to supply the defect in the defendant's proof; for that was pleaded specifically to the residue, after deducting the sums named in the other pleas. The defendant had singled out the sum of 107. 3s. in his first plea, as part of the plaintiff's demand, and he was bound to prove it. It was laid down in Com. Dig. Pleader, (E. 1.) that if the plea did not answer to every part Gurney shewed cause, and contended that of the declaration it was a discontinuance to the plaintiff's claim being completely covered the whole; as in trespass for cutting down by the proof given by the defendant, the latter 300 trees, if the defendant should plead, quoad was entitled to the verdict. too in Marks v. Lahee, 5 D. P. C., recently

sum to discharge a lien set up by the defen-
dant, the latter rejoining that the sum was guf-
ficient, the Court of Common Pleas held that
the amount was the material issue, notwith-
standing the videlicet. But here the amount
mentioned in the plea of set off was not laid
under a videlicet, and the defendant was not
therefore relieved from proving it, for it was
evidently material. It was clearly decided
now, that when a sum claimed had been proved
to have been paid before action brought, but

failing that, the plaintiff was entitled to a ver-
dict for the sum not proved, and the present
rule must be absolute.

Busby, contrà, urged that the plaintiff was entitled to a verdict; for if the defendant had not appeared at the trial, he would have been entitled to a verdict for the 107. 3s., and the 81. 3s. 6d. without the production of any evidence, even although his particulars claimed a sum short of that amount by 27. If he had pleaded nunquam indebitatus, the sums proved under each plea might have been taken together to cover the plaintiff's demand, under the authority of Cousins v. Paddon; but there was no such plea on the record, and therefore that case was distinguishable from the present. The money paid into Court could not be used

particulars only claiming 201. 15., the defen-
dant pleaded to the sum of 22, 15s., and
proved a set off to the amount of 20l. 15s.,
that in fact, he proved the liquidation of the
whole of the plaintiff's demand, but he left
27. unaccounted for, which by the record he
admitted to be due. The question simply was,
how the verdict ought to be entered, and the
case of Cousins v. Paddon, was referred to,
when the matter was very fully considered.
That was an action for goods sold and deliver-
ed, work and labour, and on an account stated,
and the defendant pleaded nunquam indebi-
tatus, payment of 3381., parcel of the amount
claimed; and a set off as to a further sum of

his pleas have the verdict entered entirely for Thursday.. The Friday Court, in the case cited, said that the verdict Saturday must be entered on the plea of payment, so Monday far as related to 3147. 3s., for the defendant; on the plea of set-off, so far as related to 217. for the defendant; and on nunquam indebitatus Tuesday as to the whole sum demanded, except 3357. 3s. for the defendant; and the consequence would be, that the defendant would have judgment on the whole record. There, however, the Court noticed that the difference between the sum alleged and that proved was covered Thursday by another plea. Here, there was no such other plea, and it must be inquired whether there was any equivalent to it on the record. It must be taken that 107. 3s. was an admitted demand on the record; there it was said that Wednesday the excess of proof on one plea might be Thursday transferred to supply what was deficient on another; so that a portion of the into Court under the third plea, might be Saturday money paid Friday applied to supply the defect of proot on the plea of set off. But that could not be done Monday here. The plea of payment besides must be taken independently of the two former pleas. and there was no issue therefore as to the original existence of the debt. The replication also, by which the money was accepted, referred only to the residue of the amount of the plaintiff's claim, and the residue was therefore exclusive of the 21. As that sum was part of a material allegation, therefore, which had not been proved, judgment could not be entered up for it for the defendant. Cases must be decided not only secundum probata, but also secundum allegata et probatu; and, although the Court regretted it exceedingly, as it was contrary to the justice of the case, the Tuesday verdict must be entered for the plaintiff, for Thursday 21., by which he would be entitled to the general judgment, and the general costs of the
