to be the Intent and Meaning of the faid Parties. to these Presents, That the faid R. D. his, &c. paying the faid feveral recited Charities, and. other annual Sums of Money, amounting as a-. forefaid to the Sum of 13. 10s. yearly, during the faid Term, hereby leafed to the feveral Perfons, and to and for the feveral Ufes aforefaid, and thereof faving and keeping the said Dame M. S. and A. G. their, &c. harmlefs and indempnified the faid Dame M. S. and her Affigns, and the Executors, Adminiftrators and Affigns of the faid Major D. and the said A. G. and her Affigns, fhall and will yearly, during the faid Term hereby leafed, admit and accept of the Payment of the fame, to be in lieu and in full of the faid yearly Rent hereby reserved, and thereof yearly acquit and discharge the faid R. D. his, &c. during the faid Term here leafed, and from Time to Time, half-yearly, during the fame Term, give, make, and execute fuch Acquittance and Acquittances for the fame, to the faid R. D. his, c. as fhall difcharge him and them from the faid Rent hereby reserved, as the fame fhall from Time to Time during the faid Term hereby granted, grow payable and due, according to the true Intent and Meaning of thefe Prefents; Provifo, That Provided always, and it is hereby declared and agreed, by and between the faid Parties to nants herein these Prefents, and their true Intent and Meaning is, That the Covenants and Agreements herein before contained on the Part of the fame Dame M. S. to be performed, fhall extend and as Executrix. fhall be conftrued to extend to charge the faid Dame M. S. only as Executor aforefaid, and not in any other Capacity (any Thing herein before contained to the contrary thereof in any wife notwithstanding.

And the faid W. J. doth make, ordain, appoint, W. F. makes and in his Place and Stead put the faid A. W. his 4. W. his Attrue and lawful Attorney irrevocable for and in the Name of him the faid W. His Indenture, Tripartite, made, &c. Between J. H. of, &c. Efq; of the first Part, R. M. of the second Part, and R. N. Efq; of the third Part: Whereas by Indenture Tripartite, bearing Date the, c. made between the faid R. F. of the first Part, J. N. of, &c. Gent. of the second Part, and A. D. of, &c. Efq; of the Recital of third Part: The faid R. N. did demise, grant, the original bargain, fell, and to Farm let, unto the faid A.D. two full and whole fix and thirtieth Parts or Shares of the New River, brought from Shadwell and Amwell to London, with their Appurtenances, and all the Benefit, Profit, and Proceed, that fhould arife by or out of the faid two Shares ; Tohabe, hold, receive, perceive, and enjoy the faid two Shares, with the Appurtenances unto the faid A. D. his Executors, Administrators, and Affigns, from thenceforth for and during unto the full End and Term of 500 Years, from thence next enfuing, and fully to be compleated and ended, by and under the yearly Rent of a Pepper-Corn. (So recite the Covenant for levying a Fine to D. together with the Provifo thereupon; then recite the Conveyance of the Equity of Redemption to the said D. with the Provifo thereupon; and then recite the Indentures of, &c. whereby N. again releases his Equity to the faid D. who thereby affigns the Premiffes abfolutely to J. H. Truft. for 1500.) And whereas the said laft recited Indenture was fo made to the faid 7. H. in Truft, only for the faid R. N. and the faid 1500l. thereby mentioned to be paid to the said A. D.
