Three Rivers.

WHEREAS the Inhabitants of the Town or Borough of Three Rivers are in pof

feffion of a Common, containing about four hundred and fixty eight Arpents of Land, in virtue of two Titles granted to them, one by Charles Huault de Montmagny, then Governor and Lieutenant General in this Province, bearing date the fifteenth day of Auguft, one thousand fix hundred and forty eight, the other from the Reverend Fathers, the Jefuits, bearing date the ninth day of June, one thoufand fix hundred and fifty; on various Lots of which many perfons have built houses before and fince 'the conquest of this Province by His Majefty's Arms, in confequence of Grants made to them by a majority of the Inhabitants of the faid Borough and otherwife; And whereas it is neceffary to make Provifion for the well ordering of the faid Common. Be it therefore enacted by the King's moft Excellent Majefty, by and with the advice and confent of the Legislative Council and Affembly of the Province of Lower Canada, conftituted and affembled by virtue of and under the authority of an Act of the Parlia ment of Great Britain, intituled, "An Act to repeal certain parts of an At piffed in the fourteenth year of His Majelly's Reign, intituled, "An All for making more effectual Provifion for the Government of the Province of Quebec, in Nori America, and to make further Provifion for the Government of the faid Province," and it is h reby enacted by the au thority of the fame, that it fhall and may be lawful, to and for the Inhabitants of the Chairman and faid Town or Borough, poffeffing Houfes and Lots of Ground, within the limits of Trufet to be the faid Town or Borough, of the yearly value of Forty Shillings Sterling, to affem. ble and meet at the Court Houfe, in the faid Town or Borough, on the firft Monday in the Month of June, next after the palling of this Act, at ten of the Clock in the forenoon, then and there, to choose by a majority of the votes of the Inhabitants of the faid Town or Borough, qualified as aforefaid, then prefent, a Chairman and four Chairman and Trustees, to manage and direct the bufineis relating to the faid Common, in the manBody Corporate. ner herein after authorited and directed, and for the purposes of this Act, and noneelfe, The Name of and the faid Chairman and Truftces fo cholen, fhall be and are hereby declared to be a to have perpetual Body Politic and Corporate, by the name of" The Chairman and Trustees of the Com"mon of the Town of Three Rivers," and by that name fhall have perpetual Succeffion and a common Seal, for doing their bufinefs, and that of their Succellors for ever, and fhal and may fue and be fued, in all and every Court in this Province, as occafion may be, and fhall and may do and execute all and every matter and thing relating to the Truft repoled in them, by virtue of this Act, in as full and ample manner and form, as any Body Politic and Corporate can or may as fuch lawfully do.

II. And be it further enacted by the authority aforefaid, that it fhall and may be powered to ap lawful to and for His Excellency the Governor, Lieutenant Governor or Perfon AdPrefide at the firft miniftering His Majelly's Government in this Province for the time being, to nominate and appoint a fit and proper Perfon to prefide at the first meeting of the Inhabitants of the faid Town or Borough, to be held in virtue of this Act, for the purpole of choofing

ATTENDU que les Habitans de la Ville ou Bourg des Trois-Rivieres font en pof

feffion d'une Commune contenant environ quatre cents foixante huit Arpens de terre, en vertu de deux Titres à eux accordés, l'un par Charles Huault de Montmagny, Jors Gouverneur et Lieutenant Général dans cette Province, en date du quinziemne jour d'Août Mil fix cent quarante huit, l'autre des Révérends Peres Jéfuites, en date du neu. vieme jour de Juin Mil fix cent cinquante, fur differentes parties de laquelle bien des perfonnes ont bâti des Maifons avant et depuis la conquête de cette Province par les Aimes de sa Majellé, fur des Conceffions à elles faites par une Majorité des Habitans de la dite Ville et autre ment, et attendi qu'il eft néceffure de faire une provifion pour la bonne adminiftration de la dite Commune, qu'il foit donc ftatué par la Très Excellente Majefté du Roi, par et de l'avis et confentement du Confeil Légiflatif et de l'Aisemblée de la Province du Bas Can da, conftitués et affemblés en vertu de et fous l'autorité d'un Acte paffé dans le Parlement de la Grande Bretagne, intitulé, "Acte qui rappelle cermines parries d'un Alte paflé dans la quatorzieme année du Règne de Sa Majesté, "introulé "Alle qui pour voit plus efficacement pour le Gouvernement de li Province de Québec "dans l'Amérique Septentrionale, et qui pourvou plus amplement pour le Gouvernement de la "dite Province" et il eft par le préfent ftatué par la même autorité, qu'il fera et pourra être loifible aux Habitans de la dite Ville on Bourg, poffèdant des Maifons et Terreins en dedans des limites de la dite Ville ou Bourg, d'une valeur annuelle de quarante Chelins fterling, de s'aff mbler dans la Chambre d'Audience de la dite Ville ou Bourg le premier Lundi du Mois de Juin prochain après la paffation de cet Acte, à dix heures du Matin, pour y faire l'Election, à la majorité des Voix des Habitans de la dite Ville alors préfents et qualifiés comme fufdit, d'un Président et de quatre Syndics, pour gérer et diriger les affaires relatives à la dite Commune en la maniere ci-après autorilée et dirigée, et pour les effets de cet Acte, et point d'autres. Les dits Préfident et Syndics ainfi élus, feront déclarés comme ils font par le préfent déclarés un Corps Politique et incorporé fous le nom de "Préfidents et Syndics de la "Commune de la Ville des Trois-Rivieres" et fous ce nom auront une fuccellion per pét elle et un fceau commun, pour gérer leurs affaires et celics de leurs Succelleurs à toujours, et pourfuivront et pourront faire des pourfaites, et être pourfuivis dans toutes et chacune des Cours dans cette Province, ainfi que le cas écherra, et exécute ront et pourront exécuter toute matiere et chofe relatives à la charge à eux commile en vertu de cet Acte, d'une maniere et forme auffi ample et autfi étendue qu'il eft loisible à aucun Corps politique ou incorporée de le faire en cette quainte.

II. Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être loifible à fon Excellence le Gouverneur, le Lieutenant Gouverneur ou à la Pertoune ayant l'adminiftration du Gouvernement de Sa Majefté dans cette Province, pour le tems d'alors, de nommer et appointer une perfonne propre et convenable pour préfider à la premiere Aflemblée des Habitans de la dite Ville, qui fera tenu en vertu de cet Acte

choofing and appointing a Chairman and Trustees of the aforefaid Common, who, by writing under his Hand and Seal, fhall declare who are the perfons chofen and appointed, to be Chairman and Trustees of the faid Common, and the perfon so chofen and appointed, fhall continue in office to the firft Monday in the Month of April which will be in the year of our Lord one thoufand eight hundred and five, and no longer, unless they fhall be afterwards re-chofen and appointed in the manner herein after di

III. And be it further enacted by the authority aforefaid, that it fhall and may be Jawful for the Inhabitants of the aforefaid Town or Borough, to affemble and meet on the first Monday in the Month of April, which will be in the year of our Lord one thoufand eight hundred and five, at fuch hour and place, as fhall, by notice given ten days before in writing pofted up at the doors of the different Churches in the faid Town or Borough, be fixed on for the choice and appointment of a Chairman and four Trufees of the aforefaid Common, to fucceed the Chairman and Truftees who fhall have gone out of Office, and the Inhabitants of the faid Town or Borough then prefent and qualified as herein before mentioned, fhall and may at fuch time and place, choose and appoint as herein before directed, a Chairman and four Trustees of the aforefaid Common, who fhall continue in office to the first Monday of April, which will be in the fourth fucceeding year, and a perion appointed by His Excellency the Governor, Lieutenant Governor or Perlon Adminiftering His Majefty's Government in this Province, fhall prefide, at such meeting, and declare, by writing under his hand and seal, who are the Perfons chofen and appointed to the office of Chairman and Trustees of the faid Common, for the four next fucceeding years and fo, in every fourth fucceeding year for ever, the Inhabitants of the laid Borough, qualified as herein before mentioned, fhall on the firft Monday of April, choose and appoint a Chairman and four Trustees of the aforelaid Common in the manner and form herein before let forth, and in cafe that the Chairman or two or more of the Trustees of the laid Common, fhall die, while he or they are in the faid office, the Inhabitants of the faid Town or Borough, qualified as aforefaid, fhall choose and appoint in the manner and form herein before fet forth, one or more perfon or perfons as the cafe may require, to fill fuch vacancy or vacancies to the time of the then next general choice of a Chairman and Truflees, as by this Act directed.

IV. And be it further enacted by the authority aforefaid, that it shall and may be termine on the on the lawful for the faid Inhabitants of the faid Town or Borough, at any general meeting, which shall be held by virtue of and under the authority of this Act, to fix and deter mine by the majority of the voters qualified as aforefaid, then and there prefent, on the number and extent of the Lots of Ground, being part of the aforefaid Common, which may be granted in the four fucceeding years, in the manner herein after directed for the purpose of building Houfes thereon with the yards, out-houfes and other conveniencies thereunto neceflary, and for no other purpose whatsoever; together with the Rents, Conditions and Services on which fuch grant may be paffed. Provided always, that it fhall not be lawful for the Inhabitants of the said Borough to grant or let for any term of years more than fifty Acres of the faid Common over and above what has been heretofore granted.

Et qu'il foit de plus ftatué par l'autorité fufdite, qu'il fera et pourra être Elections fublé» Joifible aux Habitans de la Ville ou Bourg fufdit, de s'affembler le premier Lundi dans le mois d'Avril qui fera dans l'Année de Notre Seigneur Mil huit cent cing, à telle heure et à tel lieu, qui, par l'avis donné dix jours d'avance en écrit affiché aux Portes des différentes Eglifes dans la dite Ville ou Bourg, feront fixés pour faire l'élection et nomination d'un Préfident et de quatre Syndics de la fufdite Commune pour fuccéder aux Préfident et Syndics qui feront fortis d'Office, et les Habitans de la dite Ville ou Bourg alors préfens et qualifiés comme ci-devant mentionné, pourront en tels tems et heu faire, et feront l'élection et nomination, comme ci devant dirigé d'un Préfident et de quatre Syndics de la fufdite Commune, qui continueront en Office jufqu au premier Lundi d'Avril qui fera dans la quatrieme Année fuivante, et une perfonne nommée par fon Excellence le Gouverneur, Lieutenant Gouverneur ou la Perfonne ayant l'adminiftration du Gouvernement de Sa Majefté dans cette Province, préfidera à telle Affenblée, et déclarera par écrit, fous fon Seing et Sceau, qu'elles font les perfonnes élues et nommées à l'Ofice de Préfident et Syndics de la dite Commune, pour les quatre Années fuivantes; et de cette maniere pour toutes les quatre Années fuivantes à toujours, les Habitans de la dite Ville ou Bourg qualifiés comme ci-devant mentionné, éliront et nommeront le premier Lundi d'Avril un Piefident et quatre Syndics de la fufdite Commune, en la maniere et forme ci-devant exprimée, ct en cas que le Préfident ou deux, ou plus des dits Syndics de la dite Commune décèdent tandis qu'il ou ils feront dans le dit Office, les Habitans de la dite Ville ou Bourg qualifiés comme fufdit, éliront et nommeront en la maniere et forme ci devant exprimée, une ou plufieurs perfonnes fuivant l'exigence du cas, pour remplir telle place ou places vacantes, jufqu'au tems de l'élection générale alors prochaine d'un Préfident et des Syndics, ainfi qu'il eft dirigé par cet Acte.

IV. Et qu'il foit de plus ftatué par l'autorité suldite, qu'il fera et pourra être loisible aux liabitans de la dite Ville ou Bourg, dans aucune Aflemblée génerale qui fera tenue en vertu et sous l'autorité de cet Afte, de fixer et déterminer par la majorité des voteurs qualifiés comme fufdit, là et alors prefents, le nombre et l'étendue des emplacemens, faifant partie de la fufdite Commune qui pourront être concédés durani les quatre Années fuivantes en la maniere ci-après dirigée, à l'effet d'y bâtir des Mailons, avec les Cours, Bâtimens et autres Commodités néceffaires, et pour nul autre objet quelconque, ainfi que les Rentes, Conditions et Servitudes auxquelles feront fujettes telles Conceffions. Pourvu toujours, qu'il ne fera point loifible aux Habitans de la dite Ville de concéder ou louer pour aucun nombre d'Années, plus de cinquante concédé plus de Arpens de la dite Commune, outre ce qui a été ci-devant concédé.

V. And be it further enacted by the authority aforefaid, that it fhall and may be lawful, to and for the Inhabitants of the aforefaid Town or Borough, at any general meeting to fix and determine, in the manner herein before directed, what fhall be the annual falary of the Clerk of the Chairman and Trustees, who fhall be by them appointed in the manner and form herein after directed.

VI. And be it further enacted by the authority aforefaid, that it fhall and may be frm the grants of lawful to and for the Chairman and Trustees of the aforefaid Common for the time building lots affented to by the being, chofen and appointed as by this Act directed, or any three or more of them, and inhabitants and to they are hereby required to ratify and confirm fuch Grants of building Lots on the faid Common, as have been heretofore allonted to Bonafide by a majority of the Inhabitants of the faid Town or Borough, at the time of giving fuch affent and to pafs regular and valid Titles for the fame, under the Seal of the faid Corporation, at the rents and in the conditions and fervices in fuch Grants fet forth, or if no fuch rents, conditions and fervices are fpecified in fuch Grant, then at the rent and on fuch conditions and 'fervices as were cuftomary, at or next before the time of making the fame.

VII. And be it further enacted by the authority aforefaid, that it shall and may be grant by deed unlawful to and for the Chairman and Trustees aferefaid, or any three of them, to grant. der the feal of the by Deed under the Seal of the faid Corporation, to fuch perfon or perfons as to them Corporation fuch building lots as may feem proper, fuch Lots of Ground for building on the faid Common as fhall have have been fixed been fixed and determined on at a general meeting in the manner herein before directed, and at the rent and on the conditions and fervices at such general meeting alfo fixed and determined on. Provided always, that it fhall not be lawful for the faid Chairman and Trustees, to grant to any perfon, nor to any other perfon or perfons for the ufe of the fame perfon, in the courfe of twelve years, any lot or lots of ground in the faid Common, containing in the whole more than one half of an Arpent, Paris measure.

VIII. And be it further enacted by the authority aforefaid, that it shall and may be lawful to and for the faid Chairman and Trustees, or any three of them, and they are hereby authorised and empowered to receive, levy or fue for fuch fum or fums of money as now are or may hereafter become due, owing or payable to or for the use of the Inhabitants of the aforefaid Town or Borough, by reason of rent, profit, or other cause, matter or thing belonging or appertaining to the Common aforefaid, or thereon depending and to give fufficient difcharges and acquittances for the fame, and alfo to exact and inforce the performance of all and every condition, fervice or other obligation to which any perfon or perfons may be bound in virtue or by reason of his, her or their holding, enjoying or occupying any grant or grants of any part or parts of the aforefaid Common or by reafon of his, her or their holding, enjoying or occupying any land adjoming to the aforefaid Common.

IX. And be it further enacted by the authority aforefaid, that it fhall and may be lawful to and for the Truftees aforelaid, or any three or more of them, to lay out and clearing &,, the expend or caufe to be laid out all and every fum or fums of money, which shall come into their hands, poffeffion or power, for rent or profit of the faid Common, or from any other cause arifing out of or depending thereon, in clearing, fencing, draining or otherwise
