CXCII. And be it further enacted, That every Clerk of the Peace in Ireland fhall within One Calendar Month after any fuch Conviction fhall have been returned to his Office, furnish to the next Diftributor of Stamps, or to fome Distributor of Stamps in and for the County in which fuch Conviction shall have been made, a Copy of fuch Conviction figned by himfelf, for which he shall receive from fuch Diftributor the Sum of One Shilling and no more; and every fuch Diftributor fhall forthwith tranfmit fuch Copy fo figned to the faid Commiffioners of Stamps at their Head Office in Dublin; and if any fuch Clerk of the Peace or Diftributor fhall neglect or omit fo to do refpectively, he or she fhall, for every fuch Offence, forfeit the Sum of Five Pounds.

CXCIII. And be it further enacted, That fuch Part, Share and Proportion as fhall be payable to His Majefty, his Heirs and Suecellors, of, from or out of any Penalty, Forfeiture or Fine payable or recoverable under this Act, or any Amendment thereof, or under any Act or Acts which fhall in any wife relate to the Payment or Regulation of any Stamp Duties in Ireland, and the Fines payable by Diftributors as aforefaid, fhall unless otherwife particularly directed, within One Calendar Month after the fame fhall be levied or received, be paid by the Juftice of the Peace or other Perfon by whom the fame fhall have been fo levied or received, to the Receiver General of Stamp Duties, if the fame fhall have been fo levied in the County of Dublin, or County of the City of Dublin, and if in any other Part of Ireland, then to fome Diftributor of Stamps refident in the County where the Offence was committed, and if any fuch Juftice of the Peace or other Perfon fhall neglect or omit fo to pay over the fame, he thall, for every fuch Offence, forfeit the Sum of Twenty Pounds.

CXCIV. Provided always, and be it enacted, That if different Proceedings fhall be had or taken against the fame Perfon for the fame Offence, in the feveral Modes authorized by this Act, fuch Perfon shall nevertheless be liable only to One Penalty, the Right to which fhall depend on the Priority of the Proceedings for Recovery of the fame; and if any Queftion fhall arife concerning the Priority of fuch Proceedings, then and in fuch cafe the Proceeding under which the Party complained of fhall have been first duly ferved with Summons or other Procefs, which shall be afterwards proceeded on without Delay by the Party informing or profecuting, fhall be cou fidered as entitled to, and fhall have Priority over any other Proceeding for the fame Offence, and fhall accordingly veft the Right to the Penalty duly fought thereby: Provided nevertheless, that if the Perfon against whom any fuch Proceedings fhall be taken, fhall be an Attorney of any of the fuperior Courts in Dublin, then the Service of Notice of a Declaration filed fhall for the Purposes aforefaid be of the fame Effect as the Service of Summons or Procefs as aforefaid.

CXCV. And be it further enacted, That if any Juftice of the refufing to act. Peace, Magiftrate or Peace Officer, in Ireland, fhall neglect or refute in any Inftance to carry into Execution this Act, or any Act or Acts which is or fhall be in force in Ireland, relating in any wife to the Payment or Regulation of any Stamp Duty or Duties, or any of the Provifions thereof, upon a proper Application made to him, fuch Juftice of the Peace, Magiftrate or Peace Officer, fhall forfeit the Sum of Forty Pounds for every fuch Neglect or Refufal

CXCVI. And

CXCVI. And be it further enacted, That it fhall and may be Juftices may lawful for the faid Commiffioners of Stamp Duties, by Order and mitigate Penalunder the Directions of the Commiffioners for executing the Office of ties under Order Lord High Treafurer of Ireland, to mitigate any Fine, Penalty or of Treafury. Forfeiture which fhall be incurred by any Diftributor of Stamps as aforefaid, or which fhall at any time be impofed under the Authority of any Juftice of the Peace under this Act, or under any Act or Acts which fhall from time to time be in force in Ireland relating in any wife to the Payment or Regulation of any Stamp Duty or Duties in Ireland, fo far as concerns the Proportion of fuch Fine, Penalty or Forfeiture impofed by fuch Juftice of Peace, payable to His Majefty, his Heirs or Succeffors; any thing in this or any other A&t or Acts to the contrary notwithstanding.

CXCVII. And be it further enacted, That this Act, and the Commencement feveral Claufes, Provifions and Regulations therein contained, fhall of Act. commence and take Effect from and after the Expiration of Three Calendar Months next after the paffing thereof, and not sooner.

CAP. CXXVII.

An Act to prohibit, until the First Day of November One thoufand eight hundred and twelve, the making of Starch, Hair Powder and Blue, from Wheat and other Articles of Food; and for fufpending Part of the Duties now payable on the Importation into Great Britain of Starch. [18th July 1812.]

THEREAS it is expedient that the making of Starch from

Wheat or any other Article or Thing used for the Food of Man, fhould be prohibited for a limited time:' May it therefore pleafe Your Majefty that it may be enacted; and be it enacted by the King's Mott Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, during the Continuance of this Act, no Starch, Hair Powder No Starch, &c. or Blue, fhall be made or prepared from any Wheat, Barley, Rice, made from Potatoes, Flour, Meal or any other Article or Thing ufed for the Wheat, &c. Food of Man, or any Mixture with Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing used for the Food of

Man.

II. And be it further enacted, That if, during the Continuance Making Starch of this Act, any Maker or Makers of Starch, or other Perfon or from Wheat, &c. Perfons whatever, fhall make or begin to make Starch, Hair Powder or Blue from any Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing ufed for the Food of Man, or any Mixture with Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing ufed for the Food of Man, or fhall put or lay, or caufe or procure to be put or laid in any Vat, Trough or other Utenfil or Veffel, any Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing used for the Food of Man, or any Mixture with Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing used for the Food of Man, for the Purpose of making Starch, Hair Powder or Blue, then and in each and every fuch cafe fuch Maker or Makers of Starch, Hair Powder or Blue, or other Perfon or Perfons fo offending, and the Person or Perfons in whole Cuftody or Poffeffion any Vat, Trough or other Utenfil or Zz2 Veffel

Veffel which shall be made ufe of contrary to the Intention of this Act fhall be found, fhall feverally and refpectively (over and above all other Penalties impofed by any Act or Acts of Parliament already in force) forfeit the Sum of Two hundred Pounds; and all fuch Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing ufed for the Food of Man, together with every fuch Vat, Trough or other Utenfil or Veffel fhall be forfeited, and the fame refpectively fhall and may be feized by any Officer or Officers of Excife Provided always, neverthelefs, that nothing in this A&t contained fhall extend, or be deemed or conftrued to extend to fubject any Starch Maker to the faid Penalty of Two hundred Pounds, for or by reafon of his completing or finishing any Operation of Starch making from any Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing ufed for the Food of Man, openly put in Fermentation in his entered Starch House, on or before the Tenth Day of July One thousand eight hundred and twelve, so that fuch Operation fball be continued without wilful Delay; any thing in this A&t contained to the contrary in any wife notwithstanding.

III. And be it further enacted, That if any Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing used for the Food of Man, fhall, during the Continuance of this Act, be found in any Starch Houfe, or in any Place wherein Starch fhall be preparing or making, or wherein any Starch shall have been prepared or made, or which fhall have been or fhall be entered for making or preparing of Starch, all fuch Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing ufcd for the Food of Man respectively fhall be forfeited, together with the Veffels, Sacks, Bags and other Things containing the fame, and the fame fhall and may be feized by any Officer or Officers of Excife, and the Perfon or Persons in whofe Poffeffion or Occupation fuch Starch Houfe or Place thall be, fhall, for every fuch Offence refpectively, forfeit the Sum of Two hundred Pounds.

IV. And be it further enacted, That, during the Continuance of this Act, it shall and may be lawful to and for any Perfon or Perfons who fhall be authorized for that Purpose by the Commiffioners of Excife for the time being, or any Two or more of them, within the Limits of the Chief Office of Excife in London, by One or more Juftice or Juftices of the Peace in any other Part of Great Britain, at any time or times with any Officer or Officers of Excife, or for any Officer or Officers of Excife to enter into any Starch House or any other Place whatever, wherein any Starch, Hair Powder or Blue, fhall be or fhall be fufpected to be preparing or making or prepared or made; and every fuch Officer of Excife and Perfon fo authorized as aforefaid fhall have free Admittance into, and may infpect all the Materials, Veffels and Utenfils contained in any fuck Starch House or other Place (giving thereby as little Interruption as may be to the lawful Bufinefs which fhall be there carrying on), and in cafe any fuch Officer of Excife fhall have reafon to fufpect that any Wheat, Barley, Rice, Potatoes, Flour, Meal or any other Article or Thing used for of Preparations the Food of Man is mixed in any Waters or Liquids, or with any other Materials or Preparations whatfoever, or is othewife in Operation for preparing or making Starch, Hair Powder or Blue, it fhall be lawful for fuch Officer at any time or times during the Continuance of this Act, upon Payment of Three pence per Pound

Weight (if demanded) to take a Sample not exceeding Fifty Pounds Weight of any fuch Mixtures in Waters or Liquids or other Materials or Preparations which fhall be found in any fuch Starch House or other Place aforefaid; and in cafe any Maker of Starch, Hair Powder or Blue, or the Owner or Occupier of any fuch Starch House or Place, or any Workman or Servant belonging to any fuch Maker or Makers, or Owner or Occupier, fhall refufe to admit fuch Perfon Refufing. or Perfons as shall be fo authorized, or any Officer or Officers of Excife into any fuch Starch Houfe or Place, or fhall obftruct or hinder any fuch Officer or Perfon or Perfons in making fuch Infpection as aforefaid, or fhall not allow any fuch Officer to take fuch Sample after the faid Sum of Three pence per Pound Weight shall be paid or tendered for the fame, every fuch Maker, Owner or Occupier fhall, for every fuch Offence refpectively, forfeit the Sum of Two Penalty. hundred Pounds; and it fhall be lawful for any fuch Officer of Excife or other Perfon or Perfons authorized as aforefaid, having a Warrant for that Purpose from any Two or more of the Commiffioners of Excife, or any Justice or Juftices refpectively as aforefaid, to seize, Seizures made take and carry away all fuch Wheat, Barley, Rice, Potatoes, Flour, of Wheat, &c. Meal or any other Article or Thing used for the Food of Man, and alfo all fuch Mixtures or Waters or Liquids, or other Materials or Preparations as fhall be found in any fuch Starch Houfe or other Place, together with all the Veffels, Sacks, Bags and other Things in which the faid Commodities or any of them fhall be contained. V. Provided always, and be it further enacted, That it fhall and be lawful for any Maker or Makers of Starch, Hair Powder or Starch, &c. not to Blue, to have or keep for his, her or their neceffary Ufe, in any Dwelling Houfe, Room or Place, (not being an entered Houfe, wheat, &c. in Eight Buthels of Room or Place for making or preparing of Starch) any Quantity of Poffeffion. Wheat, Barley, Rice, Grain, Potatoes, Flour or Meal, not exceeding at any one time the Quantity of Eight Bushels of Wheat, Barley, Rice, Grain, Potatoes, Flour and Meal; and that if any fuch Maker or Makers fhall, during the Continuance of this A&t, be poffeffed of or have in his, her or their Cuftody or Poffeffion, or in the Cuftody or Poffeffion of any Perfon or Perfons in Truft or for the Ufe or Benefit of fuch Maker, more than Eight Bushels of Wheat, Barley, Rice, Grain, Potatoes, Flour or Meal, at any one time, in any one or more Place or Places, every fuch Maker or Makers fhall, for every fuch Offence, refpectively forfeit all fuch Wheat, Barley, Penalty. Rice, Grain, Potatoes, Flour and Meal, exceeding the faid Quantity of Eight Bufhels, and alfo the Sum of Five Pounds for every Bufhel fo forfeited: Provided always, nevertheless, that this Act fhall not Provifo for extend to inflict the faid laft mentioned Forfeiture or Penalty or either of them, upon any Maker of Starch who fhall be the actual Grower of Wheat, Barley or other Grain, and fhall be poffeffed of any Quantity of fuch Wheat, Barley or other Grain in the Straw grown by him, or after fuch Wheat, Barley or other Graie is threthed out or feparated from the Straw, provided that fuch Wheat, Barley or other Grain fhall not be kept in his Poffeffion or in the Poffeffion of any other Perfon or Perfons in Truft for him, for a greater Space of time than Twenty Days after the fame fhall be threshed or separated from the Straw, and fo as fuch Wheat, Barley or other Grain be not kept in any Place ufed for making, preparing or keeping Starch: Provided alfo, that this Act fhall not extend to Provifo.

fhall on being required by the proper Officer or Officers of Excife fo to do, immediately wrap all fuch Starch in Papers of the Colours or one of them hereinafter mentioned and no other, each fuch Paper containing not lefs than Four Pounds Weight nor more than Seven Pounds Weight of Starch, and alfo tie up every fuch Wrapper, where the Ends of the Paper containing fuch Starch fhall be folded, and alfo ftrongly affix or pafte with warm Pafte made from Glue, on the Outfide of every fuch Wrapper, after the fame fhall be fo tied, a Label of very thin Paper Three Inches long and Three Inches broad at the leaft, and of a different Colour from the Paper in which the Starch fhall be wrapped; that is to fay, if fuch Starch fhall be wrapped in blue or brown Paper the said Label fhall be with white, and if fuch Starch fhall be wrapped in white Paper fuch Label fhall be blue, and fhall alfo affix and pafte every fuch Label on the Foldings of both Ends of the Paper enclosing such a Quantity of Starch, and in fuch a manner as to prevent the opening of the faid Paper containing fuch Starch without tearing fuch Label; and the proper Officer or Officers of Excife fhall attend to fee fuch Starch papered and tied in manner aforefaid, and fuch Label affixed and pasted on every fuch Paper containing fuch Starch; and fuch Officer or Officers fhall caufe every fuch Label affixed and pafled on every fuch Paper containing Starch to be ftamped or fealed with fuch Stamp or Seal as fhall be provided by the Commiffioners' of Excife in England and Not complying Scotland refpectively for that Purpose; and if any fuch Importer or with Regulations. Importers, Proprietor or Proprietors, or Confignee or Confignees of Starch imported or brought into this Kingdom fhall neglect or refufe fo to remove any fuch Starch, or to depofit the fame as aforesaid, or to wrap any fuch Starch in Paper as aforefaid, or to tie up any fuch Paper as aforefaid, or to affix or paste any such Label as aforefaid, all and every fuch Importer or Importers, Proprietor or Proprietors, or Confignee or Confignees fo offending, shall, for every fuch Offence, forfeit the Sum of One hundred Pounds.

XII. And be it further enacted, That the Commiffioners of Excile or the major Part of them in England and Scotland refpectively fhall provide proper Stamps or Seals for the stamping or fealing the Labels affixed or pafted on Paper containing all Starch which fhall be imported or brought into this Kingdom and prepared in pursuance of on Importation. this Act, and fhall caufe fuch Stamps or Seals to be diftributed to the proper Officers of Excife for the Purpofe before mentioned, which Officers are hereby enjoined and required, in using the fame, to do no Hurt or Damage or the leaft Hurt or Damage that may be, to the Starch or to the Paper wherein the fame shall be fo wrapped; which Stamps or Seals fhall and may be varied, altered or renewed from time to time as the faid Commiffioners of Excife refpectively or the major Part of them refpectively fhall think fit.

Forging Stamp or Seals.

XIII. And be it further enacted, That if any Perfon or Perfons fhall at any time forge or counterfeit any Stamp or Seal to refemble any Stamp or Seal which fhall be provided in pursuance of this Act for ftamping or fealing Starch imported, or fhall counterfeit or relemble the Impreffion of the fame upon any Paper containing any Starch, thereby to defraud His Majefty, his Heirs or Succeffors, of any of the Duties upon Starch, then every Perfon fo offending being thereof convicted in due Form of Law fhall be adjudged a Felon, and shall be tranfported for any Term not exceeding Seven Years; and if any
