1891

This book prints four MSS. on Court Keeping dating from the middle of the 13th to the middle of the 14th century. The Pleas in the Littleport Court extend from 1285 to 1327.

Here we are to say something of the tracts and formularies which have for their subject-matter the local courts, which would teach stewards how to preside, clerks how to enrol, pleaders how to count and defend; and us also they may teach some things that we should hardly learn from real court rolls, just as the student of modern English land law is likely to learn much from a good book of conveyancing precedents that he would hardly, if ever, discover in any chance assortment of real instruments."-Preface.

This essay is based on the section on the Boroughs in Maitland's Domesday Book and Beyond; it was he who first saw the difference between the boroughs of heterogeneous and homogeneous tenure. Building on his foundation, Mr. Ballard has endeavoured, by an independent collation of the Domesday evidence, to ascertain the municipal customs of the latter half of the eleventh century.
