Great Britain, bearing Date at Welminfer the Third Day of June 3 June, 8 G. 3. in the Eighth Year of the Reign of His prefent Majefty, the Office of Clerk of the Houfe of Commons, with an Annuity of Ten Pounds, and all other Rewards, Dues, Rights, Profits, Commodities, Advantages and Emoluments whatsoever to the said Office, after what manner foever, or howfoever, then or theretofore anciently appertaining, incident, accuftomed or belonging, was granted to John Hatfell Esquire, for and during his natural Life:

And whereas alfo by certain other Letters Patent, bearing Date at 4 July, 37 G-352 G&o. III.

Weftminfter the Fourth Day of July in the Thirty feventh Year of the Reign of His prefent Majefty, the faid Office was granted to John Ley Efquire, for and during his natural Life, to take Effect from and after the Decease of the faid John Hatfell, in as full, ample • and beneficial a manner as the fame had been granted to the faid John Hatfell as aforefaid: And whereas John Clementfon Efquire was, on the Seventh Day of January laft, appointed by His Roya Highness the Prince Regent of the United Kingdom, in the Name and on the Behalf of His Majefty, to be the Serjeant at Arm attending upon the Speaker of the Houfe of Commons, during the Sitting of Parliament: And whereas it is expedient, that, afte the Interests now vefted in the said Perfons refpectively shall expire, ' a different Diftribution fhould be made of the Salaries, Fees and • Emoluments belonging to the faid Officers refpectively, and that Regulations fhould be eftablished in relation to the Salaries and • Emoluments of the faid Officers, and other Officers of the Houfe ' of Commons;' Be it therefore enacted, That the Speaker of the House of Commons for the time being, and the Secretary or Secre taries of State, the Chancellor of the Exchequer, the Mafter of the Rolls, and the Attorney and Solicitor General for the time being (they and each of them being alfo Members of the House of Commons) thall be and they are hereby nominated, conftituted and appointed Commiffioners for the Purposes of this Act; and any Three of the faid Commiffioners (whereof the Speaker of the Houfe of Commons for the time being shall be one) fhall be and they are hereby authorized to carry this A&t into Execution.

III. And be it further enacted, That from and after the Expiration of the said Letters Patent, fo granted to the faid John Hatfell and John Ley, and of the Appointment of the faid John Clementfon as aforefaid, all Salaries, Fees, Perquifites and Emoluments, which would have been due and payable to any future Clerk or Clerk Affiftants of the House of Commons, or Serjeant at Arms attending the Speaker of the Houfe of Commons for the time being, in cafe this A&t had not been made, fhall from time to time, as the faid Commiffioners fhall direct, be paid into the Hands of the faid Commilfioners, or of fuch Perfon or Perfons as they fhall by Warrant under their Hands and Seals appoint to collect the fame, and fhall by the faid Commiffioners be applied and diftributed in the manner hereinafter directed.

IV. Provided always, and be it further enacted, That nothing fioners may act. herein contained fhall be taken or conftrued to prevent the faid Commiffioners, upon the Expiration either of the faid Letters Patent, granted to the faid John Hatfell and John Ley Efquires, or of the faid Appointment of the faid John Clementfon Efquire, which ever may first happen, from carrying the Purpofes of this Act into Execution, as far as the Nature of the refpective cafes will admit; and provided alfo, that the faid John Clementfon, fo long as he fhall continue to hold the faid Office of Serjeant at Arms, fhall hold the fame under the like Regulations as the fame was holden by his immediate Prede

• V. And whereas the Offices of Serjeant at Arms attending the
Speaker of the Houfe of Commons during the Sitting of Parlia-
ment, and of Housekeeper of the Houfe of Commons,
and for a long time palt have been holden conjointly by the fame

Perfon, and the Salaries, Wages, Fees and Emoluments appertaining to the Offices fo holden, have been hitherto brought to account ⚫ conjointly under the A&t hereby repealed;' Be it therefore enacted, That after the Expiration of the prefent Intereft of the faid John Office of Houfe Clementfon, fo appointed Serjeant at Arms as aforefaid, the Office keeper confoliof Houfekeeper of the Houfe of Commons (hall henceforth be holden of Serjeant at by the Perfon who fhall be appointed to the Office of Serjeant at Arms. Arms attending upon the Speaker of the House of Commons; and the Salary, Fees and Emoluments heretofore usually paid to the Housekeeper, fhall be paid into the Hands of the faid Commiffioners, or the Perlon or Perfons fo appointed by them as aforefaid, and be accounted for to the faid Commiffioners, and applied by them together with and in like manner as all the Salaries, Fees, Perquifites and Emoluments are by this Act directed to be paid and applied.

VI. And be it further enacted, That the Perfon or Perfons fo to Duty of Colbe appointed by the faid Commiffioners to collect and receive the Sa- lector of Fees. laries, Fees, Perquifites and Emoluments, fhall give fuch Security as fhall be required by the faid Commiffioners, for the faithful Execution of such Trust, and duly to account, from time to time, as often as he or they fhall be required fo to do by the faid Commiffioners, for all Sums of Money which fhall come to his or their Hands as fach Collector or Collectors as aforefaid; and he or they shall render fuch Account of Monies fo received as aforefaid, together with an Account of all the Sums due and payable to the faid Clerk, Clerk Affiftants, Serjeant at Arms, and Deputy Serjeant at Arms refpectively, in Right of their refpective Offices, who are hereby feverally required to certify fuch Accounts under their Hands refpectively; and every Account of Monies received by the Collector or Collectors faall be verified by him or them upon Ŏath as to the State thereof, and all Particulars relating thereto; which Oath any one of the faid Commiffioners is hereby authorized to adminifter; and fuch Collector or Collectors fhall from time to time, as fhall be fixed or prefcribed by the faid Commiffioners for that Purpose, pay into the Bank of England, in the Name and to the Account of the faid Commiffioners, all Sums of Money which fhall have come to or be in his or their Hands as fuch Collector or Collectors as aforefaid, and fuch Account fhall be called The Account of the Commiffioners for regu lating the Offices of the Houfe of Commons,' and the Name of the Speaker of the Houfe of Commons for the time being shall be inserted therein; and it fhall be lawful for the faid Commiffioners to order the Monies fo placed to their Account as aforefaid, or any Part thereof, to be paid and applied, from time to time, in making Payments under and for the Purposes of this A&t.

VII. And be it further enacted, That the faid Commiffioners fhall, and they are hereby directed to pay to the Clerk of the Houfe of Commons for the time being, the net annual Sum of Three thoufand Pounds, for and during the firft Five Years which the faid Clerk of the Houle of Commons hall hold his faid Office, and from and after the faid Term of Five Years to pay to fuch Clerk of the Houfe of Com- mons. mons, the further net Sum of Five hundred Pounds annually, making together the Sum of Three thousand five hundred Pounds; and to pay to the Clerk Affiftant for the time being the net annual Sum of Two thoufand Pounds, for and during the firit Five Years which the faid Clerk Affiftant fhall hold his faid Office, and from aud after

the Expiration of the faid Term of Five Years, the further net annual Sum of Five hundred Pounds, making together the Sum of Two thousand five hundred Pounds; and alfo to pay to the Second Clerk Affiftant for the time being, the net annual Sum of One thoufand five hundred Pounds, for and during the first Five Years which the faid Second Clerk Affiftant shall hold his faid Office, and from and after the Expiration of the faid Term of Five Years, the further net annual Sum of Five hundred Pounds, making together the Sum of Two thousand Pounds; which feveral annual Sums the faid Commiffioners are hereby authorized to pay by Half-yearly Payments or otherwife as they fhall think fit; and which Sums fo paid by the faid Commiffioners to the Clerk and Clerk Affiftant and Second Clerk Affiftant of the Houfe of Commons refpectively, fhall be taken and accepted by them refpectively, in full Satisfaction and Discharge of all Salaries, Fees, Perquifites and Emoluments, to which they might or could have been entitled, or which they may have been accustomed respectively to receive by virtue or in refpect of their faid refpective Offices, previous to the paffing of this Act, any former Practice or Ufage to the contrary notwithstanding: Provided always, that nothing herein contained fhall apply to or prevent the demanding, receiving and taking the Fees which may arife from the Examination of the Sufficiency of the Sureties who enter into Recognizances to profecute Election Petitions, or for taxing the Cofts and Expences of profecuting and oppofing any fuch Petitions; which Fees are eltablished and afcertained under and by virtue of an Act of Parliament paffed in the Twenty eighth Year of His prefent Majefty, for the further Regulation of the Trials of controverted Elections or Returns of Members to ferve in Parliament.

VIII. Provided always, and be it further enacted, That the Number of Years more than Five Years which any Clerk Affiftant or Second Clerk Affiftant for the time being, who fhall be appointed to the Office of Clerk of the Houfe of Commons after the Expiration of the Letters Patent aforefaid, fhall have held the Office of Clerk Affiftant or Second Clerk Affiftant, fhall be reckoned as Part or the Whole, as the cafe may be, of the Five Years by this Act required to entitle the Clerk of the Houfe of Commons to have and receive the full Salary or Sum of Three thousand five hundred Pounds; and fhall entitle fuch Clerk Affiftant or Second Clerk Affistant so appointed to the Office of Clerk of the Houfe of Commons, to the full Sum of Three thousand five hundred Pounds per Annum; and in like manner if any Second Clerk Afliftant who fhall have ferved more than Five Years as fuch, fhall be appointed to the Office of Clerk Affiftant, he fhall be entitled thereupon to the full Sum of Two thoufand five hundred Pounds per Annum.

IX. And be it further enacted, That it shall be lawful for the faid Commiffioners, and they are hereby authorized and directed, from and after the Expiration of the Interest of the faid John Clementfor in the faid Office of Serjeant at Arms, to pay to the Serjeant at Arms attending the Speaker of the Houfe of Commons, during the Sitting of Parliament for the time being, the net annual Sum of Two thoufand Pounds, which faid Sum of Two thousand Pounds fhall be taken and accepted by the faid Serjeant at Arms for the time being in full Satisfaction and Discharge of all the Salaries, Fees, Perquifites and Emoluments, to which any former Serjeant at Arms might or could

have been entitled, or which he might have been accustomed to receive by virtue or in refpect of his faid Office previous to the paffing of this Act, and also of the Office of Houfekeeper of the Houfe of Commons hereinbefore mentioned, any former Practice or Ufage to the contrary notwithstanding: Save and except the Allowance of Three hundred Pounds a Year, now ufually paid to fuch Serjeant at Arms, in lieu of a Refidence for the faid Serjeant at Arms, fo at tending the Speaker as aforefaid, until fome fuitable and convenient Refidence in the Vicinity of the Houfe of Commons shall be provided as heretofore for fuch Serjeant at Arms as aforefaid; and which Sum fhall be paid as heretofore by the Lords Commiffioners of His Majefty's Treasury, and be receivable by the Serjeant at Arms in addition to fuch Salary as aforefaid, upon the Condition of his applying the fame towards providing himself with a Refidence in the Vicinity of the Houfe of Commons as aforefaid.

X. And be it further enacted, That it shall be lawful for the Com- Allowance to miffioners, and they are hereby directed, to pay to the Deputy Ser- Deputy Serjeant jeant at Arms, an Allowance of Eight hundred Pounds; which faid at Arms. Sum of Eight hundred Pounds fhall be in lieu of all other Allowances, Fees and Emoluments, to which any former Deputy Serjeant at Arms might have been entitled, or which he might have been accuftomed to receive by virtue or in refpect of his faid Office, previous to the paffing of this Act, any former Practice or Ulage to the contrary notwithstanding: Save and except an Allowance of Two hundred Pounds a Year, in lieu of a Refidence for the faid Deputy Serjeant at Arms, until fome fuitable and convenient Refidence, in the Vicinity of the Houfe of Commons, fhall be provided as heretofore (which faid Sum fhall be paid to him in like manner, and under the like Conditions, as the Allowance before-mentioned to the Serjeant at Arms); and alfo except fuch Caption Fees as, upon an Account thereof to be rendered to the Commiffioners, fhall be allowed by them; which Allowance, in lieu of fuch Refidence and Caption Fees as aforefaid, fhall and may be received by fuch Deputy Serjeant at Arms in addition to fuch Salary as aforefaid.

XI And be it further enacted, That it fhall be lawful for the faid Commiffioners Commiffioners, and they are hereby directed, to pay the Collector or to pay Collector, Collectors and other Perfons employed by them in the Execution of &c. and Clerks. this Act, fuch Salaries or Allowances as fhall appear to them to be juft and reafonable; and it fhall alfo be lawful for the faid Commiffoners, from time to time, to pay and allow to the Clerks in the Office of the Clerk of the Houfe of Commons, fuch Sums and Allowances as may be juft and proper, according to the Rules and Ufages heretofore, or which may hereafter be established, or in use, for regulating fuch Allowances; which Payments and Allowances hall be deemed and taken to be in lieu of all Payments for the like Services heretofore made upon Addrefs of the Houfe of Commons or

otherwife.

XII. And be it further enacted, That the faid Commiffioners fhall Account laid beand they are hereby authorized and required to prepare and lay before fore Parliament. the Houfe of Commons, within Twenty Sitting Days after the Commencement of every Seffion of Parliament, a Statement fhewing the Amount of the Money remaining on their Account at the Bank, or collected under their Order, purfuant to the Provifions and for the Purposes of this Act, after the making of all fuch Payments as are
