II. And be it further enacted by the authority aforefaid, Claufes in That the feveral claufes contained in an act made in the eighth 8 Geo. 1. c.15. year of the reign of his late Majefty, (intituled, An act for encouragement of the filk manufactures of this kingdom; and for taking off feveral duties on merchandizes exported; and for reducing the duty upon beaver-skins, pepper, mace, cloves, and nutmegs, imported; and for importation of all firs of the product of the British plantations into this kingdom only; and that the two corporations of affurance, on any fuits brought on their policies, fhall be liable only to fingle damages and cofts of fuit) relating to the encouragement of the filk manufactures of this kingdom, and for taking off feveval duties on merchandizes exported, which were to continue in force for three years, from the twenty fifth day of March, one thousand seven hundred and twenty two, and from thence to the end of the then next feflion of parliament; and which faid claufes were, by an act made in the eleventh year of his faid Geo.1.c.29. late Majefty's reign, continued from the expiration thereof for three years, and from thence to the end of the then next feffion of parliament; and by another act made in the fecond year of his pre- 2Geo.2. c.28. fent Majesty's reign, were further continued from the expiration thereof until the twenty ninth day of September, one thousand seven hundred and thirty four, and from thence to the end of the then next feffion of parliament; and which, by another act made in the eighth year of his prefent Majefty's reign, were further continued 8Geo.2. c.18. until the twenty fifth day of March, one thousand seven hundred and forty two, and from thence to the end of the then next session of parliament; and which, by an act made in the fifteenth of the reign of his prefent Majefty, were further continued until the first day of fune, one thoufand feven hundred and forty feven, and from thence to the end of the then next feffion of parliament; fhall be, and the fame are hereby continued from June, 1754. the expiration thereof until the faid first day of June, one thou- Farther contiand feven hundred and fifty four, and from thence to the end nued by 26 of the then next feffion of parliament.

III. IV. And whereas by two feveral acts of parliament made and paffed in the eighth and ninth years of the reign of her late majesty Queen Anne, certain rates and duties, to be under the management of the commiffioners for the ftamp duties, were charged and directed to be levied or continued, for or in refpect of monies given, paid, or contracted for, with clerks, apprentices, or fervants, to be paid at fuch times, and in fuch manner, and under fuch penalties, as in and by the faid feveral acts are respectively mentioned, expressed, and provided: and whereas by an act made and paffed in the eighteenth year of the reign of his prefent Majefty, intituled, An act for 18Geo.2.c.22. granting to his Majefty the fum of eight hundred thousand pounds out of the finking fund, and for granting a fum remaining in the exchequer, arifen by the furplus of the duties upon malt, mum, cyder, and perry, for the service of the year one thousand feven hundred and forty five; and for the further appropriating the fupplies granted in this feffion of parliament; and for giving further time for the payment of duties omitted to be paid for the indentures or contracts of clerks and apprentices; and for the further enforcing the payment of the faid duties; after taking notice of the faid two former acts, and that feveral perfons had, through negligence or inadvertency, omitted to pay the feveral rates and duties payable in that behalf; and to have the indentures or contracts ftamped within the times, for thofe purposes refpectively limited by the faid acts, whereby fuch clerks, apprentices, or fervants, and their masters or miftreffes refpectively, had incurred, and might be fubject to Jeveral penalties, forfeitures, and disabilitus, it is therefore enacted, That upon payment of the feveral rates an duties fo omitted or neglected to be paid as aforesaid, on or before the first day of Auguft, one thousand feven hundred and forty five, eni tendering to be ftamped fuch indentures or contracts fo omitted to Stamped at the fame time, or at any time before the twenty ninth day of September, one thousand seven hundred and forty five,the fam indentures or contracts should be good and available in law and equity, and might be given in evidence; and the clerks, apprentices, or fer vants therein named, should be capable of following and exercising their respective intended trades and employments, as fully as if the rates and duties fo omitted, had been duly paid within the refpeche times in the faid former acts limited and appointed, and the person who had incurred any penalties by the omiffions aforefaid, upon pay. ment of fuch rates and duties as aforefaid, within the time there before limited, were thereby acquitted and discharged from the fa penalties: and it was thereby further enacted, That after the twe ty fourth day of June, one thousand feven hundred and forty f if any master or mistress should neglect to pay the faid rates and t ties for clerks, apprentices, or fervants, within the refpective time. in and by the former acts limited and appointed in that behalf, actr ing to the true intent and meaning of the fame; every fuch mailo

and miflress should, for every such neglect, forfeit and pay double the rates and duties charged and directed to be paid and levied by the faid former acts, or either of them (over and above all penalties and forfeitures thereby inflicted) for all monies which should, at any time or times, after the faid twenty fourth day of June, one thousand Seven hundred and forty five, be given, paid, contracted, or agreed for, with, or in relation to every fuch clerk, apprentice, or fervant, to be recovered, paid, and applied, in fuch manner as is therein mentioned and it was thereby further enacted, That if any master or miftrefs of any fuch clerk, apprentice, or fervant refpectively, should neglect to pay the faid rates and duties fo charged by the faid former afts, or either of them, within the respective times therein limited in that behalf, whereby the penalties and forfeitures incurred by the faid aft of the eighteenth year of his prefent Majefty, would become charged upon, and be payable by them refpectively; and any fuch clerk, apprentice, or fervant refpectively, fhould in that cafe pay or caufe to be paid the rates and duties charged by the faid former acts, or either of them, and also the penalties and forfeitures inflicted and incurred by the faid act of the eighteenth year of his prefent Majefty, at any time within one year after the fame fhould fo refpectively become charged, incurred, and made payable by virtue of the fame act, as aforefaid (fuch mafters or mistreffes not having then paid the faid rates, duties, penalties, and forfeitures refpectively, although required by fuch clerk, apprentice, or fervant fo to do) then, and in fuch cafe, it should and might be lawful to and for any fuch clerk, apprentice, or fervant, within three months after fuch payment of the faid rates, duties, penalties, and forfeitures refpectively by him, her, or them as aforesaid, to demand of his or her mafter or mistress, or bis, ber, or their executors or adminiftrators, fuch fum or fums of money, as was or were paid to fuch master or mistress, for or in refpect of fuch clerkship, apprenticeship, or fervitude; and in cafe fuch fum or fums of money fhould not be paid within three months after fuch demand thereof made, it should and might be lawful to and for fuch clerk, apprentice, or fervant, to fue for and recover the fame, with full costs of fuit, against fuch master or mistress, his, her, or their executors or adminiftrators, by action of debt, bill, plaint, or information, in any of his Majesty's courts of record at Weftminster, wherein no effoin, protection, wager at law, or more than one imparlance, fhould be allowed; and every fuch clerk, apprentice, or servant, should and might, immediately after payment of fuch rates, duties, penalties, and forfeitures as aforefaid, be dif charged from his, her, or their clerkship, apprenticeship, and fervice refpectively, and from all actions, penalties, forfeitures, and damages, for not ferving the time for which he, she, or they were reSpectively bound, contracted for, or agreed to ferve fuch mafter or miftrefs refpectively and it was thereby further enacted and declared, That every fuch clerk, apprentice, or fervant, fhould avail him or herfelf, and have fuch and the fame benefit and advantage of the time he or she should refpectively have continued with, and ferved fuch mafter or mistress respectively, as he or she could or might have done, in cafe of any affignment or turning over to any new or other

year of the reign of his prefent Majefty, unto the perfon or perfons to whom the fame ought to be paid pursuant to the fame act, and shall tender to be stamped fuch indentures or contracts fo omitted to be stamped, at the fame time, or at any time before the twenty fifth day of December, one thousand feven hundred and forty feven; then, and in such case, the same indentures and contracts fhall be good and available in law and equity, and may be given in evidence in any court whatsoever; and the clerks, apprentices, or fervants therein named, fhall be capable of following and exercising their refpective intended trades or employments, as fully as if the rates and duties fo omitted, had been duly paid within the refpective times in the faid former acts, or either of them, limited and appointed; and all and every perfon and perfons, who fhall have incurred any penalties by the omiffions aforefaid, upon payment of fuch double rates and duties as aforefaid, within the time before limited, are hereby acquitted and difcharged from the faid penalties; any double duties thing in the faid two former acts, or either of them, contained to the contrary notwithstanding.

V. VI. And it is hereby further enacted, That if any mafter or Apprentices, miftrefs thall, by reafon of any fuch neglect as aforefaid, be- &c. paying come liable to forfeit and pay fuch double rates and duties as duties forfeitaforefaid, and any fuch clerk, apprentice, or fervant refpectively, ed by their fhall and do, at any time after fuch forfeiture incurred, either malters, &c. in the presence of one or more credible witness or witnesses, or by writing under the hand of such clerk, apprentice, or fervant refpectively, figned in the prefence of one or more credible witnefs or witneffes, require his or her master or mistress refpectively to pay the faid double rates or duties fo incurred as aforefaid, and fuch mafter or mistress fhall not, within three months after fuch requeft, pay the fame, and any fuch clerk, apprentice, or fervant fhall, at any time within two years after the determination of his clerkship, apprenticeship, or fervitude, pay the faid double rates and duties fo forfeited and incurred, and not paid by his or her mafter or mistress respectively as aforefaid, then, and in fuch cafe, it fhall and may be lawful to and for any fuch clerk, apprentice, or fervant, within three months after fuch payment of the faid double rates and duties by him, her, or them, as aforefaid, to demand of his or her mafter or to be reimmistress, or his, her, or their executors or administrators, double buried double the fum or fums of money, or other confideration refpectively the fum paid given, paid, and agreed, or contracted to be paid to fuch mafter in respect of fuch apprenor mistress, for or in refpect of fuch clerkship, apprenticeship, ticeship, &c. or fervitude; and in cafe fuch fum or fums of money fhall not be paid within three months after fuch demand thereof made, it fhall and may be lawful to and for any fuch clerk, apprentice,

or fervant, to fue for and recover the fame, with full cofts of with costs; fuit, against fuch mafter or miftrefs, his, her, or their executors or adminiftrators, by action of debt, bill, plaint, or information, in any of his Majesty's courts of record at Westminster, wherein no effoin, protection, or wager of law, or more than one imparlance, fhall be allowed; and every fuch clerk, appren- and be dif tice, or fervant, fo paying fuch double rates or duties as afore- charged from faid, fhall and may, immediately after payment thereof refpec- their apprentively, and upon fignifying, by writing under his or her hand, ticeship,if they that he or the defires to be difcharged from his, her, or their require it; clerkship, apprenticeship, and fervice refpectively, fhall be accordingly discharged from the fame refpectively, and from all actions, penalties, forfeitures, and damages, for not ferving the time for which he, fhe, or they were refpectively bound,
