T the Provincial Parliament, begun and holden at Quebec, the eighth day of January, Anno Domini One thousand eight hundred and one, in the Forty"fecond Year of the Reign of Our Sovereign Lord GEORGE the Third, by the "Grace of GOD, of the United Kingdom of Great Britain and Ireland, KING, "Defender of the Faith, &c.

AN ACT for the better prefervation of His Majefty's Government, as by
Law, happily established in this Province.

tempt that may be formed for fubverting the exifting Laws and Conftitution of the faid Province, and for introducing the horrible fyftem of anarchy and confusion, which has fo fatally prevailed in France; therefore and for the better prefervation of His Majesty's Government, and for securing the Peace, the Conftitution, Laws and Liberties of the faid Province; Be it enacted by the King's most excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the faid Province of Lower-Canada, conftituted and affembled by virtue of and under the authority of an Act paffed in the Parliament of Great Britain, intituled, "An Act to repeal cer ain parts of an Act, paffed in the fourteenth year of His Majefty's Reign, intituled, An Act for making more effectual provifion for the Govern "ment of the Province of Quebec, in North America," and to make further pro"vifion for the Government of the faid Province;" And it is hereby enacted by the authority of the fame, that every perfon or perfons who are or fhall be in prifon Council within this Province of Lower-Canada, at or upon the day on which this A&t shall receive His Majesty's Royal Affent or after, by warrant of His faid Majefty's Executive Council, of and for the faid Province, figned by three of the faid Executive Council, for High Treason, Mifprifion of High Treafon, fufpicion of High Treason or Treasonable Practices, may be detained in fafe Cuftody, without Bail or Mainprize during the continuance of the prefent A&t; And that for and during the continuance perfons be bailed of this Act, no Court or Courts, Judge or Judges, juftice or Juftices of the Peace, by any Court, fhail bail or try any fuch perfon or perfons fo committed, without a Warrant for warrant from the that purpofe from His Majefty's Executive Council, figned by three of the faid Executive Coun. II. And be it further enacted by the authority aforefaid, that for and during the Peace not to bail continuance of this Act, it fhall not be lawful to or for any Juftice or Juftices of the Peace within this Province, or in any Diftrict or part thereof, to bail or admit to bail, any perfon or perfons charged with the crime of High Treafon, or Milprifion of High Treafon or fufpicion of High Treafon or Treasonable Practices, any Law, Statute or Ordinance to the contrary notwithstanding.

III. And be it further enacted by the authority aforefaid, that for and during the continuance of this Act, in all and every cafe, in which application fhall be made for His Majefty's writ of Habeas Corpus, to any Court or Courts, Judge or Judges within this Province, or in any Diftri&t or part thereof, by any perfon or persons who are or fhall be in prifon within this Province, at or upon the day on which this Act shall receive His Majelly's Royal Affent, or after, charged with High Treafon, Mifpr fion of High Treafon, Sufpicion of High Treafon or Treasonable Practices, iuch writ of Habeas Corpus, (if allowed by fuch Court or Courts, Judge or Judges,) fhall not be made returnable in lefs than fourteen days from the day on which fuch writ of Habeas Corpus fhall be allowed, and in all and every fuch cafe, it fhall be the duty of fuch Court or Courts, Judge or Judges, and of each and every of them, and

roit être formé, pour renverser les Loix éxiftantes, et la Conftitution de la dite Province, et pour introduire le fyftême horrible de l'anarchie et de la confufion qui a fi fatalement prévalu en France; afin donc de mieux préferver le Gouvernement de Sa Majefté, et d'affurer la paix, la conflitution, les Loix et les libertés de la dite Province; qu'il foit ftatué par la très excellente Majefté du Roi, par et de l'avis et confentement du Confeil Légiflatif et de l'Affemblée de la dite Province du Bas-Canada, conflitués et affemblés en vertu de et fous l'autorité d'un A&te paffé dans le Parlement de la Grande Bretagne, intitulé, "Acte qui rappelle certaines par"ties d'un Acte paffé dans la quatorzième année du Règne de fa Majefté, intitulé, "Acte qui pourvoit plus efficacement pour le Gouvernement de la Province de Québec "dans l'Amérique Septentrionale," et qui pourvoit plus amplement pour le "Gouvernement de la dite Province;" et il eft par le préfent ftatué par la même autorité, que toutes perfonne ou perfonnes qui font ou feront en Prifon dans cette Province du Bas-Canada, au jour auquel cet Acte recevra la Sanction Royale de fa Majefté, ou après ce tems, fur un Warrant ou Ordre du Confeil Exécutif de fa dite Majefté de et pour la dite Province, figné par trois Membres du dit Confeil Exécutif, pour Haute Trahifon, récellement de Haute Trahifon, foupçon de Ha te Trahifon ou pour pratiques traîtreffes, pourront être détenues fous fauvegarde fans caution ou cautionnement durant la continuation du préfent Acte; et que pour et durant la continuation de cet Acte, aucune Cour ou Cours, Juge ou juges, Magiftrat ou Magiftrats de la Paix ne recevront à caution ou ne feront le procès d'aucune telle perfonne ou perfonnes ainfi commifes, fans un Warrant ou Ordre à cet effet du dit Confeil Exécutif de fa Majefté, figné de trois Membres du dit Confeil Exécutif, nonobftant toute Loi, Statut, Acte ou Ordonnance à ce contraire.

II. IV.
