VI. And that no perfon or perfons fhall at any time hereafter be impeached, molefted or troubled in or for misprision of treason, for any offence or offences made treason by this act, other than fuch as by this act are before before declared to be in cafe of mifprifion of high treason.

VII. And be it further enacted by the authority aforesaid, That if any perfon or perfons fhall at any time after the faid first day of July bring into this realm of England, or any the dominions of the fame, any token or tokens, thing or things, called or named by the name of agnus dei, or any croffes, pictures, beads or fuch like vain and fuperftitious things, from the bishop or fee of Rome, or from any perfon or persons authorized or claiming authority by or from the said bishop or fee of Rome, to confecrate or hallow the fame; (which faid agnus dei is used to be specially hallowed and confecrated, as it is termed, by the faid bishop in his own person, and the said croffes, pictures, beads and fuch like fuperftitious things been alfo hallowed either by the fame bishop, or by others having power or pretending to have power for the fame by or from him or his faid fee; and divers pardons, immunities and exemptions granted by the authority of the faid fee to fuch as fhall receive and ufe the fame:) (2) and that if the fame perfon or perfons fo bringing in, as is aforefaid, fuch agnus dei and other like things as have been before specified, fhall deliver, or cause or offer to be delivered the fame, or any of them, to any subject of this realm, or of any the dominions of the fame, to be worn or ufed in any wife: (3) that then as well the fame person and perfons fo doing, as alfo all and every other person or persons which fhall receive and take the fame, to the intent to use or wear the fame, being thereof lawfully convicted and attainted by the order of the common laws of this realm, fhall incur the dangers, penalties, pains and forfeitures ordained and provided by the statute of pramunire and provision made in the fixteenth year of the reign of King Richard the Second.

VIII. Provided nevertheless, and be it further enacted by the authority aforefaid, That if any person or perfons, to whom any fuch agnus dei or other the things aforefaid fhall be tendred and offered to be delivered, fhall apprehend the party fo offering the fame, and bring him to the next juftice of peace of that fhire where fuch tender fhall be made, if he shall be of power and able fo to do, or for lack of fuch ability, fhall within the fpace of three days next after fuch offer made as is aforefaid, disclose the name and names of fuch perfon or perfons as fo fhall make the fame offer, and the dwelling-places, or place of refort of the fame perfon or persons (which he shall endeavour himself to know by all the ways and means he can) to the ordinary of that diocefe, or to any juftice of peace of that shire where fuch perfon or perfons to whom fuch offer fhall be made, as is aforefaid, thall be refiant: (2) and alfo if fuch Delivering an agnus dei to perfon or perfons to whom fuch offer fhall be made, fhall happen the ordinary, to receive any fuch agnus dei or other thing above-remembred,

IX. And be it further enacted by the authority aforefaid, A pardon to That all and every person and perfons, which at any time them that fince the beginning of the first year of the Queen's majesty's fhall bring in reign that now is, have brought or caused to be brought into thofe bulls this realm any fuch bulls, writings or inftruments of recon- which before ciliation only as are above-mentioned, and now have any of they received. the fame bulls, writings or inftruments in his or their hands or cuftody, and fhall and do within the space of three months next after the end of any feffion or diffolution of this present parliament, bring and deliver all fuch bulls, writings and inftruments which they or any of them now have in his or their cuftody, to the bishop of the diocefe where fuch absolution hath been given and received, to the intent that the fame bulls, writings or inftruments may be cancelled and defaced, and shall openly and publickly before fuch bishop confefs and acknowledge his or their offence therein, and humbly defire to be received, restored and admitted to the church of England, fhall ftand and be clearly pardoned and discharged of all and every offence and offences done or committed in any matter or cause concerning any of the faid bulls, writings or inftruments, for or touching fuch abfolution or reconciliation only. XI. Provided also, and be it further enacted by the authority bleman by his aforefaid, That if any nobleman, being nobleman, being a peer of this realm, shall at any time hereafter happen to be indicted for any the offence or offences aforefaid, that then every fuch nobleman and peer of this realm fhall have his trial by his peers, as in cafes of high treason and misprifion of treason hath heretofore been accustomed or used:

Saving to all and every perfon and perfons, bodies politick and corporate, their heirs and fucceffors, and the heirs and fucceffors of every of them, other than the faid offenders and their heirs claiming only as heir or heirs to any fuch offenders, and fuch perfon and perfons as claim to any their uses, (2) all fuch rights, titles, interefts, poffeffions, leafes, rents, reverfions, remainders, offices, fees and all other profits, commodities and hereditaments, as they or any of them shall have at the day of the committing of fuch offence or offences, or at any time before, in as large and ample manner to all intents and purposes, as if this act had never been had nor made; any thing herein contained to the contrary thereof notwithstanding. 23 El. c. CAP. III.

If any born within this realm, or made free denizen, hath departed or fhall depart the realm without the Queen's licence under the great or privy feal, and fhall not return again within fix months after warning by proclamation, he shall forfeit to the Queen the profits of all his lands during his life, and alfo all his goods and chattels. The like penalty he fhall fuftain, which having licence shall not return within fix months after his licence expired. The offender shall have reftitution upon fubmiflion. Fraudulent affurances made by fugitives of their lands and goods to deceive the Queen, fhall be void. EXP. 5 R. 2. ftat. 1. c. 1. 12 R. z. c. 8. 14 El. c. 6.

CAP. IV.

An act to make the lands, tenements, goods and chattels of tellers, receivers, &c. liable to the payment of their debts. OR the better fecurity of the Queen's majesty, her heirs and fucceffors, against such as shall have the receipt and charge of the money and treasure of her Highness, her heirs and fucceffors, (2) be it declared and enacted by the Queen's liable for the majefty, with the affent of the lords fpiritual and temporal, and payment of the commons, in this prefent parliament affembled, and by the the Queen's authority of the fame, That all lands, tenements, profits, comdebts by them modities and hereditaments, (3) which any treasurer or receiver not paid, &c. her heirs or fucceffors, treasurer for the wars, treasurer of any fort, town or castle, where any garrison is or shall be kept, treafurer of the admiralty or navy, treasurer, undertreasurer or other perfon accomptable to the Queen's majefty, her heirs or fucceffors, for any office or charge of or within the mint, treafurer or receiver of any fums of money impreft, or otherwife, for the use of the Queen's majesty, her heirs or fucceffors, or for provifions of victual, or for fortifications, buildings or works, or for any other provifions to be used in any the offices of the Queen's majesty's ordnance and artillery, armory, wardrobe, tenths and pavilions, or revels, customer, collector, farmer of customs, fubfidies, impofts or other duties within any port of the realm, collector of the tenths of the clergy, collector of any fubfidy or fifteen, receiver general of the revenues of any county or counties, anfwerable in the receipt of the exchequer, or in the court of wards and liveries, or the duchy of Lancaster, clerk of the hamper, (4) now hath, or at any time hereafter fhall have, within the time whilft he or they or any of them shall remain accountable; (5) fhall for the payment and fatis- 2 Mod. 247. faction unto the Queen's majesty, her heirs and fucceffors, of his or their arrearages, at any time hereafter to be lawfully, ac, cording to the laws of this realm, adjudged and determined upon his or their account (all his due and reasonable petitions being allowed) be liable to the payment thereof, (6) and be put and had in execution, for the payment of fuch arrearages or debts to be fo adjudged and determined upon any fuch treasurer, receiver, teller, customer, collector, farmer, officer or accountant, as is before-named, (7) in like and in as large and beneficial manner to all intents and purposes, as if the fame treasurer, receiver, teller, customer, farmer or collector, upon whom any fuch arrearages or debts fhall be fo adjudged or determined, had the day he became first officer or accountant stood bound by writing obligatory, having the effect of a statute of the staple, to her Majefty, her heirs or fucceffors, for the true anfwering and payment of the fame arrearages or debts.
