faid Charlotte countess of Newburgh, for and on the behalf of the Jaid James Clement Radcliffe, her fecond fon, and the faid lady Charlotte Radcliffe, lady Barbara Radcliffe, and lady Mary Radcliffe, hath most humbly implored your Majefty to extend your royal grace and favour to them, humbly reprefenting, That if no relief should be granted to them, they will be deftitute of all manner of provision after the death of the faid countess of Newburgh; and the faid James Bartholomew Radcliffe is confenting, That all the right, title, and intereft, which he or his issue male hath or can have, to the manors, lands, tenements, and hereditaments, comprized in the fettlement of the faid twenty fourth day of June, one thousand feven hundred and twelve, shall be extinguished by authority of parliament, and that the abfolute feefimple, and inheritance of the faid premiffes, fhall be fo vefted in the faid royal hofpital at Greenwich, and their fucceffors, for ever: and whereas your Majesty has been graciously pleased to fignify to your parliament, That your Majefty was willing and defirous, and gave your confent, that the parliament might make whatever difpofition and fettlement they should think fit of the intereft your Majefty hath or may have in the faid eftates, fo as the fame be for the use and benefit of the royal hofpital at Greenwich, with the allowance which shall be thought proper to be made thereout for the relief of the children of the faid Charles Radcliffe: wherefore your Majefty's faithful commons in parliament affembled, do humbly beseech your Majesty that it may be enacted; and be it enacted by the King's inoft excellent Majesty, by and with the advice and confent of the lords fpiritual and temporal, and commons, in this prefent parliament affembled, and by the authority of the fame, That all hereindefcrib- the faid barony, manor, or lordship of Langley, with the rights, ed, divested members, and appurtenances thereof, in the county of Northumberland; and alfo all thofe the faid manors of Whittingstall alias Quittingfall, and Newlands, Dilfton, alias Develfton, Aydon Shields, Warke, Elrington, and Meldon, and every of them, with their and every of their rights, members, and appurtenances in the faid county of Northumberland; and all thofe the faid manors or reputed manors of Spindlefton, Utchefter, Throckley, Coastley, Middleton Hall, Eaft Thornton, alias Thornton Eaft, Weftwood, and Thornborough, and every of them, with their and every of their rights, members, and appurtenances in the faid county of Northumberland; and alfo all that the advowfon of the faid church of Symondburne, with the appurtenances in the faid county of Northumberland; and alfo all those the said manors or reputed manors of Caftlerigg and Derwentwater alias Kefwick and Thornthwaite, with their and every of their rights, members, and appurtenances in the county of Cumberland; and alfo all that the faid manor of Seremerton, with the rights, members, and appurtenances in the county palatine of Durham; and alfo all and fingular the meffuages, granges, farms, lands, meadows, paftures, feedings, woods, underwoods, tenements, and hereditaments whatsoever, late the eftate of the faid James late earl of Derwentwater, or whereof he was feifed of any eftate of inheritance in poffeffion, reverfion, remainder, or expectancy, fitu

ate, lying, and being in the said counties of Northumberland and Cumberland, county palatine of Durham, and every of them, with their appurtenances, which, by the said recited indentures of leafe and release of the twenty third and twenty fourth days of June, one thousand feven hundred and twelve, were fettled, limited, and affured to the uses in the faid indenture of release of the twenty fourth day of June, one thousand seven hundred and twelve, mentioned; and the reverfion and reverfions, remainder and remainders, rents, iffues, and profits of all and fingular the fame premiffes, fhall, from and immediately after the death of the faid Charles Radcliffe, be and be deemed to be, and to have been divested out of his Majefty, his heirs and fucceffors, and fettled upon, and vefted in, and the fame are hereby from thenceforth fettled upon and vested in the most noble Charles duke of Richmond and Lenox, and the right honourable Henry Fox efquire, their heirs and affigns, freed, acquitted, and abfolutely discharged of, from, and against all and every the uses, and vefted in eftates, and limitations, in and by the faid indenture of release or the duke of fettlement, bearing date the faid twenty fourth day of June, Richmond one thousand seven hundred and twelve, limited and created of and the right and concerning the fame, to and for the first and other fons of honourable the faid Charles Radcliffe, and the iffue male of fuch firft and Henry Fox efother fons, and freed and abfolutely difcharged of and from all term of 500 quire, for the fuch right, title, eftate, intereft, claim, and demand, as was years. vested in his Majefty, his heirs and fucceffors, by virtue of the feveral attainders herein before-mentioned, or of the faid feveral acts of parliament herein before-recited, or any of them, and alfo freed and abfolutely difcharged of and from all fuch right, title, estate, intereft, claim, and demand, as is vefted, or that might or could accrue or belong to his Majesty, his heirs or fucceffors, by reafon or means of the faid James Bartholomew Radcliffe, and James Clement Radcliffe, or either of them, having been born out of the dominions of the crown of Great Britain, or otherwife how foever, fave as herein after is faved; to the ufe of them the faid Charles duke of Richmond and Lenox, and Henry Fox, their executors, adminiftrators, and affigns, for and during, and unto the full end and term of five hundred years, to be computed from the day of the death of the faid Charles Radcliffe, and from thence next enfuing, and fully to be compleat and ended, without impeachment of wafte; and from and after and after the the end, expiration, or other determination of the faid term, expiration of then to and for the only proper ufe and behoof of the right the faid term, honourable Archibald Hamilton efquire, commonly called lord in the comArchibald Hamilton, Charles Smith efquire, James Gunman efquire, Greenwich Sir John Thompson knight, Sir James Creed knight, Peter Burrell Hospital. efquire, William Fawkener efquire, William Baxter efquire, Edward Vernon efquire, Thomas Ripley efquire, doctor David Cockburn, James Spilman efquire, William Allix efquire, Fitzwilliam Plumptre efquire, William Young efquire, and captain Francis Danfays, being fixteen of the commiffioners, or governors and directors of the faid royal hospital for feamen at Greenwich, their

heirs and affigns for ever; in trust nevertheless for themselves and the rest of the commiffioners, or governors and directors for the time being of the faid royal hofpital, for the uses and purposes following; (that is to fay) In the first place, for and towards the finishing and completing the building of the faid royal hofpital; and after the building of the fame fhall be completed and finished, for and towards the fupport of the faid royal hospital, for the better maintenance of the feamen of the faid hofpital, worn out and become decrepit in the service of their country.

Certain lands II. And it is further enacted by the authority aforefaid, That divefted out of all that the faid manor and lordship of Alftone alias Aldftone Moore, his Majesty, and Garrigill, and all and every the rights, members, and appurtenances thereunto belonging, in the faid county of Cumberland; and all thofe the faid two parts (the whole into three parts to be divided) of the faid manor and lordship of NewtonHall, in the faid county of Northumberland; and all that the faid moiety or one half part of the faid village or township of Buteland, in the faid parish of Chollerton and county of Northumberland; and all those the faid rectories and parfonages of Kirke Whelpington, Harburne alias Hartburne, and Midford, in the faid county of Northumberland; and all and fingular the meffuages, tythes, farms, lands, tenements, and hereditaments whatsoever, fituate, lying, and being in the faid county of Northumberland, which by the faid recited indentures of leafe and release of the twenty third and twenty fourth days of March, one thousand fix hundred and ninety one, were fettled, limited, and assured to the uses in the faid indenture of release of the twenty fourth day of March, one thoufand fix hundred and ninety one, mentioned, and which, by virtue of the several attainders herein before-mentioned, and of the faid recited acts of parliament, or fome of them, do now remain vested in his Majesty, his heirs and fucceffors, fubject to fuch appropriation for the rents and profits thereof for the ufe and benefit of the faid royal hofpital at Greenwich, as aforefaid; and the reverfion and reverfions, remainder and remainders, rents, iffues, and profits of all and fingular the said laft-mentioned premiffes, thall from henceforth be divested out of his Majefty, his heirs and fucceffors, and the fame fhall be, and fhall be deemed to be, and they are accordingly, from henceforth, fettled upon, and vested in the faid and vefted in Archibald Hamilton, Charles Smith, James Gunman, Sir John certain of the Thompson, Sir James Creed, Peter Burrell, William Fawkener, for Greenwich William Baxter, Edward Vernon, Thomas Ripley, David CockHospital in burn, James Spilman, William Allix, Fitzwilliam Plumptre, Wiltruft. liam Young, and Francis Danfays, their heirs and affigns, to the use of them, their heirs and affigns for ever, in trust neverthelefs for themselves and the rest of the commiffioners, or governors and directors for the time being of the faid royal hofpital, for and towards finishing and completing the building of the faid royal hofpital; and after the building of the fame fhall be compleated and finished, for and towards the fupport of the faid roy

al hofpital for the better maintenance of the feamen of the faid hofpital, worn out and become decrepit in the service of their country, freed and abfolutely difcharged of and from all fuch right, title, eftate, intereft, claim, and demand, as was vefted in his Majefty, his heirs and fucceffors, by virtue of the several attainders herein before-mentioned, or of the faid feveral acts of parliament herein before recited, or any of them, or otherwise howfoever, and freed and abfolutely difcharged of and from all fuch right, title, eftate, intereft, claim, or demand, as any other perfon or perfons whatsoever hath or have, or may or can have, in or to the faid laft-mentioned manors, meffuages, lands, tenements, and hereditaments, or in or to any part or parcel thereof, upon any account how foever, fave as herein after is mentioned.

III. And it is hereby enacted, That the faid, Archibald Hamilton, Charles Smith, James Gunman, Sir John Thompson, Sir to hold the James Creed, Peter Burrell, William Fawkener, William Baxter, faid manors, Edward Vernon, Thomas Ripley, David Cockburn, James Spilman &c. in truft, William Allix, Fitzwilliam Plumptre, William Young, and Francis Danfays, their heirs and affigns, fhall, in trust as aforesaid, but fubject to the faid term of five hundred years (as to the premiffes comprized in the faid fettlement of the twenty fourth day of June, one thousand seven hundred and twelve, and as the fame is herein before created and limited) hold and enjoy all and fingular the manors, lands, tenements, and hereditaments, comprized in the faid fettlements of the twenty fourth day of March, one thoufand fix hundred and ninety one, and the twenty fourth day of June, one thoufand feven hundred and twelve, and which are herein before vested or mentioned to be vefted in them the faid Archibald Hamilton, Charles Smith, James Gunman, Sir John Thompson, Sir James Creed, Peter Burrell, William Fawkener, William Baxter, Edward Vernon, Thomas Ripley, David Cockburn, James Spilman, William Allix, Fitzwilliam Plumptre, William Young, and Francis Danfays; and the same thall be and be deemed to be held of the King's majefty, his heirs and fucceffors, as of his Majefty's manor of East Greenwich in the county of Kent, by free and common foccage tenure; but nevertheless the faid manors, lands, tenements, and here- fubject to ditaments shall be and fhall be deemed to be fubject to fuch quit rents, quit-rents, crown-rents, and dutchy-rents iffuing thereout refpectively, as the fame were respectively liable to on the twenty third of June, one thoufand feven hundred and fifteen.

IV. And it is alfo hereby enacted and declared, That the pre- to be accountfent or future commiffioners, or governors and directors of the able to the faid royal hofpital at Greenwich, or any of them, shall not be hofpita). anfwerable or accountable to any perfon or perfons, other than to the faid royal hofpital, for or in refpect of all or any part of the rents, iffues, and profits of the manors, lands, tenements, and hereditaments, comprized in the faid recited indentures of leafe and release of the twenty third and twenty fourth days of June, one thousand feven hundred and twelve, which accrued VOL. or became due from the death of the said Charles Radcliffe, and which have already been, or fhall hereafter be received by them, or any of them, except by laying fuch accounts before his Majefty, and both houfes of parliament, as by the faid recited act of the eighth year of his prefent Majesty's reign is directed; but that all fuch rents, iffues, and profits, and all fines and fums of money which accrued, or became due or payable from the death of the faid Charles Radcliffe, fhall be appropriated and applied to the uses, and for the purposes, in the said act of the eighth year of his present Majesty's reign mentioned, and herein before recited; nevertheless they the faid commiffioners, or governors and directors for the time being, fhall, from time to time, lay the accounts of their receipts, payments, and disbursements King and par. before his Majefty, and both houfes of parliament, as by the faid recited act of the eighth of his prefent Majefty is directed, as well with respect to the manors, lands, and hereditaments, comprized in the faid fettlement of the twenty fourth day of June, one thoufand feven hundred and twelve, as with refpect to the manors, lands, and hereditaments,, comprized in the faid fettlement of the twenty fourth day of March, one thousand fix hundred and ninety one..

and to lay their accounts before the

V. And whereas by reafon of the limitation herein before made to the faid Archibald Hamilton, Charles Smith, James Gunman, Sir John Thompfon, Sir James Creed, Peter Burrell, William Fawkener, William Baxter, Edward Vernon, Thomas Ripley, David Cockburn, James Spilman, William Allix, Fitzwilliam Plumptre, William Young, and Francis Danfays, of the faid manors, lands, tenements, and hereditaments, in manner as aforefaid, a doubt may be made, whether the tenants of the faid eftates ought from henceforth to do fuch acts and fervices, and pay fuch fines and fums, as by the nature and tenure of their eftates, founded upon immemorial ufage and cuftom, or otherwife, they would be to have done and performed, and paid on the death of any lord thereof, in cafe the limitation of the faid manors, lands, tenements, and hereditaments was made to a particular perfon only, and his heirs; now, in order to make the like provifions as were made by the faid act of the eleventh year of his prefent Majefty's reign, for obliging the tenants of the said eftates to do fuch acts and services, and to pay fuch fines and fums of money as aforefaid, it is further enacted Fines and fer- by the authority aforefaid, That upon the death of his prefent Majefty (whom God long preferve for the benefit of his people) and alfo upon the death of every fucceffive King and Queen of this realm, all fuch acts and services shall be done and performed, and all-fuch fines and fums of money fhall be paid by the upon the death of the refpective tenants of the said estates, to the faid commiffioners, King. or governors and directors for the time being, of the faid royal hospital at Greenwich, as by the ancient tenure thereof, or by any contract, law, ufage, or custom ought to be done, performed, and paid by them, in cafe the faid manors, lands, tenements, and hereditaments had continued to be, or were actually vested in his Majesty, his heirs and fucceffors, and that he
